Mr [redacted] sites Article V, Section 1 of the Covenants. This section clearly states the Association is responsible for Common Elements and maintenance of the exterior of each unit. And the Association has and does maintain those Elements. That...

Section also states that Limited Common Elements for the use of only a few units are the responsibility of unit owner to maintain. Article I, Section 5 defines Limited Common Elements as any other fixture or improvement which lies partially within and partially outside the designated boundaries of a Unit or Lot, serving only that Unit or Lot. Mr [redacted] contention that the Association is responsible for his Limited Common Elements is without merit.
Mr [redacted] bought his 30 yr old unit in the fall of 2013 and his own inspector sited walls that needed painting and repairs needed to the fireplace. The Association paid him over $1300 in 2014 for repairs associated with his fireplace problems including leaks. In the summer of 2014, the Association replaced the roof of Mr [redacted]'s unit. He claimed the new roof leaked and the roof contractor paid, or is paying, him for repairs inside his unit. Mr [redacted] has been amply reimbursed for problems the Association is responsible for and is entitled to no further moneys.
