Ms [redacted] :Re: ID [redacted] Thank You for the opportunity to respond to Mr [redacted] concerns in a mediated exchangeI have read the complaint and would like to explain what transpiredDate of Purchase was 4/4/Mr [redacted] ’s trade in vehicle was paid off on 05-09-Any money paid by Mr [redacted] after the deal was made with Lakeview should be returned to him by [redacted] Bank because Lakeview paid the amount owed on the trade-inTrade payoffs normally take between 10-days to processIn this instance there was a problem with the payoff check as the original payoff check sent was not signedNaturally, it was returned to LakeviewMr [redacted] contacted me on Saturday May 7th and inquired about his payoffIt was a Saturday and because our accounting office is closed weekends and there was no one present for me to ask questions I explained to Mr [redacted] that I would be able to research his payoff on Monday when Mandy, the young lady whom handles accounts payable, would returnWe closed out our conversation with the understanding that Monday would be a follow up and I would be able to give him more exact information at that timeIt was not an hour later that his lady friend and an older gentleman came into the dealership and they were really agitated with me because they were demanding copies of checks and paperwork and I had to refuse them.Under store privacy policy as well as CFPB rules I advised them that I could not comment on the deal and that I had already spoken to my customer and that everything was already worked outThe young women told me that my conversation with Mr [redacted] never took place and that I was a liarThere was nothing to gain by arguing with them so at that point I asked them to leave and return with Mr [redacted] or a written letter from him excusing me from the privacy policy.Right after they left I sent three (3) texts to the only two numbers I had for Mr [redacted] (See attached transcript of texts sent from my phone)I was frustrated that somehow Mr [redacted] told them I refused to speak to him when I did not but I would not classify the texts as “nasty”These are the texts that Mr [redacted] s refers toApparently, the three text messages that I sent shows up as several smaller texts on older or less sophisticated mobile phonesOne of the numbers that I had as a contact for Mr [redacted] was apparently his wife’s phoneThis would be the exact same text that I sent to his other phoneSee attachedThese were the only messages I sentI asked pointed question to Mr [redacted] about why he would lie about a conversation we had an hour earlier claiming said conversation never took place as well as instructions for him to make a written statement excusing me from the privacy rules if there were to be future visits from his family/friendsSeveral attempts to reach Mr [redacted] by phone were unsuccessful.As far as repairs are concerned Mr [redacted] has a very comprehensive service contract (see attached) that has been and should continue to be used if he experiences any mechanical/ electrical failuresHe did call shortly after his car was purchased and it was discovered that there was a leaking valve cover gasket allowing small amounts of oil to burn on the exhaust manifoldThis problem was diagnosed and fixed by dealership personnel at no cost to Mr [redacted] The electrical problems that were changing his dash from English units to metric was simply a low charge on the battery, possibly from a courtesy light being left on, etcWe fully charged the system and have not heard of any additional problems from him again on the matterThere will be times in most people’s car ownership where the vehicle will require repairs, sometimes quite expensiveWe addressed all issues as soon as we realized a problem existedIf I purchased a vehicle and I smelled burning leather I too would be concernedAgain, as soon as we were made aware of the problem again we successfully addressed itThe valve cover gaskets were changed with no expense to the customerUsed vehicles break downThey are machines with moving partsAll we can do is address the problems as they become prevalentMr [redacted] had the foresight to purchase a superior extended service contract that will help defray some of the cost associated with automobile ownershipIn closing, I would like to remind Mr [redacted] we remain committed to helping him though any of his automobile needsWe hope this explanation from the dealership point of view helps all parties to understand that Lakeview has done whatever necessary, whenever possible to carry out our fiduciary duties.Respectfully Submitted, Michael B [redacted] on behalf Lakesale Resale Company

This is in response to the complaint submitted by *** ***-***.Mrs***-*** did make a purchase of a Jeep from Lakeview Resale Company which wewere selling under a consignment agreement with a third partyMrs***-*** did not putdown $with Lakeview Resale
as she claims in her correspondenceShe was to put down $1500because that amount was needed to sufficiently satisiS! the unpaid balance that was the amount that thebank was unwilling to finance because of the risk assigned to her loanIf she paid the other $to thelender then she did so against our instructions and signed agreements to pay Lakeview ResaleAll she didby paying the lender her down payment was to prepay her monthly paymentDown payments are kept bythe dealer as they are paying down the amount you owe the dealer for the car you are purchasing from thedealer.Mrs***-*** did drive the vehicle for several months on temporary registrationWe weretrying to secure proper power-of-attorney signatures from the consignor who was in Southeast Asiaworking as a consultantWe made Mrs***-*** very aware of the problems we were having insecuring the signaturesThe lender notified Lakeview that Mrs***-*** did not make herpaymentsShe had claimed that she believed the vehicle was stolen and therefor would not make payments.The lender did ask Lakeview Resale to repurchase the loan back from themWe did agree to do so under theagreement that they reassign the retail instalment contract back to usWe would then take responsibilityfor collection of the loan, If Mrs***-*** would refuse to make payments at that point wewould then repossess the secured propertyI made it clear to Mrs***-*** that this would bethe caseThere is no way that a person can just drive around for free and not make payments.The owner of Lakeview Resale did agree to accept the vehicle back from Mrs***-*** and tounwind the dealShe returned the vehicle with excessive mileage of over 11,miles in just months andwith $600+ in damages to the vehicle’s passenger front wheel and quarter panelThere was nounderstanding that I was aware of for any money to change handsAs Mrs***-*** stated inher complaint she only made two payments of $for the 7+ months she had the loanThe $thatshe did pay Lakeview Resale directly does not even cover the expenses that we incurred as a result of herexcessive mileage and damages to the vehicleWe disagree that Mrs***-*** is owed anymoniesShe stopped making her contractually agreed upon paymentsThis is why the deal went southWehad worked out the title issues before we repurchased the installment contract from the lender so that isnot why this deal was unwound.SincerelyMichael B***

I have tried a few times to respond/retract this complaint as the owner of Lakeview Resale did indeed address the issues with me; however, I could not find an option to do so until now.
