I have been in contact with *** to tell her that all she just needs to do is contact the sub contractor to get fronts delivered, but what I find out is that they are being sued buy the sub-contractor because they have not paid him for the work
he has done for them
So that be said,
They are not telling the whole truth at all
All they have to do is pay the sub-contractor and the fronts will be delivered to their doorstep
The way I got the job was through the sub contractor and that's the reason for non delivery
I heard the money that they refused to pay was more than $20,
That is the 100% reason for non-delivery

We do not accept the response provided by Mr*** for the following reasons:
Mr***'s response contains statements and allegations about us that are completely false
Mr*** has not contacted me regarding this complaint that I filed against him and his business
We were the "general contractors" for our house project and I initiated contact with Mr*** directly via phone and email regarding the fireplace purchase and all subsequent communication regarding the fireplace purchase were between myself and Mr*** via email and cell phone
Mr*** provided me with a quote via email, I accepted it and he was paid in full with a check made out to his business, Lakeville Fireplaces (via bank disbursement request that I submitted with his invoice to our bank upon initial fireplace installation)We are simply asking him to provide us with the glass fronts, remote and any other equipment and final installation service for which he has been paid
The allegations which Mr*** says he has come to "find out" and "heard" about us are completely falseWe do not owe the sub-contractor any money and we are not being suedThe fact is, we ended up firing the sub-contractorOur understanding is that our past sub-contractor and Mr*** are business acquaintancesNone of our business with the past sub-contractor has anything to do with this current business complaint we have filed against ***We do not understand why Mr*** chose to provide the glass fronts to the dismissed sub-contractor since we did not authorize such actionWe do want the glass fronts back from the sub-contractor
Mr*** needs to take responsibility to follow through with the business deal he had with us per our paid agreement we had with him
As you will note, the attached documents provide more detailed information to show that all business communications/transactions involving our fireplace purchase were between myself and Mr***/Lakeville Fireplaces
1) Summary of all email communications between me with *** regarding our fireplace purchase which also includes:
aThe fireplace quote with details of costs and services that were included provided to me by Mr***
bMy acceptance of Mr***'s quote
2) Invoice Mr*** submitted to me for payment via email
3) Copy of the check issued by our bank to "Lakeville Fireplaces" with Mr***'s signature
We are requesting that Mr*** follow-through on our requested resolution of this matterThe only resolution we are working toward is with Mr*** directly per our agreementHe needs to provide us a new set of glass fronts as replacements for those he gave to the sub-contractor and to leave the new set of fronts, along with the remote and all the other equipment that belongs to our fireplace at either the Burnsville or Jordon showroom so we can pick it upWe will then inspect the equipment and if damaged, will not accept itIn addition, we no longer want Mr*** to complete our fireplace installation, we will choose a different installer and then submit our paid invoice to Mr***, so that he can refund us once the installation has been completed

I know the *** did not want me to respond but here is all the things I found out since the last response
The *** Construction Mechanics Lien is #***
It was filed Oct 10,served to *** and *** on June In Rice County District court.No case # yet but they have days to respond.The only way I was able to get this job was through *** Construction.We have been doing business for plus years and have a very trustworthy relationship
Most every job I do for *** Construction I bring finishing fronts to them so they don't get damaged before finish product
In this instance they decided not to pay them for their construction services before the job was complete
I hope this helps to get to the bottom of why the fronts were not brought out to their house

We do not accept the response provided by Mr*** because he has included information in his response that has absolutely nothing to do with our complaint against him and his businessHis response does not provide requested resolution to this complaintThe documentation I provided as part of the my last response clearly shows that I worked with Mr*** directly to purchase our fireplace and that he was paid in full with a cleared check made out directly to his business*** Construction was not involved in any way with our fireplace, Mr*** came out to do the initial installation and told us at that time he would keep the glass fronts at his shop until we contacted him to let him know we were ready for final installationSo again, there was no reason that *** Construction should have ever received the fireplace glass fronts from Mr***
We do not understand why Mr*** continues to avoid his business responsibility to provide us with the final fireplace equipment and services he owes us since it was part of the paid agreement we specifically had with himWe still expect that Mr*** will follow through and provide the resolution we have requested for this complaint and nothing less
