I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
With the backdrop that as of mail delivery on November *, (the 65th day following the expiration of my lease), I still have not received the check that was supposedly issued on October ** and mailed on October **, let me provide a full timeline of the events of the last two months Approximately 90% of these are verifiable in the email correspondence I forwarded with my last response, the remaining 10% can be verified by the building's super, Lalezarian employees and my wife The timeline will show to any reasonable person (A) which party is responsible for any delays, (B) that Lalezarian has been misleading, at best, and untruthful, at worst, in its prior Revdex.com responses, and (C) a very clear breach of the day requirement to return my security deposit under the terms of the lease
August **: Conduct walkthrough with super at which time super informs tenant that nothing will be withheld from security deposit
August **: Move out of apartment
August **: Term of lease ends
September **: Receive security deposit form from Lalezarian infoming me of $withholding for cleaning oven and fridge
September **: I respond by email disputing the amount
September **: I receive email from Lalezarian informing me that I'm responsible for returning apartment in same condition I received it, essentially disregarding substance of my complaint
September **: I respond immediately asking to be put in touch with ***
October *: After receiving no response for weeks, I send another email
October ** *** sends email to another employee intending to inform me that Lalezarian is prepared to go to court if needed I am not included on email
10: October *: I call to follow up on my October * email Lalezarian employee forwards me *** email and I respond to *** and I correspond over email until I threaten to go to small claims court, report conduct to AG and Revdex.com, and send letter to tenants informing them of bad business practices *** phones me and offers to reduce amount I reluctantly agree to avoid court dispute and inform *** of all practices that I believe were inappropriate *** asks that I send back executed security deposit form signed by both tenants October **: I send back executed security deposit form to *** October **: I follow up on status of check and get out of office response from *** I receive email (attached) from another Lalezarian employee saying accounting never got the security deposit form I forward email from October ** evidencing that I sent the form Accounting confirms receipt and informs me it has been sent to accounting department for processing
October **: I follow up again asking status Accounting informs me "Once processed [I] will receive it in the mail", indicating to me that check has not been processed yet I respond with two harshly worded emails demanding a status by the end of the day I receive no response
October **: I file complaint with Revdex.com on 60th day following lease expiration
November *: I receive email from *** with copy of check supposedly issued on October ** and sent on October **, informing me that Lalezarian has responded to my Revdex.com complaint and accusing me of lying I respond to *** email and Lalezarian's Revdex.com response I check mail when I return home and no check has arrived
November *: I receive *** response to Revdex.com again accusing me of lying, maintaining that I caused the delay by disputing the charge, and insisting that Lalezarian complied with the terms of the lease
Again, I don't see how any reasonable person can look at this course of events and determine that Lalezarian has conducted business acceptably I would be happy to discuss this further over the phone with any Revdex.com personnel responsible for reviewing this file I am an attorney by trade, I paid my rent on the first day of the month every month while I lived in the building, I never caused an issue with any other tenants or management and I have no reason to lie, as I expect to receive a check in the next day or so and the matter will be resolved financially I am legitimately concerned about the way that Lalezarian conducted business and I am not willing to drop this until Revdex.com tells me that I am incorrect

Please be advised, as per this tenant's lease agreement, the landlord has 60 days after the end of the lease to refund the security deposit. We comply with terms of the lease and sent his security deposit...

Unfortunately the events described by the former tenant is not accurate, the check was in fact issued on 10/**/14, and we have provided proof of same to the former tenant. The tenant in this case delayed the security refund process by disputing the charges for the repair(s). In good faith we settled for less then the actual damages to close out the matter. All matters were handled in a timely fashion in accordance to the lease.

The term of my lease ended on August **, 2014.  It is now November *, 65 days after the term of my lease, and I have not yet received a check.  The company has stated that the check was sent to me on October **, 2014 (61 days following expiration of my lease, so they admitted to breaching my lease).  Lalezarian has sent me an image of the check dated October **, 2014.  However, when I inquired on October **, 2014 whether the check has been processed and sent to me, I received a response from the company stating "Once processed you will receive it in the mail."  I've attached all correspondence between Lalezarian and myself dating back to September ** as a pdf.  Based on the October ** email from [redacted], I think it is reasonable to infer that Lalezarian back-dated the check to October [redacted] in order to appear as though they returned the funds to me in a timely manner, considering that on October ** (six days later) [redacted] seems to indicate that the check has not been processed yet.  More importantly, in the correspondence you will see a pattern of non-responsiveness, unprofessionalism and even an admitted breach of the lease.  Over the past two-plus months, Lalezarian has attempted to charge me $175 to clean an oven and a refrigerator, until I threatened to go to small claims court and take other actions, at which time they reduced the charge to $85 (which I reluctantly agreed to in order to put this behind me), then they failed to process return of my payment in a timely manner, and ultimately breached my lease agreement by failing to return my security deposit within 60 days.  All of this conduct is completely unacceptable and I am concerned that if it goes without consequence, it will continue to happen to other tenants. 
Security deposits are meant to reimburse landlords for damages suffered at the hands of their tenants leaving an apartment beyond ordinary wear and tear.  Charging $175 or even $85 for cleaning and oven and refrigerator, in an arbitrary manner (I've attached their "invoice" for the reimbursement, which includes $25 for cleaning products), getting tenants to agree to a less ridiculous amount to avoid going to court, failing to pay them that less-ridiculous amount within the period set out in the lease and being completely non-responsive when asked for a status of the refund is not corporate behavior that should be deemed acceptable by the Revdex.com.  Had Lalezarian actually sent a check after we agreed to the lesser $85 amount, I probably would never have filed this complaint.  But taking into account the totality of these dealings with Lalezarian, I believe that they should be cited on the Revdex.com so that other potential tenants can be warned of what to potentially expect at the end of a lease term.

I unfortunately had a similar experience to the reviewer above. I lived in the Deco East Building managed by Lalezarian Developers for over two years and received experienced the most disgusting customer service. The doormen oftentimes lost packages and management is near impossible to get in touch with, and when you were able to get ahold of them, they were not the least bit helpful. I was once charged a $176 late fee for when my check was a few days late due to a major snow storm, and management did not remove that charge. Additionally, the super is very dismissive not helpful. The building is extremely dirty and there is always vomit and empty beer cans in the stairwell/on the roof. I one time saw human excrement in the stairwell and complained to the super who did nothing. Someone stole a smoke detector from my apartment and the super said I would not be charged - however, I saw a charge of $50 on my security deposit return form. During the walkthrough he said I would be charged around $400-500 from my security deposit for the shape of the floors - which was mostly pre-existing to when I moved in. However, when I received my security deposit statement, they took out $50 for a smoke detector & $1400 in floor repairs. I was in contact with Bibi and Chrystal who were EXTREMELY rude and refused to provide receipts for the smoke detector and a $1400 charge for floor repair. This is unacceptable. They are obviously trying to hide something if they do not provide tenants of receipts for what they are charging. During a nasty exchange of emails (extremely unprofessional on their part) they accused me of having 4 dogs, which is a blatant lie and accusation. They refused to provide proof of the 1400 charge and have not returned what was left of my security deposit. Instead of trying to scam their tenants, they should probably focus on becoming a better company. Check out their 8 1 star Yelp reviews - there's definitely a consensus. This management company is unprofessional and takes advantage of their tenants, avoid them at all costs.

Review: I leased an apartment in one of Lalezarian's properties at [redacted]. At the expiration of my lease, I conducted a walkthrough with the superintendent of the building to confirm whether any of my security deposit would be withheld and was informed that nothing would be withheld. There was no damage to my apartment beyond ordinary wear and tear. Two weeks following my lease expiration, I received a notice informing me that $175 would be withheld for cleaning the refrigerator and oven and I disputed the charges. Lalezarian could not produce a receipt for cleaning services in the amounts requested, rather, they sent an arbitrary list of cleaning charges, including $25 for products, on Lalezarian letterhead. Ultimately, I agreed with a representative of Lalezarian, [redacted], on a lesser amount. [redacted] failed to submit the payment of my security deposit for processing. Three weeks following the agreement on the lesser amount, [redacted] and other representatives of Lalezarian would not inform me of the status of my payment. Two months following the expiration of my lease and three weeks following the settlement on a lower amount, I have not yet received return of my security deposit.Desired Settlement: I would like Revdex.com to make this information public so that when other potential tenants conduct searches on Lalezarian, this information is available to them.
