The follow is our response to the complaint filed against us
We received a phone call from the insurance company of the homeowner in question stating that Mr*** was upset that James Proper Care DKI had not completed the repairs at
his house that had resulted from an ice dam claim over the winterThe original repairs were done in the last week of July and the first week in August The project manager at the time believed the job to be finishedAt no point in time did the homeowner ever call the owner - ***- or the company to express any concerns that he hadOnce the insurance company made us aware of the homeowner's concerns , *** immediately contacted the homeowner to set an appointment to view the deficiencies*** viewed the site at 10am on December and sent a carpenter crew on December 3, to address the deficiencies which were completed to the homeowner's satisfactionThe homeowner signed a work completion form stating that all repairs were done to their satisfactionAlso the day after the repairs were completed the homeowner called to thank *** and James Proper Care DKI and to express his appreciation for our good workmanship and for quickly addressing his concerns
We believe this matter to be now settled

After waiting a few months for the work to be completed by James Proper Care, because the employees of James Proper Care thought the job was done, but it was not, I decided to call the insurance company, again because the work was not completedAs stated in the comments by James Proper Care, the owner called me immediately after receiving the notice from the insurance company and we set up an appointment to review the matter*** came to my house and after looking at the deficiencies of the work took the appropriate measure and assigned another crew to complete the repairs the following dayThese repairs were done in a very professional and timely mannerI am very satisfied with the final outcome of this situationAgain, I must thank Mr*** for making this problem a high priorityHe delt with it to my utmost satisfactionAgain, thank youI will not pursue any further action about this matterAnd if I required the services of a restoration company, I will not hesitate to contact James Proper Care to remedy the situation

Our company has been in business since We strive to satisfy our customers and value the referrals they have given us.When customers are unsure of their property boundaries we recommend that they have their physical property corners marked by a licensed survey companyWe do not require
our customers to incur this extra cost for a property survey as the final placement of the fence is ultimately up to them as stated in our contract In this particular case the customer only supplied our company with the plot plan and had not located the physical property cornersThe plot plan supplied by the customer provided to the Revdex.com clearly states at the bottom: “Property corners should be relocated for the erection of fences”The customer accepted our estimate and signed our contract on 11/9/That contract with our company states “Customer hereby assumes full responsibility for the location of the line upon which said materials are to be installed.” On the day before installation of the fence, we contact the customer and review with them a list of questions on a standard questionnaire of which we have provided Revdex.com with a copyThe first question is “Are your property lines marked?” Our staff member had circled the customer’s response as “Yes” per the phone conversationOn the morning of 12/15/2009, our installation crew met the customer and the property corners were not visibly markedWhen confirming the exact location with the customer as our layout is subject to change the customer decided to enclose a row of rose bushes, which extended the rear fence line as originally contractedNote that we did this at no additional cost to the customer at the time.Seven years later, the customer contacted our company with her problemThe owner of the property behind her had paid to have his property corners located for the placement of his fenceHis markings showed that her fence was on his property so he asked her to remove it and she had been given a deadline to do so A representative from our company went to inspect the conditions at no charge and drew up an estimate of $to move her fence to her propertyA copy of that estimate is attachedWe agreed to work it in our schedule to perform her work in order to meet her deadline in the middle of our busiest time of the yearThe customer expressed in an email that she thought her fence should be moved at no chargeShe elected not to use our company to move her fence and now is asking our company to pay her $“to fix what they did wrong” We feel we do not owe her the money and that we did not wrong her.The customer also states in her complaint that “Truly their contract offers no protection to the consumer” and wants the Revdex.com to provide her report to othersWe welcome the Revdex.com to display our contract and it’s conditions so as to inform the consumers, not mislead them As you can see, we make every effort we can to establish where fences will be placed to satisfy the customer while keeping it in their boundary linesWe will continue to strive to provide quality fence installations and materials

I have reviewed the response made by the business in reference to complaint ID 11488225, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
[In reviewing the Company's response, it obvious Raatz is admitting they did not install the fence according to the contract agreement, signed by both the homeowner and the company representative, *** ***1) Indeed a property survey was provided to Raatz Fence, which supports the drawing on the contract for the location where the fence would be installedThe fence was to be installed well within my property, therefore no corner markings should have been needed, had the fence been installed ftoff the property foundation. If the contract was altered in any way, there was no revised contract signed by the owner that I am aware ofWould Raatz provide a copy of the revised contract showing the request to place the fence 21ft off the property foundation?2) Yes its been yrs since the fence install, however I do not recall meeting with anyone the morning of the install to give permission to place the fence anywhere different than what was contracted. Additionally the company removed numerous rose bushes to be able to install the fence3) On May 2016 we met with Mr*** at his office, looking over the contract and survey he had in file, he did admit it was his handwriting on the survey that supported where the fence was to be installedHe seemed, at that time, to be willing to make the necessary correction, however later presented me a statement to move the fence to where it was contracted to be originally, for $After already paying his company $to install the fence, we felt that it was unfair, as we were giving the company the opportunity to make right what they did wrong, and all the hardship it had caused us. Thousands of dollars in now matured landscaping and hardscape had to be moved, resulting in loss of much of the landscapeWe were given a short time frame to have this completed to avoid a legal situation with our neighbor, which we did not want. We were just asking Raatz to please correct their errorIf Raatz had my authorization to make the placement changes, I am sure they have a copy of a revised contract, showing I gave them permission to place the fence at ft., then please accept my apologiesHowever that is not how I remember itAnd truly I would have never thought I'd had to go check their work, to make sure it was done correctly in the location placementThe only reason I felt we were due the $is because Raatz thought it was a FAIR to charge a customer $to correct their mistake, then we equally should be entitled to that reimbursement cost from what I paid them to do a job, that was not done incorrectlyTruly they advertise "DO IT RIGHT THE FIRST TIME" and it was mentioned in the company's response, their Reputation- you would think they would have stepped up and done the right thing regardless, if having a good reputation was important to them. In sharing my story with many others, I have learned of numerous situations that they had experienced the same with Raatz exceeding the homeowners property line, and for Raatz it's just easier to state "It's the property owner's fault" than to make it rightYes that is the rehearsed statement of the company and the reputation that follows themI've always heard "mistakes will happen, however what you do with them will be your advertisement" In my situation, Raatz had a chance to make a big difference in a bad situation, and that story would have been told, rather, its easier to make excuses than to step up and do the right thingYou choose who you want to do business with!I would like my complaint to remain on Revdex.com, as it's important to protect the buyer to see what a company will do when given the opportunity to make something right, and what Raatz choose to do.Respectfully,*** *** ***
