Review: I am attempting to retrieve my deposit back after vacating an apartment on July 31, 2014. In fact my daughter has not lived in the apartment since July 31 2013 and has not been on the lease since that time. Her roommate remained and someone replaced my daughter on the lease (as my daughter studied abroad 2013-2014). There was confusion about the new girl's deposit and I allowed our deposit to 'ride' and did not request it be returned at that time, although I think it should have been returned. My daughter and I helped clear out her former roommate's apartment on July 31, 2014. I personally talked with the manager of the apartment, [redacted], on that day about the deposit. She made certain that she had my correct address. My wife contacted Chesterfield Apts on Sept 1 and was told that the lease says they have 45 days to return the deposit and that we would have our check by September 15. She called September 15 and was told the check is in the mail. It is now September 19. Mail from Richmond takes one to two days to get to us. She has called twice today and talked to office staff who remarked that she would need to speak with the person in charge, who we have yet to hear from. She left her contact information both times.Desired Settlement: Our deposit returned.

Review: I rented an apartment with Chesterfield Apartments for my daughter who is attending college in Richmond, Virginia. The lease was from August 1, 2013, to July 31, 2014, and required a $500 security deposit. All rent payments were made. My daughter moved out of the apartment at the end of the lease.

The terms of the lease say that the Landlord has up to 72 hours after Tenant vacates to inspect the rental unit, and after the inspection, landlord shall provide Tenant with an itemized list of any deductions from the security deposit which andlord claims. The security deposit or any unused portion thereof, plus any accrued interest thereon, due to Tenant, shall be returned to Tenant in accordance with the law.

As of today, six weeks later, Chesterfield Apartments has not returned the security deposit and has not responded to multiple inquiries in writing, by phone, and in person about the status of the security deposit.Desired Settlement: I would like Chesterfield Apartments to immediately return the security deposit or any unused portion plus accrued interest along with an itemized list of any deductions from the security deposit.

Revdex.com spoke with [redacted] from the company and he stated that if the consumer's did not provide a forwarding mailing address, the security deposits get sent to the office. [redacted] suggested the consumer contact him at [redacted] to provide him with information regarding the security deposit.

Response:

I have reviewed the offer made by the business in reference to complaint ID[redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I spoke on the telephone with [redacted], the assistant manager, on the morning of October 2 and he told me that a check was mailed to us on September 15. I told him that as of October 1, we haven't received any such mail containing the security deposit refund check, and asked to what address the check was mailed. The street address that [redacted] said that the check was sent is to not our address and there is no such street address in our neighborhood. [redacted] then said that he would talk to their corporate office about what to do, but would get right back to me. On the afternoon of October 3 , I again called [redacted] and was told that he was in the office but was on the phone, and would call me right back if I provided my name and phone number. I provided my information but did not hear anything further from [redacted].

Revdex.com spoke with [redacted] from the company and he stated that the corporate office reissued a check to the consumer for the correct address on October 8th.

Response:

I have reviewed the offer made by the business in reference to complaint ID[redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Two (2) security deposits totaling $750 ($500 by [redacted] and $250 by the co-tenant) were made for Chesterfield [redacted] for the lease period August 1, 2013, through July 31, 2014. The two security deposit amounts are documented on page 2, paragraph 9 of the signed lease. While it is true that a check was reissued, the amount of the reissued check was only $202.50, or $547.50 LESS than the total of the two security deposits made. No explanation of any deductions from the two security deposits was provided as spelled out on page 3, paragraph f of the signed lease. I am at a loss to understand why the landlord refuses to acknowledge the two documented security deposit amounts and return them to the tenants.
