Because the property was signed over in April 2015 and the maintenance fees were up to date at that time. If they had assumed the property as agreed upon there would be no late fees in our name. Sumday wants to refund us $226 and return the title. We paid $4,425 all total. $226 is not acceptable.
Final Consumer Response /* (3000, 22, 2016/04/05) */
In response to your letter let me say I am disappointed in the handling of this transaction form the beginning. After the initial paper agreement, April 19, 2015, nothing was done wit this account. In August of 2015 you requested a payment of $425 to pay a transfer fee. We issued that check to you August 16, 2015. You deposited that check in your account in OakStar Bank on October 9, 2015. I heard nothing form you until I called your phone number on the initial transfer paper work. At which time I was told Sumday Vacations was no longer in business. After calling several of the phone numbers on that paper work I was able to get an existing number for yo. Had this transfer been handled immediately the 2015 maintenance fees would have been up to date, but as the transfer was not completed the 2016 maintenance fees became due. It was at that point I began wondering what was going on.
In return you sent me a letter telling me I had two options regarding the ownership of this property. The only way that can be done is if my $4,425.00 is refunded. The transfer fees and the $4,000 of mortgage relief cost we paid to United Transfers LLC. On these Liquidation Papers second page it sates "we understand that United Transfers LLC guarantees that the abov3 resort contract will be canceled or any funds paid to United Transfers will be refunded not to exceed the original amount paid to United Transfers,LLC." Your agent [redacted] signed this paper as did my husband.
I chose to discontinue my business with United Transfer, LLC now known as Sumday Vacations. I expect full refund of monies and paper work given to Untied Transfers (Sumday Vactions).
Sincerely,
[redacted] E [redacted]

Mr. [redacted],
You have not followed the steps correctly to transfer your timeshare out of your name. You were supposed to pay Sumday Vacations for the transfer fee. Your contract that you signed states that you MUST remain current with your maintenance fees until the transfer is complete. We can still transfer your timeshare. You have chosen not to follow the procedure to allow us to do so. All you need to do is pay your maintenance fees and we can proceed.
Thank you
