Review: My current apartment at [redacted] was rented last June 2013 by myself in an agreement with Landmark Reality ([redacted] representative).

I was not told about a termite infestation when I moved in, only that the bugs in the bathroom were 'little house flies' and had just been exterminated.

I found out they were termites in March 2014, and immediately sent pictures and emails to Landmark. It took 1 month (after several phone calls and emails of pictures of the terrible infestation) for Landmark to reply. They finally sent an exterminator named [redacted] from [redacted]. The exterminator applied a foam treatment that would only buy the house a little more time. He said that he is at this house every year and that he has been telling the company to fix the problem, and that the colony of termites must be huge. He showed how he did his work and pointed to holes drilled in the bathroom wall from past years by himself. I emailed Landmark to tell them this news, and they denied ever having anyone there or knowing of the problem. For weeks I was living with dead termites falling out of the walls, in the shower, from the ceiling in my bathroom. The walls had all been sprayed with chemicals. I asked Landmark if they would kindly prorate my rent for the month or give a partial amount of my security deposit back to compensate for living with such a tremendous amount of bugs for months. They said no. Now that I am moving out and my lease is up at the end of May they say that they are planning to fix the issue.Desired Settlement: I would like an apology for the way they treated me, for lying to me about the issue, and for renting a house that had a huge termite infestation that they were aware of. a I was a loyal customer who paid my rent on time or early each month for the duration of my lease. I would like their business to be investigated or this house taken on the rental market so that other people in Ellensburg do not have to go through what I went through. I would also like my security deposit back or a prorated amount of money for living with a giant termite infestation for the months of March through May.

In response to this complaint, I have included email communication with the tenant refuting her claims of prior knowledge of and treatments for a termite infestation. In addition, we are waiting for a letter from the exterminator in support of our position, which is why this response is taking so long.

At no time did we deny her a pro-ration of rent and she is getting a full refund of her security deposit. see below

It should be noted that the tenant was at work during the foam treatment and a house guest let the exterminator in the house, so the conversation with him seems unlikely; and that the bugs were pointed out to her at the initial showing, prior to moving in, were not referred to as "house flies", were cleaned up with bleach and she was told to report if they re-appeared. We did not know what they were at the time.

Additionally, the further recommended treatment for the house was scheduled, at the tenants request, to be after she moved.
