this is in response to case id XXXXXX. the member signed a 3 month contract which we have. the first month is 60$ FEE which covers the personal training fee and setting them up a program. the monthly fee is 25$. so her start up fee is 90$. i...

trained her over an hour and set up program, and she was very happy. the next time she came in she told me she wanted me to number my machines because she didnt want to try to figure out where they are, and I said no because we move machine around from time to time and that I would help her until she learned where they are and with out another word she turn and left the facility. she still owes us for two more months. if she doesn't want her membership she can sell it we dont have a problem with that. just to let you know we have been in business since 1992 and have never had a complaint against us in all that time and even better not one insurance claim either. we are very proud of our record. so as far as her complaint to us she still owes us two more months.

I was NOT told there was a 3 month contract. I was told that if I agreed to pay for 12 months in advance (a contract) it would be much cheaper.
They did not contact me at all after they got my letter dated April 9th to tell me this either so I could use the facility So it does look like they knowingly/deliberately are taking money they know they have not earned.
So in addition to not telling me of any contract, ignoring my wishes for training there, they made no attempt to contact me since April 9th.
I will not pay for a contract that was misrepresented. In my April 9th letter, I had agreed to pay fees for 2 visits (which included his hour of training), and asked that the rest of my money be refunded. A reputable businessman would have been honest to admit that he did not tell me there was a 3 month contract, and recognize that he was ignoring my stated wishes for an exercising at the facility.
An honest businessman would have contacted me immediately when he received my letter dated April 9th to resolve the issue. This man did nothing until he heard from the Revdex.com.
It should not be expected that I pay for a month of facility use after my April 9th letter because I had no knowledge of a 3 month contract, received no contact from the owner to state otherwise, and have not used the facility.
This man owes me the membership fee and part of the 1st month's fee minus his hourly training fee and my one thirty minute use of the facility prior to the day he could find time to give me the training.

It appears this man feels his training session is worth $90. Since I had agreed to pay for his time, I accept his "settlement". He makes no apology for his behavior I have talked with several of his customers who have mentioned his pushy attitude (perhaps he doesn't realize how his passion [redacted] what he believes to be right comes across); they say they just ignore him and do what they want. That said, I regret my initial reaction to his behavior I am not proud of being rude to anyone; no matter the provocation; and I realize he might not recognize how condescending his attitude comes across. He has misrepresented several things in his last and previous statements, and has chosen to ignore several of my stated concerns, but at this point I see nothing constructive in re-addressing them.
I thank the Revdex.com for mediating this matter; as you can see from our responses, there was little common ground to work with.

in my last response to case XXXXXX, the member was definitely told all about a three month contract because she didn't want to pay for the year because she wasn't sure if she would stick with it. we have her signed copy and her waiver. there is a 65 dollar initiation fee which covers her assessment, designing a program for her and her personal training which we did and I know she was happy when she left. then it 25 dollars a month. the contract is for three months. the only thing I will do for woman is not charge her for the next two months which technically she owes. I would love also to say that we never for once misrepresented any thing to her and she knows it. she just didn't like to be told no, I and other members witnessed that. we will not for get her rude behavior. she needs to come look me in the eye and tell me all of these things shes saying. I would love to see that. you can ask any member of our gym that when we set programs up for people we follow up until they get an understanding of what they are to do and which machines are what and what form etc. we are extremely proud of our record and we stand by it. thanks [redacted] CRooks the owner and trainer.
