[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because:It is an inaccurate account.I immediately told the workers the stone did not match and attempted to reject the work The workers told me the stone would "age" in time It was not until I had another person look at the work who advised me stone would never age Evan walked through the project with me and agreed "it looked bad" I agreed with his proposal to mix the stones up, however, when this was attempted Evan said "they made it worse" Evan agreed to make it right so I "would have a better opinion" of his company Yet, Evan and his crew repeatedly no showed for appointments and did not complete any of the work on time I followed up with him repeatedly when the 9/date was set (which allowed them nearly weeks to complete the work), yet he never came back and never updated me on his plans to schedule completion of my project.Evan promised he could find a closer match and admitted he had not been present when the stone was picked up In Evan's reply, he states multiple quarry trips in an attempt to match the stone I would like it noted that a near-exact match was located by another company within a matter of days Evan has made at least visits to a property across the street (the property who referred me who has since complained about Evan and The Landscapers for many of the same reasons), yet he never attempted to follow up with me on the status of my project.At this time, I would like to request a refund for the labor and stone as agreed on in emails dated 8/and 9/ This is not a situation where the customer cannot be satisfied, it is a matter of Evan and The Landscapers failing to follow through on completing a project in a timely manner Regards, [redacted] ***

To Whom It May Concern:This is in regards to the complaint from our customer, [redacted] on 09/16/2016. In our initial Sales meeting on 03/11/2016 we looked at her patio. The patio had been installed by a previous contractor. Ms. [redacted] wanted to fill in some more space with a patio extension,...

using the same stones that the previous contractor used. I was able to advise her that the Stones were called Foggy Bottom, and are sold at local stone stores. She opted to pick the stones out herself, and we would provide the labor to install the Stones picked out and purchased by her. On that same day, we provided a price quote of S4,650.00 including $500.00 of labor for the patio portion of the work, per contract 5441 100. She wrote back to our emailed contract and asked for us to include the Foggy Bottom Stones in the contract. On 03/15. We sent over the revised contract 5441 100-2 to include the Foggy Bottom pallet. There was a mistake on this contract, so the final contract was resent that same day. 03/15, 54.41 100-3. The total cost of the contract was $5,047.50 and included the Foggy Bottom pallet.There was no specified color strain on the contract, nor did she ask for color approval before we began working.We collected the down payment of $1,948.00 and scheduled the work for the first 2 Weeks of April 2016. We got the Foggy Bottom stone, per our new agreement, and began working on Monday, 04/11. On 04/14, Ms. [redacted] wrote us an email stating how Well everything was going and how happy she was to be working with us. We processed the second installment of $1,550.00 on 04/15 with her approval. On 04/18, she wrote to let us know she had seen the stones and didn't think a second pallet was needed. On 04/19 Ms. [redacted] wrote us another email stating "Thanks for their work. :) looking forward to another project soon!". And again, on 04/19 stating "Thanks Evan - Sorry about that....They did a great job.". Once again on 04/20, in an email asking for an adjustment to her final bill ($75 for landscape fabric), she stated, "They worked hard and it looks good!".On 04/22, we sent out the final invoice, with a balance of S550.00 left on the contract, and provided an adjustment of -$305.00 for the pallet we did not end up needing and a $75.00 credit for some landscape fabric of hers that we used. That same day, she emailed giving us permission to process payment in full to her credit card we had on file.On 04/26, Ms. [redacted] wrote us and had a couple complaints about the wall that was built, and mentioned there were a couple of areas of the patio that needed to be adjusted. We returned and completed the adjustments on 05/13. We pulled up some of the existing patio and mixed in the new pallet of Foggy Bottom stones to come up with a better blend.We ended up using the pallet that we provided a discount of $305.00 for, and that balance remains on her account, unpaid.On 05/16 the customer stated that the blend was not to her satisfaction, and she was looking for us to fix it. The stones are different colors. That is the nature of the stone, they are natural stones and there is no way to get an exact match on the existing stones. It is always going to be a bit off.The customer was called several times, but we were not able to link up. She then reached out to us on 07/08 asking what the status was. I let her know I would bring by samples on 07/13 to try to get a closer match, and make her more happy with the work. Unfortunately, they still did not have a strain any closer to her existing color. After looking around at more local quarries, I found some samples and dropped them off 07/15. We did not hear back from the customer.On 07/27 we followed up, and she said she was still not happy with the color selections but they were better than what we had already installed. once again suggested that we pull up 5-15% of the existing stones and rework the old and new stones to blend them a bit more. She was not willing to accept this solution. We again tried to keep checking at the quarry for strains that were closer to what she expected, and said we would keep looking for something. Unfortunately, there is not an exact match on stones like this. It is never going to be an exact match.On 08/28, Ms. [redacted] asked us for an update and suggested we have the work completed by 09/16, or she wants a refund of the stones and labor. I agreed that we would have the work completed before 09/16. On 09/14, I let Ms. [redacted] know that I was not able to find the exact match she was looking for, and offered another solution of pulling up the entire patio, and reworking the entire space. She would not accept my solution once again, so I had no chance to fix the work before her deadline because she was not going to accept the solutions was offering. So on 09/16 I wrote her an email stating that, and even offered the following: “I am willing to offer the following proposal, in order to fulfill my contractual obligation and go beyond what I contracted and do more work to get the entire patio looking good, and leave you happy with our services. We come in, pull the entire patio up, old and new sides, mix up all the stones, and relay the patio fresh. The stones being the same Foggy Bottom style, with different colors all mixed up nicely will look as though that was our plan the entire time when viewed upon by fresh eyes. This gets you the patio of continuity that you've desired since the new stones were installed, and we can start the work this morning, and finish the project by the end of the day today, or at worst, will finish tomorrow.'In reviewing the contract and her complaints, I came to the conclusion that she was happy with the work, and after the fact is now trying to renegotiate the contract terms. We have satisfied our end of the contract, providing a functional patio in the style selection that she chose-Foggy Bottom. We also offered a solution- pulling up the patio and reworking the newer stones in to create a better blend, but she refuses. There is no way to please her. We are not responsible for the stone coloring, as it is an all-natural stone.
