This guest purchased three (3) three activity package for $per person plus tax (Parasailing is $60, Jet Ski is $and the Bumper Tube is $– on a stand alone basis.) The customers (3) arrived at our office, signed waivers and watched safety video The waivers – copy attached include a section that you will be responsible for damages in the event of a collision The safety video repeats this information Our staff also verbally lets the customer know they will be responsible for any damage In addition, the video and our staff tells the people to leave feet between them and any other jet ski This rule was violated and resulted in a collision The adult male rode a jet ski by himself; a younger child and his mother drove the other jet ski The ski the mother and child were operating struck the rear side of another ski There was damage We charge $per square inch for any damages The collision was witnessed by two USCG Licensed Captains One was on the bow of the boat and less than feet from the two jet skis He watched the ski driven by the younger child and mother strike another ski due to following too closely Picture of damages to jet ski is attached 5” x 2.5’’ = $ We asked for $ The customer initially denied any collision however, after explaining there is a video and witnessed by two people he did admit there was a collision The officer that was called to our business understood the situation and suggested we may want to file a civil action and offered no further advice He left the premises without paying for damages and we charged the credit card on file The customers are responsible for these damages The customer was offered a bumper tube ride and refused – “absolutely not”A refund was not appropriate as the activity was cancelled by the customer

I am rejecting this response because:
I can't even begin to tell you how many inaccuracies there are in this response by the businessPlease allow me to attempt to refute point by point.
From my point of view the company are obvious scam artists as even the police nformed us this happens often and he advised us to just leave and not pay the feeWe dont dispute that a slight bump happened but we dispute the sequence of eventsThey have a for rule but then their employees pushed the jetski out form the dock within to feet of another jetskiIn our view the staff was negligent as well as the other jetski equally at faultThe contact was so minimal I asked for proof of incident which they have repeatedly failed to provideNotice we only have after photo of the jetski which is on the wrong side of the contact They are making the sequence of events up to suit their astronomical damage clainWhere is the before and after photo? Where is proof this damage didn't already exist? Every jetski in the place has these same type marks all over themThe video camera was pointed at the drivers and shows nothing nor does it prove culpabilityThey obviously have a nice little scam going on by causing minor damage to jetski charging astronomical damage rates then never fixing the damage as evidenced by other jetskisWhen I questioned all marks on all other jetskis the employee even admitted that people paid the $but they obviously never fix the jetskisI can purchase a brand new jetski for $but a scratch costs $500? What rights does the consumer have? Shouldn't before and after damage agreement be gone over to point out all knicks and scratches beforehand like a rental car company has to do?
Listen this whole situation is extremely shady and I will not allow us to be connedAfter I informed them I would not pay damage without proof they denied bumper tube activity and even threaten to make us swim from raft back your our car instead of allowing us to take the boat taxiWe had an year old with us who they threaten to make swim in deep water back from the raft to try coerce us into paying the fraudulent damage claim.
Fraud has been reported for unauthorized charges to my credit card and charges will be disputedIt would make it easier if h2o would just do the right thingIf they refuse my credit card company will protect me but at least we have a forum to let potential customers of this business know about these shady activities and perhaps choose to spend money elsewhere.

verbally lets the customer know they will be responsible for any damage.  In addition, the video and our staff tells
the people to leave 100 feet between them and any other jet ski.  This rule was violated and resulted in a collision.

another ski.  There was damage.  We charge $40 per square inch for any
damages. 
The collision was witnessed by two USCG Licensed

and less than 15 feet from the two jet skis. 
He watched the ski driven by the younger child and mother strike another
ski due to following too closely.  Picture

2.5’’ = $500.00.  We asked for $500.
