Greetings [redacted], I’m writing you to follow up to the complaint you recently filed with the San Diego Revdex.com (“Revdex.com”). Abacus takes your reported billing concerns very seriously, and I would like to discuss the issues you brought to our attention in further detail. After...

an investigation into your account history, I found evidence that you provided written notice of cancellation to Abacus in April 2017 via a letter sent by e-mail. In accordance with that notice, Abacus immediately cancelled the month-to-month billing on your account. However, you indicated in your Revdex.com complaint that you had notified Abacus representatives of your cancellation before that time, and thus, you are requesting a refund for the billing in which Abacus continued to bill you. Please forward that cancellation correspondence to me via e-mail so I can verify, and provide a refund if one is due. Further, I would like to discuss the status of your AbacusLaw license. It appears you are requesting to be granted “legacy” status, and to enjoy use of an older version of AbacusLaw software without the associated support and monthly billing. While there are inherent dangers with using older, unsupported software, Abacus is willing to provide access to that older version to the extent that you are entitled to its use. Please reach me on my direct line listed below, or by replying to this e-mail, at your earliest convenience. Greetings, Thank you for providing the attached documentation, we appreciate your prompt response. Consistent with my statements in the prior response, the e-mail screenshots you included of conversations between you and Abacus associate Dusty Lillo are reflective of the several instances where Abacus went above and beyond its contractual obligations to provide downgrades, billing suspensions, and credits, all of which were provided to address external factors affecting your firm that were not caused by Abacus. For that reason, Abacus disagrees with your statement that services were never provided. In fact throughout a period of over one year, numerous examples of correspondence and support records demonstrate that members of your firm were actively using the products and services, receiving support from Abacus, and making monthly payments without dispute. Ultimately, as stated in our prior response, Abacus released your firm from its contractual obligations as a good faith gesture due to the untimely passing of your husband. So while Abacus has already offered tens of thousands of dollars worth of concessions in light of the circumstances surrounding your account, there is no basis upon which to grant a refund of payments that were made and collected while the services were provided.  You have my contact information, which was sent to you via e-mail, if you would like to correspond further, but unfortunately we will be unable to offer additional financial consideration to you.
