Larry B. Kawa Response • Mar 09, 2020

This patient was not unhappy with the procedure that was done but has made it very clear to us that he wanted additional work done at no extra cost or we could refund his money for a procedure that has been completed which was done flawlessly and without complication and has been successful. He has made it very clear to us in no uncertain terms that he was going to extort us through the internet unless we provided free services. We refuse to be extorted and we hope that you share our sentiments that the Revdex.com is not to be used as a tool of extortion. Due to HIPAA privacy concerns and respect for the doctor/patient relationship we are unable to disclose additional details without notarized patient consent. After a 40-year career as an oral surgeon with zero complaints to the Revdex.com or any other entity and as a former president of the American Association of oral medicine and as a graduate of both Tufts Dental and Oral Surgery programs followed by two masters degrees from Harvard, Dr *** is very proud of his flawless reputation. He welcomes the opportunity to support that the work that he did was both appropriate and fair. In order to do so please provide for us a notarized waiver of privacy of the patient as required by the Florida Board of Dentistry and the Department of Health. Absence such documentation you would unfortunately be putting us in an indefensible position. If Dr Segelman were as bad a doctor as this patient suggests, it is unlikely he would have a flawless track record as a Board Certified Oral Surgeon for the past 40-years.

The statement provided by *** Orthodontics addressing my complaint is simply not accurate. I am not extorting anyone; I am simply standing by the truth. I do not question Dr. *** education or his professionalism.
An honest man, regardless of education level, should stand by his words and actions.
During this experience, Dr. *** did not act honestly. When confronted initially, Dr. *** denied any wrongdoing after I have met with other 3 doctors and came back to his office again he admitted his mistake
The statement "...procedure that has been completed which was done flawlessly and without complication and have been successful" is a gross mischaracterization of what occurred. Dr. *** after being caught in denial, quoted the fixing of his error at $2500. He also sold me a "3D scan" on a CD for $241.
I am not asking for a financial refund of the procedure. My complaint is that after paying for the initial procedure $2300, Dr. *** refused to fix his error unless I paid an additional $2500. I am however, asking that he cover the cost of fixing his error by another doctor which cost me less than half of Dr. *** quote. -$1200
There are other people that have complaints against Kawa Orthodontics posted to the Revdex.com.

With my consult with Dr. ***, after he had seen scans of the past and present, he promised to help me in front of witnesses. He said he would push my teeth forward and outward. However, as soon as he put the braces on me I felt that everything was going in the opposite direction. Only within 2 weeks he pushed my teeth backwards, with spaces between my teeth. When I complained Dr. *** said, that eventually the teeth will be open forward And sideward. He told me that the arch wire is for 3 months and not to come back until then. However, due to the fact I still felt that my teeth were going backwards and narrowing, he ignored my complaints. Within 2 months, I complained to him about 4 times. I couldn't bear the uncomfortably of the treatment. So, I went to see him again and demanded to see the doctor. I showed the technician the gaps between my teeth and that my teeth were going backward and limiting the space for my tongue. Then Dr. *** asked me to take an x-ray. After reviewing it he decided to change the wires and put on a power chain. Within a few hours after leaving his office, my teeth pushed backward and down. I could not drink, eat, or speak correctly. I could no longer put my lips together to produce a seal. After a week of suffering I asked to remove everything. My situation became worse. When I complained about what he did to me, Dr. *** told me to go to an oral surgeon to take me to a hospital to fix the problem. Now I am in a devastated situation. Other doctors in ***'s practice had told me that they couldn't help me before I consulted with Dr. *** but Dr. *** said he could. Dr. *** lacks integrity, honesty, empathy, and morals.

This patient was dismissed for personally harassing me. When he first came in I gave him my cell phone number, not something a doctor does when, in his words, they lack integrity, honesty, empathy, and morals. He abused the privilege of having my cell phone and has called me as many as 10 times in a single day. He would leave harassing and threatening messages often with him screaming and crying to me on the phone. Then he would show up at my office unannounced and without an appointment many times demanding to speak with me. Then he joined the same gym that I joined and would come up to me while I was exercising, even while I was holding weights in my hand to talk to me and complain about his teeth. His chief complaint was that he did not have enough room in his mouth for his tongue and it was giving him nightmares. He somehow felt that I was going to create more room for his tongue. Then he would come in screaming and crying and leaving me multiple messages as well about how his tongue did not have enough room in his mouth. I have practice for 29 years and have never had a patient with this chief complaint. He even went so far as to have oral surgery with another oral surgeon and did a procedure that I did not even ask him to do. I spoke with the oral surgeon and even the oral surgeon said that he had recommended not doing this procedure but the patient insisted that he do it anyway. We have told him that if he returns to my office the police would be involved as he is not in a position to impose his will and bully my staff or myself and force his way into my office to demand that I help him with something which is quite obviously a mental issue not an orthodontic issue. I say this in the interest of accuracy not to denigrate the patient but it is clearly not the position of the orthodontist to take someone who is over 60 years of age and somehow make him believe that their mouth was going to grow. That was never something that I had even suggested to him and I don't know where he got that idea. He is now upset that he cannot reach me by cell phone and is not allowed to walk at my office without the police being present. His assertions are unfounded and he is simply using you as another potential Avenue to get to me even though it is clearly not indicated. After 29 years of practice I have a flawless rating with the Florida Board Of Dentistry, the American Association of Orthodontist, and the Revdex.com. After 29 years of practice I have a flawless rating with the Florida Board Of Dentistry, the American Association of orthodontist, and the Revdex.com. We treat the families of most of the local dentists and doctors and while I am proud of my staff and our abilities, I am also aware of my limitations. I unfortunately have been unable to help him and as clear as I made that to him he would not except the answer. Insisted on designing both his own treatment plans and his unrealistic expectations and now is trying to hold me responsible for them. If you would like me to forward his delirious voicemails of him screaming and crying about not having enough room in his mouth for his own tongue after 61 years I will be happy to do so. I have saved his voicemails. i'm sorry that you have to be involved in this unusual and unique situation and I thank you for your consideration and understanding. I wish this patient well and it is unfortunate that neither I nor any Orthodontist would have the ability to help him. That he made me aware of the unfortunate mental challenges he was facing and unrealistic expectations he had adopted without my suggestion, I never would have treated him in the first place. That is why I dismissed him. Well he clearly has the right to complain, I also have the professional responsibility to make a patient aware that I am unable to continue their care since I cannot meet their needs. -Dr

I again today have had a confrontation with the patient as he again approached me at the gym. The police were called and arrived, they said he is acting erratic and they are assessing him to determine if he should be baker acted due to the threat of suicide. This patient has harassed me numerous times.

Dr. Kawa is great at what he does. He has done braces for many people that I know and I have only heard positive things about his work. I highly recommend Kawa Orthodontics.

My daughter was told her braces would be on for 9 months to fix a very minor midline and bite alignment. They said if she didn't then she would have issues later on with her bite. They told us 9 months for 3200.00. 6 months in she felt no movement, they said they do not SHOCK the teeth. 8 months they said they needed more time. We kept telling them nothing was moving. 16 months later they took off her braces and began putting on her permanent retainers, but I stopped and asked if I could see them. NOTHING HAD CHANGED. Her midline and bite were still off. The two men who worked on her teeth for the 16 months admitted, in the main underwater room with others there to hear, that they did not have a plan on file for her. Dr. ***, who we had not seen, showed us it was a millimeter of change. He refunded us. I assume that's why my complaint is not showing here. Imagine - my daughter wore braces for 16 months (almost 2 years) with bleeding and metal in her mouth for nothing. Then today I notice the Office Manager for *** gave my company a bad review on facebook. He has never utilized my company or me for consulting or business transition. My review was in 2015! His review is recent. People should know about the way they run their business. Not sure why Revdex.com is not still showing my complaint as still showing as customer complaint but resolved. Meaning, I got the 3200 they were going to take without changing my daughters teeth back, but not the pain for my daughter for 16 months!

I would be happy to reply to this post once this individual provides us with a release composed by her attorney confirming that she has waived her rights to privacy through the federal HIPAA laws. I can assure you I have a suitable response but remain on able to reply due to privacy. until I am in receipt of this document. Please note that this review was submitted as a retaliatory measure due to a bad review that was placed on her husband's business. The above untrue comments were made in relation to a visit from years ago. Once again I would be happy to reply to these untrue assertions once I receive the necessary privacy waiver document her attorney shall compose. He or she must be sure that such privacy waivers are not only compliant with HIPAA but all current federal and state healthcare regulations. Furthermore, please be sure that this document is signed and notarized in order to be appropriately recognized as valid. I would also suggest you ask this complainant why she waited so long... Several years... The file this complaint if it was truly a genuine concern to her. Thank you for your consideration.

Customer Response

Dr. ***'s new office manager, *** posted on our ROCG Company facebook page just recently a bad rating (1) when Dr. *** nor Mr. have ever received services by our company, period. Upon finding this we documented and copied the posts. The only reason why we know it is his new Office manager is because Mr. wrote a review for ROCG in the last few days and 1 month ago a review for his employer Dr. *** (he wrote that he was the office manager on his review for ***). So we then put it together that Mr. posted this in retaliation for a post 2 years ago by a partner whose daughter had braces put on and taken off at ***. The reviews are online and the dates show it all happened 2 years ago, not recent. So there was no reason for this new office manager to come after ROCG. I want to reinterate that Dr. *** nor his office manager has ever utilized ROCG or its partners for services period. For them to rate our company is wrong. Upon noticing the facebook post from Mr. last night (which we have saved) we contacted Dr. *** via email and explained about his office managers post and that it should be removed. We let him know that we contacted Facebook, the Revdex.com, and documented the behavior on social media (all which I have documented). I am more than happy to supply the timeline and copies of everything. We have screen shots. As to him posting it to Ronen Shefers
business, it is a partnership of businesses, *** is the CEO. But to go after the facebook page when you never did any business with ROCG let alone 2 years later?

To then take it a step further - Mr. review goes missing at noon today (but we copied it) and then Dr. *** writes a bad review followed by ***. Again, who are the aggressors here? We are not hiding anything!

As to Dr. *** statement about why a complaint wasn't made 2 years ago ( not several as he states) last night we were documenting a review of the CURRENT SITUATION of rating our company in retaliation, out of nowhere, but noticed that the review the partner thought they did 2 years ago wasn't on the Revdex.com website. So the partner was looking into it further, emails, etc. with a Revdex.com associate. The events documented by our partner on social media are all true - no lies and the two men who worked on the partners daughter confirmed it, period. Dr *** gave a refund and that was the end of it. But the post on Facebook to a company page 2 years later - shows the mentality of the office and that should be shared. There is some bullying going on here and it will come out.

Larry B. Kawa Response

Please see my comment above. I would be happy to reply to this post once this patient waives confidentiality as described above. Until then we are on able to reply due to patient privacy and they're both federal and state laws per HIPAA and the Florida State Statutes. They are well aware of this and have chosen not to respond. We are still waiting as they have not complied with as they have not complied with these federal and state requirements that are necessary to proceed.

This was the worst experience I have ever had with a doctor's office. Not only does the office empty people without a college degree who then get to use sharp instruments in your mouth, the doctors themselves are useless and ineffective. Look at the mouths of the people working there, they do not have perfect teeth and neither will you if you uses this orthodontist.
