I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Mr. [redacted]'s determination that he can use an email address of someone that placed an eBay bid for a vehicle and then use the email address for his own marketing outside of eBay is completely WRONG.   The privacy policy that he quoted applies strictly to eBay transactions.  In fact, the eBay "rules and regulations" that he quoted is eBay's policy and applies only to how eBay can contact an eBay member.  It has absolutely nothing to do with Larry Green Chevrolet using someone's email address for their own marketing purposes.   I strongly suggest that if Mr. [redacted] and Larry Green Chevrolet are going to send unwanted and unsolicited emails, that they familiarize themselves with the CAN-SPAM Act of 2003.   Otherwise, they will surely come across someone who will make an example out of them via a very costly lawsuit.

Now, delete my name and email address and MAKE SURE THAT YOU NEVER SEND ME ANOTHER EMAIL.

Review: I placed a bid on a vehicle, through eBay, that was being sold by Larry Green Chevrolet. My bid was not high enough to meet the reserve price, so no action was taken. Larry Green Chevrolet obtained my email address ([redacted]) through eBay. Now, my email address is being bombarded with unsolicited and unwanted emails from Larry Green Chevrolet that do not comply with the CAN-SPAM Act of 2003. The link to unsubscribe took me to the website of a company called [redacted] Driver (AKA [redacted]). In order to unsubscribe, I am being forced to "read the GM Legal Statement and accept all terms and conditions". However, there is no "Legal Statement" or "terms and conditions" stated on that webpage, so in order to get my email address removed from Larry Green Chevrolet databases, I must accept terms and conditions that I am not being provided. This is clearly a violation of the CAN-SPAM Act of 2003.Desired Settlement: I want a letter from Larry Green Chevrolet ensuring me that they have removed my name, email address, and any other personal information from any and all databases used for marketing purposes. In addition, I want Larry Green Chevrolet to confirm that they have contacted [redacted] and instructed [redacted] to remove my name, email address, and any other personal information from any and all databases that [redacted] uses for marketing.

Review: They are just incompetent and need to be held accountable. 3 main complaints. 1. When purchasing my new car, I was told it was a Sonata Limited, my paperwork says Sonata limited but when I had service issues, found out its a Sonata SE, called [redacted] the sales person an asked her what make it was she again said a limited. I brought it to the Sales Manager he said "it doesn't really matter, the VIN number is right" I think this just gives you an idea of how incompetent they are and they don't care. 2. from date of purchase, I had issues with the blue tooth/stereo system. first issue was it would cut out momentarily, sporadically then the external temperature gauge went out completely. I was in thier service department 9 times (time off work) trying to get it fixed. I finally threw a fit and the sales manager told me to "Check my cell phone for the outside temperature". I was going to file a complaint with Hyundai and then they decided to replace the whole unit. After that, the temp gauge worked but the blue tooth/stereo cut out more often until eventually it would go out for days and then just come back on. Each time I took it in (even when it wasn't working) service said they could not duplicate the issue, they said they tried several fixes. However, none of these worked. I finally took it to an Audio Dealer and had them look at it, it took 15 minutes and they discovered there were bolts missing in the mounting. They put it back together and it has worked ever since. The audio dealer only charged me 45.00 but I think Larry Green should refund that to me because they installed it incorrectly and couldn't figure it out. I lost a lot of time and had a lot of aggravation because of this. The big one is last year when time for new tires I went to dealership they put on new tires, I paid 550.00, I immediately took it back because they car didn't ride right, it shook and felt unsafe. They were not happy with me, they put on a new set and said I cost them $200.00 because I was finicky. The new set was better but still didnt feel right but I didnt know what to do so I went with it. This year, time for new tires, I got a quote from Larry Green but took it to [redacted] to compare pricing, [redacted] said "that quote is for a 91v your car has to have a 95v for safety. its a weight limit issue. I went to [redacted], he said the same thing, So, I investigated on the car it clearly states tire requirements are a 95v. I called the service department asked why he had those on my car he sald "it really doesnt matter, they are just trying to get more money out of you". Actually [redacted] tires (correct tires) are the same price as their incorrect ones. I drive 30,000 miles a year for my job and my car is loaded with supplies. The dealer knows this yet they still put unsafe tires on my car and were going to do it again. I don't ever want to go back to them because I do not trust them.Desired Settlement: I want the $550.00 I paid for the unsafe tires they put on my car that put my life in danger everyday and I want the $45.00 I had to pay someone else to fix their mistake. thank you

We had a twelve passenger Van that we were selling and called Larry Green Chevrolet in Cottonwood to find out if they had an interest in purchasing it. We faxed over the title and registration so they had time to review it and check things out before seeing the vehicle. We brought the van to the dealership, and after their sales manager checked it out, our sales person said yes, in fact, they were interested since they did not have any vans on the lot, and the van was in excellent condition for 2007. The sales person said they would pay $9,000 for the van, which had a private party resell value of approximately 13,500. We were trying to make the sale an easy one, and that is why we called the dealership instead of placing an ad. We were told that the offer was good until the end of the month of October.

We were asked to bring the title, registration, and photo ID. When we arrived at the dealership, they said they wanted to check the van again and came back and said there was a problem with the mileage. The mileage on the new title showed 114,000 and the odometer showed 94,000. This was an error when the title was transferred to us. They said that in order for them to still purchase the van we had to go to [redacted] get a corrected title or we could take the van to a [redacted] dealership to have them run the test to prove the mileage had not been tampered with.

We went back to MVD and got what they asked for. Then, we made another appointment to finish the deal. (So far we had been to the dealership 3 times). We had an appointment that next morning to pick up the check and sign all the final documents. When we arrived, I was then told that they were only going to pay $7,000 for the van because they ran a [redacted] report and the mileage showed the incorrect mileage of 114,000, not 94,000. I had the original title when the van was purchased in June of 2013 and showed them the mileage, and that is why we were able to get the title corrected. They then told us that if we could get the [redacted] report corrected, they would still give us the original agreed price of $9,000. We filed all the proof we had and actually got [redacted] to send us a corrected report showing that the van really only has 94,000 miles, all within a week’s time. We called again and the sales person was out sick so we spoke to a different Sales Manager who was extremely rude about the and said there wasn’t any way that we got that report corrected and he needed to see for himself. We faxed this proof, directly from [redacted], to the sales manager and requested a return call to verify receipt, but we never got a call back from him. The next morning we received a call again from our Salesperson who advised that everything was fine and we should come in to finish the transaction. Then, the next morning, I called [redacted] on his cell, and he agreed to meet me between 10am and 11am. I called him again as I was leaving my office in Sedona, and then I called him again in route, verifying everything would be ready for me to come in and sign the paperwork and pick up a check for $9,000. He said all was good. As I turned in to the dealership, I spotted my white van with the hood up, doors open, and a sales person and potential customer looking at it. I went into the office where I met with [redacted], my sales person, and I was told that he was sorry and that the manager only wanted to give me $7,000 for the van. He said that the manager was “tired of dealing with the van,” but was willing to pay less for it. This is an example of how used car dealers get their reputation as being “used car dealers.” This was intentionally deceitful and dishonest on the part of the dealership. I cannot even imagine trying to purchase something from these people. I did everything that was requested, and then was offered a lower price, thinking I would be desperate to sell it. This is an example of the dealer trying to rip off the consumer.

As a Master autobody tech/painter, I have been in the car repair/buying business for 30 years. Rarely have I came across a team of people so willing to work so hard at getting the deal done. Barak S[redacted] is one of the best, most professional sales person(s) I have met to date. I put him through the wringer for a week, lol. He stuck in there and got me the right car at the right price. Trust me, if these guys can sell me a car then they really know how to match the right person, with the right car...with the right deal. And as a technical advisor/blogger for several large websites, I will be recommending them to all my readers. You can rest assured that when you go see Barack S[redacted] at Larry Green, you will be given the best deal possible. Thanks agian guys!

Review: There are many points I'd like to list as complaints but this tool does not allow that. Here is the data I have collected:

Found vehicle I wanted online at [redacted] Chevrolet in Cottonwood, a couple of hours away.

I purchased the same exact vehicle 2 years before for my son from [redacted] for the same price as this truck. It has been amazing with only minor age issues.

Called to see if it was still available before driving up. spoke to salesman [redacted].

asked for [redacted]. He read car fax to me over phone: ONE REAR END ACCIDENT 4 years ago. (signed witness statement the he confirmed this in person at the dealership when I asked to see it.)

Drove there and asked that truck be put on lift to examine under carriage.

Noticed Transmission fluid all over undercarriage.

Was told by salesman that they fixed a transmission problem and fluid was because they hadn't wiped it off yet. (signed witness statement)

Left there in my own vehicle to drive back to Phoenix. Noticed when stopping for a meal that car fax was not included in paperwork. Drove 25 minutes back to dealership to get car fax promised by [redacted]. Noticed there were TWO accidents, not one and the other accident willfully withheld was a Front end collision. Since I had spent hours there with the paperwork I agreed to take it anyway thinking that any major issues would be covered by the Service Contract I was purchasing from [redacted] (**)

[redacted] (**) called me multiple times because they could not get clear title from dealership to release the check to them. They were asked repeatedly to re-fax information to the dealership that they had already provided in order to get a clear title. They asked me to call the dealership. I called [redacted] several times and they kept telling me the bank was at fault as the they had sent the bank everything the needed and tbat the bank would not provide them with something they needed. The title the bank had received had a lien against it. I asked [redacted] dealership to come pick up the truck I was tired of doing all of the work for them. [redacted] and [redacted] (finance) assured me they would get it worked out. (Signed statement from [redacted] Bank Manager as I was in their office when this conversation occurred).

I met [redacted] courier at [redacted] on 6/7/2013 to do the transaction.

6/20 the engine light came on in my truck and the transmission fluid was all over the garage floor the next morning, (6/21). I called my local [redacted] to get it in for diagnosis They diagnosed it as broken transmission part and another part (broken motor mount) as being pre-existing conditions. They said [redacted] would have had to have broken the part or seen that it was broken when they were "fixing" the transmission leak. The broken motor mount had rust on the broken part indicating it was that way for awhile. (signed statement from witness 20 yr Dodge transmission mechanic.) (signed statement from Purchased Service contract Company inspection Mechanic who refused to cover it as it was a per-existing condition).

I reported it to sales manager [redacted] at [redacted] Chevrolet and gave him [redacted] Service Advisor name / number. Every time I called [redacted], they hadn't heard from [redacted]. I called [redacted] and they kept telling me they couldn't get ahold of anyone at [redacted]. Oddly enough I had no issues. Again I told them to come get the truck. They suddenly were able to get ahold of and work with [redacted]. Power dodge gave [redacted] a substantial discount to do the repairs. [redacted] made me pay 1/2.

3 Days after the repairs were completed, the engine light went on again and the truck was slamming into gear. I took it back to [redacted] thinking they would fix it under their repair warranty. Per [redacted] it is a different pre-existing issue. Confirmed by Service Contract Inspection Mechanic.

Tried to get a decision maker at [redacted] to talk with me about this. Called and left messages for [redacted] General Manager 3 times. No response. [redacted] called and left messages multiple times. No response. I finally outlined my intentions of filing complaints if I did not get a response in last voicemail then called again. He got on the phone this time. I outlined the situation and he said he would get "this staff's side of the story" the next day and call me back the following day. He did not. I left him a voice mail of my intentions to file complaints if I did not hear from him by the end of the next day. He called. We discussed it and he told me lies that his staff said I knew of transmission leaks and was okay with it! He said I needed to go to [redacted] to fix. He said the truck issues were outside of the lemon law because he counts the day I signed the papers as the date of sale, not the day the check and title changed hands in an actual transaction. I DID NOT DRIVE THE VEHICLE UNTIL THE DATE OF TRANSACTION BECAUSE THEY MADE ME TAKE IT THROUGH EMISSIONS! I could not even do that without a title. I paid for the truck, I paid over 500.00 (my 1/2 of pre-exisiting repairs and now it will be 1800.00 more to fix the 2nd round of per-existing repairs.

Their practices of lying about issues / repairs / car faxes / clear titles, etc. are unethical, unprofessional and these DO fall into the Lemon Law guidelines and are their responsibility.Desired Settlement: I want the repairs done to the transmission by power dodge paid for by [redacted] Chevrolet. I would never trust [redacted] Chevrolet to fix anything properly. I want the 500.00 I previously paid for the pre-existing repairs refunded to me.

I will keep my response short and objective. At the time the Dakota was taken to [redacted] it had exceeded the 15 day 500 mile implied warranty, as per their documentation. Our dealership was not required to participate in the repair work done at autonation on June 25th 2013 but we did it as a goodwill gesture to our customer. If the customer is not happy with the work performed at [redacted] then they should pursue having that work corrected by [redacted]. Based on documentation provided to us by [redacted] the second complaint dated July 25th 2013 had a diagnosis that is completely unrelated to any leak in the transmission. [redacted]'s service advisor also noted that some of the repair work was declined by the warranty company due to a lack of coverage for those specific repairs. This warranty was not purchased from our dealership. It is our determination that we did our part to try to exceed our customers expectations. In order for us to consider any further participation the vehicle would be required to return to our service facility for our technicians to check and advise. Thank you.

Our dealership did indeed have the title and lien release to the vehicle at the time it was sold. The transaction was consummated on the day the paperwork was signed but regardless of that fact there was almost 1000 miles put on the vehicle before it was taken to [redacted]. Our obligation is only for the first 500 miles but again we participated in the repairwork as a goodwill gesture. We will consider further participation but as stated before the vehicle must come to our dealership for further evaluation of the customer complaints. It should be understandable that if we already paid for half of the repairs at [redacted] and our customer is still not satisfied with those repairs then we are not willing to do that again.

I'm not sure how they can continue to lie when my bank; [redacted] waited for two weeks to get a clear title. I have a notorized signed statement from the bank manager. The truck had been sitting in my driveway NOT used for TWO WEEKS. They suddenly acquired a clear title. They should have paid for ALL of the repairs NOT half, since AGAIN it is on several expert witness statements that the issue was pre-existing. It is the same issue I questioned them about on the day I had them put it on the lift and saw transmission fluid all over the undercarriage. They said they had "fixed" the transmission. BY LAW a transaction date is the day money changes hands NOT when I sign a paper and have to wait 2 weeks to get a clear title before that transaction can occur. They did not say warranty was 500 miles they said 15 days. It broke in 14 days after TRANSACTION date, which is also the LEMON LAW. Does this also allow them to LIE about the accident on the Car fax? I WILL go to court over this.

They delivered the truck to me which accounts for 81 of those miles.
