Re attached estimate dated *** to replace flat roof section of roof, approximately *** sq ft, at *** *** and hired by ***

*** accepted by proposal in the amount of ***$ plus hst for a total of *** plus all woodworking costs if required after stripping and viewing bare roofSee attached fax dated***, days later, I spoke to *** on *** to explain how the work was to be completed due to the bad condition of his shingled roofI explained the bas and cap sheet of the modified room would have to be placed over top of the shingles due to the bad condition of the roof he was not replacingHe agreed
The roofing replacement that I was contracted to completed was completed that day with no additional woodworking required
While the men were working on the roof the ywere told by *** that his roof had been leaking for yearsIn speaking to my roofers, they reported to me that the shingled part of his roof was in extremely bad shape, granules missing, shingles badly curledI was NOT contracted to work on this section of his homeMy men commented it looked to be at least years oldIn conversation with the men on the roof he told then he was waiting for a credit card approval in the amount of ***$ to pay for the job he had given me the go ahead onThere was no $$ collected in advance of the men completing the jobTo this date I have not received cent
A couple of days later he contacted me by telephone to say his roof was still leakingI assured him there was no such leakage in the flat part of his roof that I had been contracted to replaceI told him I would come to prove it, by bringing a garden hose so his roof could be saturated to try to make it leekHe agreed to the fact that I sent men back to his home and could not make the new roof leak, he would have to pay an additional invoice for our timeTHE ROOF DID NOT LEAK! My men moved the spray of water to the old worn out shingled roof, and of course it started to leakHe agreed at that point to pay me the money owed for the service I provided on Thursday, November 5th, in full
At this point my men attempted to tar down some of the lifted shingles as a very temporary attempt to slow down the leaks until he could get the roof replaced, which was what he requires to solve his problems with his worn out roof* stated that it had stopped 97% of the leakage in the shingled roof
At that point my men measured up the shingled roof that had just been proven to be the source of his leaks as he wanted an additional quote to replace it, stating he did not have the money to do so, ***
I received a call from ***'s ***, ***, and stated that the shingled portion of the roof was years oldI advised her at that time that she should contact the roofing contractor who completed the job as there must be a defect in the shingles that were used and they would be able to make a claim to the manufacturer if that were the caseHer response was if you read the find print I would probably get nothing from that
On *** he started a *** email campaign to me refusing to pay, acusing me of *** (he did not pay penny to me) then trying to negotiate a lesser prise, after agreeing to the original quoteHe went so far as to call me at 12:11am on December 4th which is the middle of the night in my house, and not an appropriate time to discuss roofing business
Obviously this man has a roofing problem that he is not willing to address, and *** The men, materials and HST have been paid by myself* ***
I will be putting a contractor's lien on his home and will be serving him with small claims court documents for n***

One of the employees of the company reassured me when he was on the roof to give me a quote that the transition would be done properlyThis means removing three rows of shingles bringing up the flat roof over it and then re-shingling or replacing the shingles back on top of the flat roof partOn *** when I was sent the quote by email I was a little bit concerned that shingles wasn't part of the material list so I replied to the email asking about this matterI never got a response back or phone call back regarding the estimate and the details of the material not including shinglesLater that same night *** called me to confirm that his workers would be there in the next day to complete the jobBy then I had forgotten to ask about the shingles but I assumed later that this company was professional and that it was just an oversight that it wasn't specified in the estimate or that they would just reuse the existing shingles to replace on top
No one with the company had a conversation with me about the shingles being too old to replace on top of the flat roof until after the job was done and until after the leak started in the other room were never really beforeThe shingles that *** is talking about our only about seven or eight years old and there is no reason that they should be bad alreadyThe flat roof that they did does not leak and I never argued that pointThe reason it leaks now is because of the way to finish the job at the transitionWhat a professional company like Martin roofing should've done is point the detail to me before they started the job and say something such as we will have to buy shingles because of this situation and it's going to cost you extra and then I would've had the opportunity to say yes go ahead or no don't But I was never even given the optionHis men came two days later after it leaked when we had some rain and used caulking at the seam to try to stop the leak and it reduced the leak considerably but since then it started leaking more and more and it's just getting worseThe reason I did not pay yet is because the job was not done properly and until they come back and finish the job properly I will not be payingThe reason I called late that night as *** pointed out was because I cannot talk to that man on the phone *** He will not let me squeeze in a word edgewise and this was the business phone number from the phone bookI didn't realize it was his home phone and assumed he would get the message the next day
As far as the *** and this is not a matter that I was trying to get a job done for free*** Since they have worked on the roof, a new leak has sprung up in a different room that never leaked previously and we had tenant staying in that room prior to the roof job done by Martin's Roofing who can confirm that this room never leaked prior to their jobSo you can understand my frustration as now we have unusable rooms now instead of one and also why I don't feel it's justified to pay him at this time
I would be satisfied at this point paying *** **,*** for the work that he did do as I will need the balance to hire another contractor to finish the job properlyOr pay it in full to Martin's Roofing if they agree to come back and properly finish the job themselves
If this resolution isn't satisfactory to *** I am prepared to discuss this matter further in a court setting
