Complaint: [redacted] I am rejecting this response because:again [redacted] is incorrectI have bank statements proving the drafts for the past two yearsThey did call me after my card got changed and I gave her new card info and have proof of that chargeIn fact after researching I have found that I have overpaid $I was never given a receipt for my payments in fact when I asked [redacted] walked off and said he would take care of itI have spoken with collections and the lady actually yelled at me for directly dealing with ***That I was not letting her do her jobShe said she would contact him and then get back to me and that was weeks agoIt will be hard for her to contact him I'm sure since he has made sure not to be available during business hoursThis was after she advised me to stand down as I was going in with the police in towCollections has told me that he has to clear the account Regards, [redacted]

We have employees present at the gym everyday! The mailman drives by in his brown Honda crv, wearing street clothes and NEVER gets out of his car to bring in certified lettersThe sender PAID for this serviceThey paid to have the letter brought in so ANY employee can sign for itThe sender should get a refundOnce again we will accept the 1st certified letter as proof and go by that dateWe cannot cancel anyone without knowing they are trying to cancel by letterWe also do not have a [redacted] in our computerWe have a [redacted] ***, but no [redacted] Thanks

There are employees present at the gym at all timesThe mail men are not bringing in the certified letters that the customers are paying forWe have complained many times to post masterThey refuse to bring letters inside, and we have no idea if a customer is canceling or not without recieving
certified letter which is required by the state of Texas attorney generals officeThis is an ongoing problem with the post office and not the fitness centerWe are present and any employee can sign for letter

I was never given a receipt for my payments in fact when I asked [redacted] walked off and said he would take care of it. I have spoken with collections and the lady actually yelled at me for directly dealing with [redacted]. That I was not letting her do her job. She said she would contact him and then get back to me and that was weeks ago. It will be hard for her to contact him I'm sure since he has made sure not to be available during normal business hours. We have gone round and round with the post office. They are not bringing in the certified letters that the customer is paying for. It's a small town post office and the do not drive postal cars or wear uniforms. They use their cars and wear whatever they want. They are required to bring in certified...

letters for us to sign, but refuse to get out of their cars. Then they tell customers we are not here when they come and send them back. Please advise customer to bring 1st certified letter into gym so we can have proof of letter and date it was sent.. this is required by the state of texas for cancelation of gym membership..thank you

I am rejecting this response because:
I have tracking copy with a note saying a notice was left because an Authorized recipient was not available. If a staff member is present at all daytime hours, then the certified letter was not allowed to be signed by said staff. I spoke with the postmaster who indicated that he has my letter at the post office awaiting pickup. If indeed there is an issue with mail not being brought in, then the business owner should take responsibility and go to the post office and collect any undeliverable mail. If there was indeed a complaint made to the post office by said owner, then a resolution should be made so that members can follow the contract guidelines as stated. When my letter comes back to me, I will personally bring my "certified letter" to the gym to be accepted by Authorized staff as I followed the required contract obligation to send such letter certified.

Mr [redacted] let months go without payment, didn't return phone calls, and made no attempt to correct his lack of payment. This IS WHY he was sent to collections. Yes he did pay his balance off AFTER collections started calling him. Which months had passed. Once someone is sent to collections, they...

have to deal with the collection company. We DO NOT like having to send someone to collections, but when customers like Mr. [redacted] are not paying or responding to our calls our hands are tied. He can show proof of payment (which he has in his posssesion) to the collection company and have it removed by them.

I am rejecting this response because:First tracking # [redacted]....notice left on 4/23/15 comments say no authorized recipient available, unclaimed 5/11/15' returned to me with notice left on 5/20/15. I went to the post office to pick it up and it shows delivered on 5/22/15.second tracking# [redacted]....notice left on 5/26/15 if it is unclaimed after 15 days the post office will return it. If no one is available to sign for the letter a notice is left for the business to pick it up. I can only come by the gym on the weekend. I am pretty sure that even if I bring the letters and proof of certified mail there will not be anyone there to cancel my membership. Your policy says to send a letter certified mail. I have done it twice. I should not have to come in to the gym.
