When Mr. [redacted] purchased his pool, he bought it from a competitor of Viking Pools (Blue Hawaiian Pools). Viking Pools has subsequently purchased Blue Hawaiian pools, but only purchased the assests, not the liabilities. The pool warranties for pools manufactured prior to Viking's acquisition are the...

For 3 yrs. now the representative of Latham pools Ms. Cindy W[redacted] wascommitted to providing the repair (I have several e-mails with thosestatements)I find those statements binding and the company should come out and repairthe fiberglass pool, hopefully in spring 2016.I will be contacting Mr Erdelac soon. Ms. Cindy w[redacted] has ALL the informationMr. Erdelac was requesting. There should be no cost for this minor repair.

I have had the opportunity to review the documentation and emails related to this particular swimming pool.  Per the terms of the Limited Lifetime Warranty, there are specific requirements of the homeowner related to a warranty claim.  In this particular instance, the homeowner has refused...

to perform their requirements in order for the pool to be repaired.The warranty is very thorough relative to what is and what is not covered on a pool.  This particular pool was purchased in 2012 by a contractor.  According to the paperwork, it was not installed until September of 2014.  During that time frame my organization has no knowledge as to how that product was stored or what condition it was in at the time of installation.In spite of that, as a gesture of goodwill, we offered to fix the spot(s) on the pool that were showing some modest discoloration or had become rough.  Per our standard repair protocol, we issued paperwork for the homeowner to review and sign.  This paperwork is required for us to schedule the repair.  The homeowner refused to sign the paperwork due to a clause relating to draining and bracing the pool, and a clause related to incidents that occurred during the repair were not toe responsibility of the manufacturer.The draining and bracing of the pool is a requirement by the homeowner per the terms of the warranty.  The homeowner claims they did not receive a copy of the warranty.  Our website has the warranty posted on it for easy reference and we supply every pool with a Customer Information Packet that includes a hard copy of the warranty in place at the time of sale.  Whether the homeowner received the Customer Information Packet would be the responsibility of the contractor and not the manufacturer.Regardless, in an attempt to further assist the homeowner, we decided that we would drain and brace the pool and get the repair completed.  The homeowner continues to refuse to sign our paperwork referring to the clause related to potential incidents that may occur on the site.At this point, it is my contention that our organization has been very accommodating and willing to go above and beyond our requirements on a repair that may or not even be a warranyt item.  We are at the ready to perform the repair.  all we need is for the homeowner to sign our paperwork. Best Regards,[redacted]

I apologize for the confusion.  The agreement was made in previous emails to the complainant that the company would perform the drain and brace at our expense and risk.  I assumed that fact in my recent response that we were modifying the repair agreement.  To be specific, the company will drain and brace the pool and assume the risk related to draining and bracing the pool along with removing the clause related to damage to the site caused by the company repair crew.  The remainder of the repair agreement will be in full effect.What we are requesting is for the complainant to sign the revised repair agreement so that we can commence the scheduling of the repair.   Regards,[redacted]

Spoke to Pool Builders, ([redacted]).  Contractor advised that they have put a new liner in pool on 4/28/16.  As Liner has been replaced, we consider this matter closed.
