August 26, In response to the consumer complaint ID # [redacted] filed with your office on August 10, 2015, it must be immediately noted that the customer DID NOT pay ANY amount of money out of her own pocket toward the purchase of this vehicle on the date of saleThere was a signed financial “agreement” between the customer and her employer, in which her employer fronted ALL of the Down, tax, tags and registration money ($1,570.00) to which the customer would pay her boss back through payroll deductionsSo, the money she is requesting to be refunded was never hers to begin with.On the date of purchase, the customer, her boss and customer's ex-boyfriend (also boss's son) showed up together to purchase the vehicleThe customer is correct in stating that a few days after the purchase of the [redacted] the transmission began leakingUpon diagnosis that the car, in fact, needed a transmission rebuild or replacement, I informed “them” that Lauer Brothers Auto Sales would be replacing the transmission at No COST to the customerIn agreement with the customer it was approximately two weeks we had the [redacted] due to many communications between numerous salvage yards and transmission shops to ascertain what the most cost effective means of repair would beAround that same time period, two weeks, the customer and an acquaintance (customer's brother's girlfriend) stopped by the lot and we had an at length discussion and it was requested and agreed upon at that point to allow the customer out of the remaining car loan (which they were both very relieved to hear)It was clearly stated and agreed upon by all that the money the customer owed her boss would still be paid by the customer according to the “agreement” between those two partiesThe acquaintance Commented that the binding financial agreement between the customer and her boss would be the customers "life lesson" in not having a family member included with her financial decision to buy a used carNow, in an attempt to run a respectable business and assist a young inexperienced customer, did, in fact, extend an offer to “try” to refund a portion of the money fronted by the customer's boss.There was never ANY communication stating that the entire or even a partial refund of the boss's upfront money would be guaranteed to be refundedSo the customer's recollection as she stated in her complaint letter;" was told I would get my down payment back.", is a flat out LIE!!! About a week or so after I told the customer I would try to refund some of the money, the acquaintance (customer's brother's girlfriend) called to ask if I had made any decisions, at which time I asked for a little more timeMy request was granted and the acquaintance (not the customer) called a day or two later and demanded I let her know that dayI tried to explain to her that I was on vacation for a week and that Lauer Brothers Auto Sales was not my own personal business and try my hardest to run a reputable business on a "shoestring” budget and that if she would not afford me more time to check the budget then my decision was to refund her nothingAgain, there were NEVER any promises or guarantees made to refund any amount of money, not to mention it wasn't even the customer's money to refundLauer Brothers Auto Sales will not refund any of the customer's boss’s money as per the customer's requestIf you should require any additional information, please feel free to contact me, Respectfully Submitted, Kyle BOffice Manager
