Review: We hired Lavezzo Construction to do work on our floors prior to moving into our new home. He was contracted to tear out the existing flooring (300 sq ft of glue down hardwood) and then install 930 sq ft of new floors. In the middle of the job, he demanded roughly 2.5 times the money to finish the work, though the scope was within the bounds of the original contract. On the first day, May 6, he scraped maybe 2-3 square foot of floor, and was on the job no more than an hour or two. On the next day, May 7, he did not show up until 11:00 and then left at 2:50, a larger chunk of time that was spent doing other tasks and taking out only a few additional feet of wood floor. He then never showed back up to work. As such, we had to turn to another contractor to finish the job, one who finished it at an appropriate rate, and in a single morning. When approached for a refund due to a breach in contract, [redacted] refused to give our money back, ignoring the fact that it was a large deposit because of the vast amount of work we had contracted him to do beyond tearing out the wood floor. He claimed it had been consumed by tool rental (which was not a tool that was usable for the job, as he found out) and that it was within his contractual rights to keep our money. In reviewing the contract, there is nothing stated whatsoever about his ability to keep our deposit without completing the work. Furthermore, the contract states that he may only stop work to request money if "issues are found that were hidden from sight during the original estimate." He knew that the glue down hardwood was on concrete and could see it from the tear out of the carpet we had done ourselves in an adjacent room. Despite being warned about the level of difficulty of this project, he knowingly cited us the price and listed the project fully in the scope of work. Furthermore, he claimed in his email that it was taking more days and thus more money than originally anticipated, forgetting that we were here during his work.Desired Settlement: Because the contracted work was not completed as specified in the contract, and the contract does not allow for Lavezzo to keep the deposit without completing the work listed therin, we require that our deposit of $630 be refunded.

I spoke with [redacted] with the company. He stated he originally contracted with the customer to remove and put down new floors. The job would typically take 2 days to complete. When the work began they came into some difficulties removing the wood. They rented a floor scrapper which in turn did not remove the wood. When that tool didn't work they rented a new tool. Once they were able to determine that the floor was not coming up even after renting a second tool they gave the customer a price for a change order as per the original contract both parties signed. Ms. [redacted] did not accept the new change order and requested a refund. The deposit is non-refundable and was told to the customer and it is also on his website. The customer is not warranted to a refund in this case.

[redacted] was contracted to remove glue down hardwood floors. He knew the type of flooring it was going into the job. The contract only stipulates a price change for unforeseen circumstances. There was nothing unforeseen in the job. He knew from the beginning and included in the contract the type of floor removal he was doing. His incompetence in gauging what machinery or method to properly use in that job should not be charged to us. It is not our responsibility to pay for his guesses at a job that he clearly was not qualified to do. He had no business taking our money if he lacked the ability to properly handle the job. We trusted his assurances that he knew what he was doing and, simply put, he lied. We should not be left holding the bill for that.
