Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me and the matter has been resolved

I have been astonished by [redacted]’s allegation. [redacted]’s comments are not credible. At the outset of our meeting, I never promised the deadline of her desire. In our written contract, it is not mentioned, either. Besides, by the various date she insists on our deadline, the client’s work was not done yet, as of now. In addition, under the Immigration and Naturalization Act, it is the US petitioner who petitions to [redacted], not the beneficiary (in this case, [redacted]). I confirmed with the petitioner that there is no need for [redacted] to come to US in January 2017. Rather the petitioner thought that it would be better for [redacted] to prepare well before moving to the US. [redacted]’s insistence on her own deadlines are not based on the petitioner’s needs, but just [redacted]’s desire for control. Speaking of money, [redacted] sent $4,500 instead of just $2,000 retainer I requested because she found that the exchange rate suddenly looked good on that day (I have a copy of e-mail.) Here she wrote as if she was doing me a favor in hope for additional service. As [redacted] wrote, she was given as much as $1,500 discount out of $6,000 our regular fee in this case. Later, she even confessed that other law firm quoted $6,000 plus $2,000 in total $8,000 because the volume of materials she brought was too much. So that it is practically $3,500 savings for [redacted] already. She did not present her possible evidence for O-1 petition at our first meeting so that I based on the fee on a regular case plus her expected ability to concisely present the necessary evidence. It is less than candid of [redacted] not to show any evidence especially when she was quoted $2,000 more at another firm. After commencing the case preparation, she sent me enormous amount of evidence despite that I took extra time just for her to explain what would be considered good evidence and how [redacted] would see based on the O-1 requirement. Instead of screening what is important, she had me review just everything she has so that she feels extra safe at no additional cost. She also kept telling me how large loyalties she is earning from her hit songs. She is not a poor artist everywhere. She wrote that after commencing the preparation, she asked to withdraw if I cannot finish by the time she desired. That is not conditioned in our written agreement. Moreover, that does not reflect the truth. Just prior to that, she asked me to review the contract between the petitioner (US artist management agency). As an attorney, I urged her to hire an entertainment lawyer, for it is very risky to make a contract without attorney’s advice here, especially when, she has ability to make money that was proven in Japan. She insisted that I just review in light of immigration, and if I refuse and she had to hire an entertainment lawyer, she is not sure if I can meet her expectation so that she might be better off withdrawing. It is not only inappropriate for me to advise on contract, but would be against the lawyer’s ethics that is set by American Immigration Lawyers Association. Regardless of who pays the attorney’s fee, who signed the contract with the lawyer , who are de facto contact, immigration lawyer must treat both the petitioner and beneficiary as clients and owes lawyers duties. If I advise on the contract, it would be against ethics. I explained that, but she pushed so hard to have me review for free. Here, astonishingly, she still tries to get $2,000 more that was consisted of [redacted] filing fee of $325 for I-129m (before the [redacted] fee raise), $1,225 for I-907 premium processing service, the mandatory consultation fee for American Federation of Musician of $350, and ordinary cost for this firm of $100 including for printing and shipping, e.g., [redacted]. The invoice has been issued on 11/**/2016, e-mailed instantly. I have not heard anything, even the acknowledgement for the receipt of the invoice. The first time she refers to the invoice was in Revdex.com complaint. After that she just e-mailed that my draft looks perfect. I was waiting for her to send filing fees, then she complained that I am not keeping my words, passing deadline. Actually, to finish by her desirable date to submit the petition, not even the travel to US, I did two overnights, and pushed other cases aside that caused substantial delays for other cases. Because of that push, I had to work on Thanksgiving day to catch up with other cases, worked until after midnight. [redacted]’s treatment against me was so insulting and disrespectful. At that point, [redacted] was the one who was behind carrying out her contractual duty, by not sending the filing fees. In addition, the English translations of the evidence that were [redacted]’s responsibility had not been done. Then, I received phone calls from [redacted]’s boyfriend on the case in total well over 1 hour. I addressed the issue but [redacted] just ignored. During that time, [redacted] did not contact me except for one phone call. (Prior to that, I told her boyfriend that phone calls do not resolve the problem and just time wasting at that point.) I was at a café when she made a call, and the café was very noisy so that I could barely hear her. I showed the noise and asked if she could her the noise, to which she answered “No.” But I could not hardly hear her so that I told her that I had to hang up, but it is not that I am avoiding her. Here, she wrote she cannot contact me that is totally not true, after having me spend hours while she had not carried out her contractual duty. I issued a new invoice based on the revised [redacted] fee on 12/**/2016, delivered to [redacted] via e-mail. However, first, [redacted] says she does not have my bank information that had been given when she retained me and sent initial money. I provided the information again on o1/**/2017, but as of 01/**/2017, I have not received the fee, and just the e-mail from [redacted] that “If you can still take care of my case,” as if I am resisting moving forward so that she can make an excuse, and keep the complaint up to threaten my practice. The petitioner says they want to reconsider an item in the petition as of today so that it is the client’s side who has not done the job for the petition. [redacted]’s complaint is groundless and even insulting. I am in a disappointment on [redacted] whom I once cared so much that I introduced other internationally known composers in NY, or taking her to a club event that was hosting a Broadway producer. I have to add that in a casual talk, I told her my experience that how musician avoided paying me fee, and how difficult it is to collect it once it happens, because lawyer has ethics and malpractice insurance that would raise the premium if someone makes a complaint, even if it is dismissed so that many lawyers do not speak up. I feel I was fully taken advantage of.
