Attorney Matuzek refuses to honor bankruptcy agreements as required by written agreement with her clients. She fails to follow through. WARNING!Ms. Matuzek was contracted to handle a bankruptcy case in 2009. She has failed repeatedly to file court documents as contracted, she has failed to file the proper documentation with creditors, and she has caused severe distress because of her failure to communicate. Despite delivering copies of legal documents to her office, she refuses to respond. She absolutely refuses to return calls. Note that she is actually being considered for nomination as a judge! Ms. Matuzek is extremely unprofessional. I would NOT recommend her to anyone! Desired SettlementI'd like her to call and resolve outstanding legal issues. I'd like her to file the documents she was contracted to file with the proper creditors and with the court. IMMEDIATELY.Business Response In response to this complaint, I am advising the Revdex.com and all interested parties that the complainant is the domestic partner of a bankruptcy client of mine. I have never had direct contact with this individual, although she did call my answering service and I did speak to my client following her call. The history of the client's case is as follows:The client contracted with this office on March 17, 2011 for the filing of a Chapter 7 bankruptcy petition. There was some discussion at the time as to the advisability of one or more adversary proceedings to discharge old tax debt. The client was unable to finish paying all pre-bankruptcy filing/legal fees until December 22, 2011. Once all necessary documentation was gathered, the Chapter 7 bankruptcy petition was filed on February 17, 2012. A meeting of creditors was held on March 20, 2012 which I attended with my client. On February 17, 26, March 6, 12 and May 19, 2012, I filed all required documents according to court orders or established deadlines. On May 23, 2012, the court issued the client a discharge of all debt except for some disputed tax debt and other non-dischargeable debt such as support or student loans. On May 24, 2012 I filed an an adversary proceeding on behalf of the client against the IRS to determine which old tax debt was dischargeable. Although there was some delay in service upon the IRS which resulted in an order to show cause issued by the U.S. Bankruptcy Court on January 3, 2013, the matter was resolved on January 22, 2013, the case went forward, and the IRS later agreed to a judgment releasing the client from older tax debt on May 7, 2013. That case closed on or about June 12, 2013. There remained an issue as to whether there was dischargeable state tax debt. I filed an additional adversary complaint against the Massachusetts Department of Revenue on behalf of the client on June 13, 2013. There was an issue involving signing the adversary cover sheet on July 24, 2013 which was resolved with the court on August 8, 2013. At this time I requested the court issue a new summons as the previous summons was not correctly served on the Mass. DOR. The court sis not issue a new summons until October 16, 2013, and I did not initially catch an email containing the summons until November 11, 2013. I served the summons late, around November 14, 2013, and there is currently a hearing scheduled as to the actual date of service to be held on February 26, 2013. This hearing has been postponed February 13 and February 18 due to weather, but is still pending, as is the adversary proceeding. It is not correct that I was engaged to file a bankruptcy in 2009. I did previously file a Chapter 7 petition for the same client in 2001 which was completed in 2002. It is true that in December of 2013 I did not speak to the client as to the order to show cause issued by the court as to the service issue with the Department of Revenue, and had some communication issues with returning the client's calls between December of 2013 and February of 2014. The client's partner should be aware that I have spoken to her with the past two weeks and am researching a mortgage issue for her.
