Not certified with state bar of Texas, pending a court hearing with Fred Biery.
This women did a lot of scam to many people. She will never answer her phone. I also heard her license with the Puerto Rico is currently suspended. She also has a court pending with federal and also with state court. She abuse people for their money and milk their money. She won't give you the face, she is the worst attorney you could ever meet. I hope her days in court, justice get served for those victims that she took advantage of. She need to served time in jail for her actions she did. She liar, she told people she can take their case even though she couldn't do it. I pray she get justice.

Xiomara was hired to process a Visa U on behalf of my daughter and I. She requested full payment upfront before she began any work. The payment was collected and it took her nearly 2 years to submit the paperwork. She’s been a hassle to contact ever since. She never has an update, doesn’t answer nor return calls and essentially collected payment and never did any work for us. It’s been a total of SIX full years and this woman has never contacted us nor done her due diligence to let us know that she moved offices. She’s located in San Antonio, TX and it took some tracking down to finally locate her again. For six full years we’ve called, left voicemails with her assistance, left voicemails on her personal cell phone, text messages and the woman has been nothing but negligent towards her clients. The times that we’ve visited the office we’ve heard the same complaints from other clients. This woman is a thief!!

Ms.:

My name is Xiomara E-S*** and this serves as my formal
response to the complaint filed by ***. I categorically deny each and every accusation made by Ms. in
the Revdex.com complaint. Unfortunately, due to my ethical obligation to protect the
client's confidentiality, I am unable to disclose the contents of Ms. case file or any other information concerning her case to disprove the false
statements made by Ms. in this Revdex.com complaint. The contents of her file
would show that all work that I was contracted to complete on behalf of Ms.
*** was diligently completed, and there is nothing further to do at this
stage as she awaits a response from the applicable governmental authority. Prior to being retained as her lawyer, I specifically informed Ms.
*** of how lengthy the immigration process could potentially be and that, once
her application was submitted to the appropriate governmental authority, the
processing time frame is completely outside of my control and hers. In fact, she was
specifically informed that it commonly takes several years for the agency to
complete processing in similar cases. Furthermore, throughout the process I
have diligently communicated with Ms. and kept her apprised of every
development in her case, as is my ethical duty. Finally, although as a result of the COVID pandemic
I have recently decided to conduct my legal practice as a virtual office, neither
my telephone number nor my email address has changed in over 6 years, and I am
readily available to all my clients. With respect to Ms. libelous accusation of theft and given her own disclosures to the Revdex.com concerning the contracted fees, I can add the following. I
have represented Ms. for nearly six years. Ms. signed a
contract for legal representation in which she agreed to pay attorneys fees in
the amount of $6,540.00, as she has disclosed in her Revdex.com complaint. This amount
is reasonable based on my experience, the complexity of her case and the going
rate for similar legal representation in the San Antonio legal market. In
addition, I was engaged on a flat fee basis, which means I assumed the risk of having
fees capped at $6,540.00, even if the value of the work provided ultimately exceeds the contracted amount. In the end, Ms. indeed
received the benefit of the flat fee arrangement because, over the course of
six years of representation in her case, the value of the time and work undertaken by my office on her behalf has a value that exceeds the flat fee amount that I received. In
any event, if Ms. disputes the contract, the contracted fee and the work
provided, she has recourse through the proper legal venue.While I am unable due to ethics rules and rulings to provide evidence from
Ms. case file to prove that her statements are false, you have the
ability to obtain access to Ms. complete file by simply either (i)
requesting a copy of the file from Ms. directly, or (ii) requesting
that Ms. sign and notarize a waiver of her attorney-client privilege,
confidentiality and liability that specifically grants me permission, as the
attorney, to disclose the contents of her case file to the Revdex.com. With a proper authorization from Ms., the Revdex.com can independently
verify the veracity of her claims by reviewing the case file in its entirety. I
assure you it will disprove her libelous accusations.I trust that you will proceed with the utmost integrity and ethics and
am confident that after reviewing this matter you will conclude that the claims
made by *** are false. This is not a matter of Ms. opinion.
Therefore, it should not ethically form the basis of a consumer-protection
complaint against me with the Revdex.com.

I am rejecting this response because: Xiomara gave me a one year time frame to receive a response from Immigration. It has now been a total of six years. I have contacted her many times via phone calls to her office and cellphone and have received no response. I even drove from Austin to San Antonio to speak to her with a set appointment and she was not available, nor in office despite the fact that we had agreed upon a set time. Please note this was way before the pandemic came into effect. Text messages were sent to her as well, but untimely response were sometimes given. My accusations of theft are not false. Please do a Google search and you can find similar complaints from her other clients where she is non-responsive and does not follow up. She has not kept up with the case not even remembered my name to begin with. I’ve had to do my own investigative work to get any further update and I even had to go to court to collect some paperwork that I was told was her job to do as the attorney. Xiomara has been a negligent attorney the entire time, has not followed up and even lied about certain paperwork she was working to obtain. We hope we can find justice in this matter.
