To Whom It May Concern:*** * *** *** hired me to represent their daughter, *** *** (***), in several Juvenile Court matters involving their grandchildren in King County, Washington. My first communication with *** *** occurred on January 29, 2015. During that
conversation, Ms*** detailed concerns regarding losing her grandchildren to the State of Washington and the Department of Social & Health Services. Over the next several months, almost monthly, I would hear from Ms*** and her husband and there would be discussions about the legal options that they had to prevent their grandchildren being taken away from their daughter, including the representation of their daughter(Please see attached call logs from *** In June, 2015, Ms*** and her daughter called several times and began to seriously discuss my representation. (Ms*** called from *** and Ms*** from *** Please see attached Call Logs) We agreed to a flat fee of $5,for preparation and representation in the upcoming trials in August, with $2,up front. The terms for the flat fee agreement were agreed to on July 2, and Ms*** provided me the necessary financial information for her Discover Card and authorized the $2,charge. I provided a copy of the Flat Fee Agreement that memorializes our agreement andwas sent to the ***. (Please see attached copy of Flat Fee Agreement as well as copy of receipt for transaction)No sooner than I got off the phone with Ms***, Ms*** asked me to text her my email address so she could provide that to *** so *** could start sending me the correspondence and court documents that she had in her possession(Please see attached D’s iphone messages from Ms*** at *** and Ms*** from ***On July 2, through July 21, 2015, *** began sending me the documents and information that she had. I have provided redacted copies of the emails that were sent to me to protect attorney client communication. I began to review the documents and began to prepare for trial in these matters. The last email on July 21, asked me to look into a license issue that Ms*** had.Under the terms of our flat fee agreement all fees were due and payable upon agreement of the contract. Recognizing that it is apparent that Ms*** and Ms.*** apparently had decided to not proceed with me and honor the terms of the contract, I have provided an hourly breakdown of the work that I did inthis matter, for July only. (See Attached statement detailing work done at direction of Ms*** and Ms*** for July 2015)It is a misrepresentation of Ms*** to say that she did not receive services from me. Throughout our many conversations she sought legal advice and expressed concerns regarding the legal situation facing her daughter and herself. I repeatedly gave legal advice and when I received payment I began working and preparing for representation. It is accurate to say that Ms*** does not want to pay for the work that I have done on their behalf, however it is disingenuous of her to state that I provided no legal services on their behalf. The best analogy that I have thought of for this situation is, if Ms*** had hired me to remodel their bathroom, and in the midst of the project, even though it wasn't completed, Ms*** said to me, well I don't want you working on that anymore, we decided we weren't going to use that bathroom, and you didn't finish the project so I want you to give the money back. Ms*** hired me to represent her daughter in a trial and after several weeks decided she wanted to go in a different direction. That doesn't change the fact that I had worked on her daughter's case at Ms***'s and her daughter's direction.In conclusion, I would like to highlight one particular piece of evidence from Ms.***’s own text from *** dated July 21, which begins, “HiDesmond thanks for your help this is a nightmare…” This text is an admission from Ms*** that she knew I was preparing for trial in the case involving the children and the Department of Social and Health Services. And then the later texts from *** about checking into the license is further proof.Ms***'s complaint is inaccurate and a misrepresentation of what occurred and I ask that it be dismissed because I did provide legal services to both *** *** and her daughter *** ***.Sincerely,Des K***
