In response to your letter dated February 9, regarding the above matter we submit the following:
Client contends that this firm does not have a "live" person handling "your case." However, all clients' cases are handled by assigned
"live" Case Managers at every step of the process of their claim from initial intake through the federal court process if applicable
Since client retained this office on January 16, my staff answered every call unless the call went to voice mail and then the call was returned within 24-hoursSince client retained this office the Case Managers, Attorneys, and Support Staff called client numerous times including returning all voice mail messagesIn excess of calls, including call backs, were made to client, his caretaker, and his sister,
Regarding client's contention that he had to drive medical documentation to cur office because "their mail is slow everything was lost can you resubmit." The only records brought to this office by client were records that were submitted and were not lostWe encourage each client to bring medical records to our office in support of their case and to that purpose, each client signs an agreement when they retain this office that they *** participate with us in developing their case for their disability hearingAs is our practice we requested and paid for all medical records as needed to fully develop client's file that he did not have in his possession
Regarding client's contention that he never received a call prior to his 12/3/court date we offer that on 11/5/Attorney _MB spoke with client and his caretaker by phone at his expressed request and did a complete review of his fileOn 11/19/client came to the office and met with Attorney *** in person to ask questions and review his caseOn 11/30/Attorney AS the attorney assigned to go to the hearing with client called him twice - once to tell him she would be calling him back later in the day and the second call to review his case
Regarding the day of his hearing, unfortunately Attorney AS had a death in her immediate family and could not attend client's hearingHowever, another attorney associate, Attorney RD, was able to step in and represent client at the hearing so that his hearing would not be continued by the Administrative Law Judge due to any fault of this office, Because of the completeness of the file development and Attorney RD's competence, a fully favorable decision was achieved, Client *** receive all the benefits to which Social Security determines he is eligible

I *** request my cell phone records to further prove the calls made and the calls returnedCalls go completely unreturned Follow up is done by the clientTheir statements stating reviews of my case were done on 11/5, 11/weere only done after my badgering and calling and leaving unreturned phone calls I think Revdex.com should read some of the Yelps about this office- the EXACT complaints I have- no live person, never a return call, etcare the common thread of each complaint Furthermore, if on 11/ attorney was assigned to me THREE days before my hearing it was because I initiated the inquirywho *** be my attorney? I have the phone records to prove how many calls that tookAt the hearing I was told to come minutes early to go over my case with my attorney that I never met minutes before my case was to be heard (you can look at the sign in sheet) at the court- my attorney comes in & we had minutes tops to talk- he didn't even know my name This firm is living in land if they truly feel they are on top of their cases and had anything to do with my success at hearing I *** forward my phone records under separate cover highlighting how many calls it takes to get a return call or even a live person to acknowledge you are a client of theirs

The client's case was handled in a competent mannerThe client was kept informed multiple times during the pendency of his case3, My representation resulted in a fully favorable decision for his disability benefits
I *** have no further comments as this case was fully presented to the Social Security Administration by my office and resulted in a fully favorable decision which is the result for which he retained my office

In response to your email dated April 30, regarding the above matter, we submit the following: After receiving your e-mail on April 30, 2018, I called Ms*** but was unable to leave a message because I received this message from her voice mail: "this number cannot accept calls at
this time." I had the case manager send Ms_ *** a contact letter asking her to call directly to me at my cell phone number. I attempted another phone call on May 1, and again received the some message from her voice mail. Since we were retained by Mr*** on 11/12/we contacted and/or responded to Mr*** on the following dates and topics:
12/9/2014: called client no answer, left message regarding status12/12/14: called client advised that we tiled his hearing request12/22/14: client called - discussed the video teleconference possibility with the judge4/18/15: called client and provided status5/7115: called client and provided status9/24/15: called client and provided statusSent "pending" letter12/14/15: called client and provided status4/7/16: called client and provided status4/8/16: sent client notice of hearing from SSA that hearing scheduled4/18/16: sent Notice of Hearing to client confirming hearing date4/28/16: called client to do prehecring update6/29/16: called client to confirm hearing date and his attendanceLeft voice mail7/7/16: received call from client; Case Manager *** confirmed that client spoke to her in English requesting an interpreter at the hearingShe confirmed address of the hearing locationInformed client that *** request an interpreter and that was requested on this dateNotified client of change in attorney due to unforeseen hearing changes by other Offices of Disability Adjudication and Regarding the additional issues raised by client's wife, we respond as follows:
The client did meet with the assigned attorney on 7/11/for a pre hearing conferenceThe attorney stated that she was able to communicate with the client adequately in English and did not need to have the Case Manager provide interpretationAdditionally, there was an interpreter present at the hearing by phone as provided the ODAR as we requested and all of the proceedings were translated into Spanish as requested(It is required that ODAR provide all interpretersNeither the client or our office is allowed to provide them for the hearing.) Although client's wife contends that Mr*** understood "nothing throughout the hearing and the judge seemed annoyed." According to our attorney at the hearing, the judge was annoyed that Mr*** answered many questions even before the interpreter finished interpreting the judge's questionsAfter the hearing on 7/12/the Attorney called the client as she had promised but he did not answerShe left voice mail
On 7/21/16, Dr*** called the client and *** *** interpreted on the phone between Mr*** and Dr***, Mr*** admitted that he did meet with the attorney before the hearing to discuss his caseAll his questions about his case were answered

Some of these statements are true but many are notMessages by mail or phone messages/voicemails were not received on all dates listedOften times messages client left were not returned so if you claim you left messages and made contact other than a few times that is a major mystery as to why or how they were not receivedWe can request phone records for the past three years to verify all times you called his only numberNever received any notices in mail with information at old address or at new address despite giving you new address info more than onceOne follow up letter was received indicating that things were moving forward with the case and to notify their office of any changes in his health etcRegarding the hearing address, nothing was received in mail with this infoHe did receive an initial call with date and was told he would receive the address etc in the mailHe did notHe received a voicemail confirming date and time but no addressHe had to make several calls and left messages to get the address of the hearing before his call was finally answered a few days before hearingTwo messages asking for this information had not been returnedWe Never indicated that client spoke NO English but that he is not proficient enough to understand fully, especially a legal hearingHe was Not told about change in lawyer and only found out on day of hearing when his lawyer called about mins before their scheduled 8am meeting time that she would be late, Client arrived at 8am as instructed by office in order to discuss case beforehandLawyer did not arrive until approx 820/and took client into a room to sign papers (which were in English) but nothing about case was discussedDespite several messages left over past
year with client's new address, the court still had his old address on the paperworkDespite your claims that client spoke English and understood English including the phone call asking for the court address, that is not trueClient asked if she spoke Spanish on phone and she said yes and gave him addressClient did not understand most of what lawyer said in English and she did not speak Spanish and he has no idea what you are basing that assumption on He stands by his statements about his experience at the hearing as indicated and he heard secretary say to lawyer after tgey went into the room that she was late and judge was waiting and judge also said she was lateThat he understoodHe felt judge was annoyed with the fact that the phone speaker with translator was not working well so judge was frustratedHe felt judge was irritated with other things but did not know whyAfter hearing he asked lawyer why judge was irritated and did not understand her reply Client did receive calls after hearing but when he returned calls the lawyer was not availableHe did speak with a woman in Spanish to answer a question that he was told the judge had about a job he hadThere was a lot of "phone tag" the week after hearingHe did finally get a call from *** *** with a translator explaining to him that because he was not out of work on disability for months straight (it was months) that he would not be approved, something he was not aware ofHe filed for SSI to help compensate for the lack of state disability benefit that he received due to the fact that he had one short term job in between several months of not workingThis was before he was aware of and diagnosed with his medical condition that had clearly affected his ability to perform his job well and he lost that short term jobThat was the only reason he applied and later appealed his denial by using the services of the office of *** ** ***

In response to your letter dated September 14, regarding the above matter we submit the following: On Thursday, September 15, 2016, I called Ms*** and explained the situation regarding her husband's hearing for Social Security disability. At the completion of my explanation regarding
the procedures and requirements for Social Security disability and a hearing with the Administrative Law Judge, she expressed that she understood and would remove the complaint.

In response to your email dated September 11, regarding the above matter we submit the following:? This is the first notice we have received from your office regarding this matterI called Mr*** today (September 12, 2016) and explained the time frames of filing with Social

In response to your email dated May 9, regarding the above matter, we submit the following: After receiving your complaint on May 9, my office called her and left a message for her to call my office; We called her two times on May 10, again leaving voice mail messages to call us

Client did respond on May 10, whereupon we updated her fire, provided status, and gave her all contact information for my officeThis includes the department's direct phone line, names and emails of all staff working in her assigned department, the telephone extensions to the staff working on her case, as well as the Supervisors phone numberWe obtained her email address, verified her address, confirmed her emergency contact name and number, and sent her a medical packet to update her treating source information.? Client responded by stating, "thank you so much" and we sent her an email stating "thank you" as well,?
