I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:1. Mike, the owner of the  business acknowledges that they were hired to install a burm on both sides of the walkway  and erroneously states a 6 foot blue spruce (it was verbally agreed that he would deliver a  6-8 foot tree), but doesn’t acknowledge that the burms  were to consist of topsoil which is clearly on my receipt and he doesn’t discuss that that trees are sold as 4-6 foot or 6-8 foot, not by a specific size.  Naturally each is priced differently.  When he wanted an additional $350 for the tree, and I questioned the size,  it was agreed that he would deliver a 6-8 foot treet and in fact it’s a 4-6’ tree.  2. Mike  claims that the week they came for lawn maintenance I complained that the lawn was not cut properly.  This was never my complaint.  Prior to my first lawn maintenance I called their office and spoke to Enid, one of their employees, and told her that the flower beds on the side of the walkways and in the front of the house  were growing  a lot of weeds and asking when they were going to e coming back for maintenance to take care of it.  She called me back and left a message on April ** telling me she had “ …discussed with Mike that the weeds were coming through the mulch”  and that they would let me know what day they would be coming back to take care of that.  She was very nice and later got back to me to let me know what day they would be coming.  I anticipated that the problem would be solved then.3. The next time I spoke to Enid was after they had come to do the lawn.  After they left I was surprised to see that they had not TOUCHED the weeds In the flower beds.  I called again and again spoke to Enid.  She recognized me and asked if I was happy with the job and I said NO, and told her that they didn’t do anything to the flower beds and that the weeds were still there.  She said not to worry, she thought they were right in the area and would send them back asap to fix it.  I advised her I was leaving for work and she assured me that I could go ahead and they would take care of it.  I completely trusted her advice.  When I returned home that evening  I saw AGAIN that they didn’t touch the weeds in the flower beds.            4.   Of course, I called the next day.  I got Enid again who said she understood my problem, couldn’t imagine why it was happening (neither could I) but that I would have to speak to Camille, Mike’s wife and she would straighten it out.  She wasn’t in, but she would have her all me back.  Camille did call me back, I explained AGAIN about the flower beds and she assured me it would be taken care of.   On April ** I received a phone message from Camille (which is still on my phone) letting me know that she spoke to Mike and that he sent the men back to my property again, ASKING ME TO CALL HER BACK AND LET HER KNOW IF THE WORK WAS SATISFACTORY THIS WEEK.   She was very cordial and nice and there was no problem, no indication in the message that she was under any kind of duress from our telephone conversations.   5.   When I got home that evening I was amazed to find that NOTHING HAD CHANGED.  The beds were the same, the weeds still there.  At this point I WAS ANNOYED.  I waited till the next day so I could speak directly to Camille.  When she answered the phone I identified  myself and she immediately asked if everything was ok, was I satisfied with the maintenance work?   I was DUMBFOUNDED.  I told her NO, I’M NOT HAPPY, THEY DIDN’T DO ANYTING.  NO-THING CAMILLE, NOTHING!  My voice was raised, I was annoyed, I was frustrated, but at no time did I say anything profane.  THOSE WERE MY WORDS.    Camille responded by asking me “DO YOU KNOW WHO I AM?  DO YOU KNOW WHO YOU ARE TALKING TO?”  “I DON’T HAVE TO TAKE THIS”.  “I WILL MEET YOU ON A STREET-CORNER!”.   She then told me they didn’t need my business and that they would not be back and hung up the phone.    6.   To this day I have no idea what elicited this response.  Meet me on a street corner? I didn’t say ANYTHING that would merit a response like that.  I said “THEY DID NOTHING!  NO-THING CAMILLE”.   No profanity, no threats.   The purpose of my call was still to try to resolve the issue.  I had  been more than patient.  I was  annoyed and that was not unwarranted at this point.   I am a professional, ** year old woman. I can assure you that  I don’t threaten to MEET PEOPLE ON STREET CORNERS!  And frankly, I don’t accept being bullied by someone who asks me if “I know if who am talking to”.  I don’t care who you are, or how long you have been in business.  You don’t speak to  a customer this way.  7.   Mikes’ response says that I complained about the lawn maintenance.  Not the case.  That I cursed at his wife, used profanity and threatened her numerous times over the course of three days.  Not the case.   I believe the tone of the recorded messages I have from Enid and Camille indicate that no such thing was going on and in the end it was Camille who threatened me.   He states I insisted they stay off my property and wanted no further communication.  Again, not the  case.  It was Camille who said they didn’t need my business!  He libels me by saying that I have “issues”.  Again, Not the case.  I don’t threaten people, I didn’t threaten them and his statement is at best heresay since he never attempted to speak to me directly.  It was possible that he had a misconception about my complaint but its clear in the telephone conversations that at least Enid was well aware of the issue at hand.   He continues to say that my lawn is overgrown weeds and that I don’t have an irrigation system.  That at least is true.  My lawn  does have a lot of weeds and I don’t have an irrigation system for it.  Is that mandatory to hire a landscaper?  My lawn was damaged by salt water from Hurricane Sandy and has not been the same since.  I admit that but I WAS NOT COMPLAINING ABOUT MY LAWN.  I am complaining about the fact that my flower beds were not installed with top soil as contracted for but was “fill”, not clean top soil, that the burms were not done as specified (as he admits here), that that the fact that they were not done properly and that the soil was not as contracted was contributing to the issue of the weeds, which as my landscaper, he had contracted and agreed to take care of and then NEVER DID.  8.   Mike claims that he will pursue a complaint with the attorney general for an order of protection for himself and his wife against me.  This is another threat from him to me and again, I will not be bullied by these people.  I hired this company and told Mike when I hired him that I had hired him because I thought he did beautiful work. I paid him $2,700 in good faith for the burming.   I honestly have  never seen a job that he had done that looked like this mess.  And for the life of me I cannot imagine why mine does.   But that doesn’t mean that this did not happen.  My house is here.  The dirt is here. The weeds are still growing through.   The lack of requested burms is STILL HERE. I have photos.   It is obvious to anyone that can see  this that this is NOT WHAT I CONTRACTED FOR.  This  is not the typical job that this company does. I DON’T KNOW WHY.  Perhaps because I didn’t hire him to do a full planting? He wanted $5,000 for that.  Because I didn’t hire him to install an irrigation system?  He wanted a couple of thousand for that.   I told him I couldn’t afford all that right now and would start to plant my own plants for now and take care of the irrigation with a sprinkler.  Did that annoy him?  I don’t know.  But I do know this is not what I contracted for in either the maintenance or the installation.  I also know  I didn’t threaten anyone and that I don’t intend to be threatened, regardless of “who you are”.    I am trying again  to resolve this issue without a court case, but If necessary, I will do what needs to be done because I know that this is a true accounting of the facts of this situation.  1.

Unfortunately at this time there is nothing, I believe, that can be done to resolve this matter. [redacted] is irrational beyond words. I have been doing business in the community for 46 years, I must be doing something right or I would not be in business.I believe it would be unreasonable to have me return to her property to do anything for her considering the circumstances in which I was told not to return.

immediately sent the crew back. There was nothing to be done. She again called the office threatened my wife used profanity over the phone called and cursed my wife numerous times over the course of three days. [redacted] told us not to come back to her house. She insisted we stay off her property and wanted no further communication with us. She must have issues because WE WERE THE ONES WHO WERE THREATENED.Her lawn consisted of overgrown weeds. She does not have an irrigation system to support proper maintenance of a lawn. If [redacted] pursues this complaint I will be forced to contact the district attorney's office to inquire about an order of protection for myself and my wife. We take threats very seriously. I have been working in this community for 46 years and have never encountered such vulgarity from anyone. I am in a service business not the abuse business.
