I have asked Mr. [redacted] for money back for expenses and have not recieved anything as of yet. His sec. had prev. said it was not a problem.PURCHASED A HOME AUG. 2012 AND FOUND OUT OCT. 2012 THAT THE HOUSE WAS NOT LEGALLY OURS AND COULD NOT GET INSURANCE SO WE HAVE NOT BEEN ABLE TO MOVE. WE HAVE WORKED WITH [redacted] HOLMES FOR THE PAST 4 MONTHS TRYING TO GET THIS RESOLVED. WHILE WORKING THIS OUT WE EXPLAINED TO MR. [redacted] VIA EMAIL AND ON THE PHONE THE MONEY WE HAVE SPENT NOT BEING ABLE TO MOVE AND REQUESTED A REFUND FOR THE MONEY LOST OVER THE LAST 4 MONTHS SINCE WE FOUND OUT ABOUT THE HOUSE. I WAS TOLD BY THE SEC. [redacted] THAT [redacted] HOLMES DID NOT THINK THAT GETTING US THE MONEY BACK WOULD BE A PROBLEM. WE JUST RECENTLY GOT THE HOUSE PAPERS FIXED AND I HAVE SPOKE WITH [redacted] OFFICE AND THEY HAVE BEEN RUDE AND DONT THINK THEY SHOULD PAY ME ANYTHING FOR THE MONEY WE HAVE LOST THE LAST FOUR MONTHS. Desired SettlementI AM REQUESTING THE TOTAL AMOUNT OF $3,600 I HAVE EMAILED [redacted] HOLMES THE COST BROKE DOWN SHOWING HIM OUR INCOME LOST. Business Response In her complaint, Ms. [redacted] states that she purchased a home in August, 2012. The closing to which she is referring actually occurred in August, 2013, and at that closing, the property was purchased by [redacted] However, [redacted] was present and explained to me that [redacted] was purchasing the property for her. A few months later, we were notified by another real estate attorney, who was performing a title examination for Ms. [redacted] so she could purchase the property from Ms. [redacted] that there were a few issues with the title that needed to be cleared up.[redacted] states in her complaint that we were rude and didn't think she should be paid anything for the money she has been out over the last few months. I have never been rude to [redacted] and I have apologized to her for anyone in my office whom she felt might have been rude to her. We have stated to her that it shouldn't be any problem for her to be compensated for any reasonable expenses and/or damages she may have incurred due to the issues with the title to the property. After the title issues were cleared up (or so we thought) and the discussion turned toward [redacted]'s compensation, yet another title issue developed regarding a lien that was on the property. In an effort to make it right, we offered [redacted] several options. We offered to buy the property back from Janice or [redacted] so they could be free of this property and the lien problem. We also offered to [redacted] and the attorney performing the title examination for [redacted]'s lender, to provide the lender with a title insurance policy (owners and lenders) from our title insurance underwriter insuring over the lien. We also agreed to indemnify [redacted] from any loss resulting from the judgment lien.This property had been owned by [redacted]'s grandfather, [redacted] and he died intestate. There was a Quitclaim Deed from his wife, [redacted]'s step-grandmother) to her son, [redacted] The Quitclaim Deed stated that [redacted] Settle was his only heir at law. This proved to be untrue in that [redacted] had five children.It turned out that Mr. [redacted] was in the nursing home and my office did not have a [redacted] release when the property was purchased by [redacted] We were able to get a release but because of the backlog in Nashville, it took several months. After we thought we had all the title issues resolved, it turned out that one of the heirs who had quitclaimed his interest in the property had judgment liens filed against him.[redacted] is a very nice person and I understand her frustration with the title defects and the fact that it has taken so long to resolve the problems. I offered to pay [redacted] her cost of the property, plus the cost of her improvements. I have also been able to obtain financing for her with a different bank if her Lender refuses. I have offered to put [redacted] in the same position that she would have been in if there had been no issues with the title. I am still willing to work with [redacted] to resolve this and I am waiting on her attorney to let me know if her Lender will accept a Lender's title insurance policy so she can close her loan.
