Dear Ms. [redacted]:Thank you for your letter. I’ve been a practicing lawyer for approximately 14 years and this is the first time I face a complaint. whether or not they amount to commercial defamation.In brief, I believe Mr. [redacted] is upset because we would not accept his case lest he would be unable to pay for attorney fees. As for the statements regarding patent search, he was in my office and contrary to what he says, he insisted on doing a patent search. I include a redacted (for privacy and confidentiality reasons) copy of the executed Patent Search Request Form which he agreed to and signed.As for the content of the search report, I cannot divulge that information to you because of confidentiality. However, if and when Mr. [redacted] decides to waive the attorney-client privilege, I’d be more than happy to discuss the report with you or otherwise publish the report.Mr. [redacted] was initially happy with the search report but reversed his position when we started to discuss the cost of drafting the underlying invention. After receiving the search report, I emailed a copy of our standard retainer agreement for him to review and sign before working on his project. We have records of this email and its attached retainer agreement which will be provided if and when Mr. [redacted] decides to waive the attorney–client privilege. Upon receiving the retainer agreement, Mr. [redacted] called me to discuss the fees and upon being informed that no discounts or variations to the retainer fees would be available, he informed me that he did not want to retain my services. Approximately a week later, he emailed me and demanded a refund for the patent search. I informed him that no refund would be forthcoming, prompting Mr. [redacted] to make his false statements on [redacted] and to Revdex.com.Lastly, we are disappointed about Mr. [redacted] experience with the firm. However, as a matter of principle, we cannot refund his money for the work which he agreed for us to perform and we did.
