Review: I received a driving ticket in Virginia and solicited representation from several lawyers in the Virginia area. I contacted SRIS and received an e-mail response on 2/19/2013 in which I was told "You would not need to personally appear in court on this charge." Based on this guarantee which competing fir** could not necessarily offer, I elected to hire the firm to represent me. At the time, I was living in North Carolina and a court appearance, while inconvenient, was feasible. Nonetheless, based on the company's promise that I would not need to appear in court, I elected to not come in court. Thereafter, I was informed of a "new requirement" that required my appearance. A new court date was given at which point I had moved to [redacted]. In order to appear in court, I had incurred additional charges to fly to Virginia, stay in a hotel, and obtain a rental car. These additional charges were a direct consequence of being told that I "would not need to personally appear in court" and then being told of the "new requirement" after I had hired the firm.Desired Settlement: The additional expenses incurred based on the firm's misrepresentation of the requirement to appear in court.

On 2-18-13, [redacted] was provided an initial telephone consultation re criminal misdemeanor charge of Reckless Driving, 90/70 mph zone, which was pending for trial in the [redacted] County Virginia General District Court on 2-28-13. He was informed that a Reckless Driving was a criminal offense under Virginia law, which could carry a penalty of up to 12 months in jail and/or a fine of up to $2,500.00. See, VA Code Sections 4 5.2-862,46.2-868, and 18.2-11, below.

§ 46.2-862. Exceeding speed limit

A person shall be guilty of reckless driving who drives a motor vehic in the Commonwealth (i) at a speed of twenty miles per hour or more applicable maximum speed limit or (ii) in excess of eighty miles per fyour regardless of the applicable maximum speed limit.

§ 46.2-868. Reckless driving; penalties.

Every person convicted of reckless driving under the provisions of this article is guilty of a Class 1 misdemeanor.

§ 18.2-11. Punishment for conviction of misdemeanor.

The authorized punishments for conviction of a misdemeanor are:

(a) For Class 1 misdemeanors, confinement in jail for not more than twelve months and a fine of not more than $2,500, either or both

On 2-IS-13, [redacted] was a medical student who resided in North Carolina. He was advised that generally the [redacted] County General District Court did not require defendants to personally appear at a speed of 90/70 mph zone on the trial date, and that an attorney from our Firm would appear for him at trial on 2-18-13. [redacted] retained our Firm at a flat rate fee of $525.00 on 2-25-13.

Our Firm appeared on behalf of [redacted] in the [redacted] County General District Court on 2-28-13. At that time, we were informed by the new Judge, recently appointed to the bench, that there had been a change in policy, and that the Court would no longer waive the possibility of jail time for defendants at speeds of 90 mph and above. The Court advised us that [redacted]

[redacted]’s personal appearance was required for trial. The Court continued 13. On 2-28-13, [redacted] was contacted by letter to inform him of the Court’s policy change requiring his appearance at trial on 4-30-13. [redacted] inforned our Firm at that time that he could not appear on 4-30-13 because he had graduated from medical school, relocated to Massachusetts and was starting a job on 4-30-13. [redacted] was advised that if he did not appear, it was possible that the Court could charge him with a a additional criminal charge of Failure to Appear, and/or our chances of getting his Reckless Driving charge reduced could be compromised. Our Firm contacted the Court, explained [redacted]’s situation and was able to continue his trial date to a later date of 6-11-13 . After multiple contacts with [redacted] and the Court, our Firm was finally able to continue his trial date all the way out to 8-3-13 for his convenience.

On 8-3-13, Our Firm appeared again in the [redacted] County General District Court along with [redacted]. We were successful in getting his criminal charge of Reckles s Driving reduced to a simple traffic violation of Speeding at 80/70 mph zone. The Court does not generally reduce a Reckless Driving charge by 10 miles an hour. See Court Case Information below.

It appears that [redacted] is concerned about the [redacted] County General District Court new 2013 requirement that defendants charged with Reckless Driving at speeds of 90 mph and above must personally appear, his travel expenses from Massachusetts to Amhurst, Virginia and believes his $525.00 attorney fee should be refunded- However, it was not foreseeable by our Firm at the time of the initial consultation with [redacted] that the [redacted] County General District Court would change its appearance policy, or that [redacted] would relocate from North Carolina to Massachusetts.
