Spot lawn spray killed Japanese maple tree sapling, damaged black-eyed susans, and caused leaf burn & drop of nandinas in flower bed. I called lawn svc. 5-21-2015 to add lawn insect spray and wanted spot treatment of weeds (i.e., wild violets, particularly in backyard. I reminded receptionist to tell tech not to get spray on new plants. On 5-27-2015, tech sprayed bug killer in the front & back yard and spread fertilizer in the front & back yard per remarks/recommendations on bill left on door. 5-28-2015, husband and I noticed leaf curl on Japanese maple tree sapling in front flower bed. Watered it several times over next week. Also, black-eyed susans in same bed had black spots begin to appear. Only ones not affected were in the far back of bed. Nandinas that were situated next to black eyed-susans had leaf burn and drop, but only affected front of a couple of bushes.Only plant not affected in area was an elephant ear. It look like wind blew spray in that area. We attempted to nurture plants, but lost Japanese maple tree sapling. Contacted Lawn Doctor with complaint to replace tree about 6-8-2015. Owner was not in, but left message with receptionist first time of which she said he would come out later in week to look at tree.Called back to find out progress on checking tree on 6-15-2015. Receptionist said that owner was not in, but took message.I purchased Japanese maple tree (same variety) at [redacted] 6-15-2015. Called Lawn Doctor again 6-17-2015 that I had to get new tree planted a.s.a.p. before rain from Tropical Storm Bill on Fri. 6-19-2015 and we left on vacation on 6-21-2015.Planted new tree in same spot as old tree on 6-18-2015 and put old tree in new tree container and left it on sidewalk to front door. Called Lawn Doctor 6-18-2015 to let them know old tree is in container on sidewalk. On 6-19-2015 [redacted] called me at work to say he did not see a tree. I had husband, who was home, call [redacted] to let him know tree was on front porch.Called Lawn Doctor on 6-26-2015 on three-way conference call to [redacted] and was told by him he did not see that his company was at fault, even though I mentioned at that point about the other plants showing damage from the spraying. I had him discuss it with husband of which we discontinued service and notified them we would inform neighbors that used them about complaint. I also, paid last bill on this date.Desired SettlementI never got to ask for resolution from company. I wanted them to replace cost of new tree ($48.15)by deducting cost from our account. We had owed $50.00 at the present time. I felt this would be the best for both parties involved. Since, no resolution took placed I paid account off 6-26-2015 through their website.Business Response I have attached a Customer Contact sheet, which is what we enter every time a customer calls our office. (Look at Contact Notes) Mrs. [redacted] states she called our office on June 8th, as our records indicate she called on June 15th. The same day she bought a new tree. I actually went out on June 19th to inspect the tree and they said it was at the street. When I got there it was gone, so I called them and they said they put it on the porch. I went back and it was gone. I never had the opportunity to see the tree when it was in the ground or when it was dug up. How can I be responsible for something I have never seen. Plus, if tree was purchased the month before from [redacted] whose to say it didn't have a fungus or disease from [redacted]. Plus, they have a one year warranty from [redacted]. Also, the service we did on the lawn was a fertilize treatment. We only spot sprayed any weeds at the time of service. We as a company have made mistakes in the past. I have always had the opportunity to see the mistake and get it corrected by buying the new product or reimbursing the customer for the new product. However, I never had the opportunity to see this tree dead or alive. As I tried to tell Mr. & Mrs. [redacted], anyone could call and say we killed something, but we need to see it.
