I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Landscaper has been sending people to work on the tasks and is looking to complete the tasks listed. Thanks to the landscaper for that. There are some completed tasks, but there are still tasks that are not completed. Regards to the allegation that material is not there, material that is clearly specified is always on site.      a. Plants, pots, soil was onsite , but was planted after 3 months from the original purchase date of the plants.     b. Regards to the transformer, the higher wattage transformer was not required, but the landscape insisted on it. It was there the next day, but now we do not need it.  Right now the smaller wattage transformer is the one that is installed and working.     c. Regards to the firepit bench, the work has been pending for 6 months before action was taken last week. I had to pay the cost for the Landscaper's workers not dong the job right way. The material      d. Drainage covers in the water feature is not installed yet.      e. Power washing is done once compared to the three times specified in the response. It also is not done fully due to the additional debris still on the site.  The major issue is that the workers are being sent without proper coordination.  Request the Landscaper to not misrepresent the facts and finish the remaining work as quickly as possible with proper coordination.   I haven't listed the full set of tasks in my original complaint. I want the landscaper to comprehend the full required work and finish it as soon as possible.

In response to the complaint from [redacted], pleasesee the following.Lawns & Beyond Landscape Company, Inc. agrees that this project has taken time waybeyond what was originally agreed to and we would also like to complete the project.We have responded several times by...

phone and sending employees to complete work.We have made many attempts to complete the project. The main issue we have had onthis project is the material, which is to be provided by the homeowner, has not been onsite when required by the contract.As stated in the signed contract:“Homeowner agrees to purchase all materials, permits, etc. when needed for eachphase of the project in order to keep project within the agreed upon labor weeks (seeEstimate/Bid); a delay of materials may cause a delay of labor or extension of projecttime and will be discussed and worked out with the Homeowner on a case by casebasis.”Our employees show up to complete the project only to find that the required suppliesand/or material is not on site. This has happened numerous times and each time wesend our employees, we lose money when the material is not there. Please see twoattached Addendums, that were attempts to get the material on site on a schedule,earlier in this year.As referred to in one Addendum, Page 4, Section 2 of the signed contract states:“2. DELAYS. Contractor agrees to start and diligently pursue work through tocompletion, but shall not be responsible for delays for any of the following reasons;failure of the issuance of all necessary building permits within a reasonable length oftime, funding of loans, disbursement of funds into funding control or escrow, acts ofneglect or omission of Owner or Owner’s employees or Owner’s agent, acts of God,stormy or inclement weather, strikes, lockouts boycotts, or other labor union activities, extra work ordered by Owner, acts of public enemy, riots or civil commotion, inability tosecure material through regular recognized channels, imposition of Government priorityor allocation of materials, failure of Owner to make payments when due, or delayscaused by inspection or changes ordered by the inspectors of authorized governmentalbodies, or for acts of independent contractors, or holidays, or other causes beyondContractor’s reasonable control.”In response to numbered items:1. There are some plant that need to be planted in the planter bowls on the pillars. Wehave got these multiple times and they are dying because these have not beenplanted. I have already spent twice for these plants.Each time that we were on site to plant, materials were not available (pots, rocks, soil,etc.) Plants are now planted.Planting is completed.2. Low voltage lighting needs to be connectedClient has been told that a larger transformer and caps are needed. These are still notavailable to complete. Homeowner needs to provide the material in order for us tocomplete and we can complete in one day.3. Firepit bench needs to be finishedWhen the proper material is provided (grout and tile) this can be finished this week ofNovember 1, notwithstanding any changes requested by the homeowner. Material hasnot been on site to complete. Homeowner has recently seen anotherhomeowner’s completed benches and is now requesting a change to them.4. Drainage in veggie planters need to be doneMaterial had previously not been on site before.Drainage is completed for the veggie planters.5. Drainage covers in the water feature needs to doneMaterial had previously not been on site before.Drainage covers are complete this week.6. Whole yard needs to be power washed. This has been done three different times. Client is required to remove the debris andthis has not been done. We have offered to remove debris but the client does not wantto pay for it.Power wash is completed.7. Drain cover in the front yard needs to be done. (This is dangerous for the children aswell)This has been completed.8. Need to finisher caps on the pillars.This has been completed.9. The patio cover pillar bottom and beam needs to be painted and edge of the raftersneed to be trimmed.This has been completed.Everything else on the property has been completed.As mentioned, if the remaining material/supplies are available, this project can becompleted in a very short amount of time without changes or additions from thehomeowner. We would also like to have the project completed. We are on site, againtoday, to ensure the Fire Pit and Lighting get completed.Thank you:[redacted]Lawns & Beyond Landscape Co., Inc
