Mr. *** retained me on about February 23, We never had a flat fee basis of compensation for his contested, out of county, custody caseThe terms of compensation was always on an hourly basis calling for a) a minimum retainer of $1,500.00, b) ultimate fees based on itemized time
records, and c) my having the right to withdraw as attorney of record for non-payment of Attorney Fees At the end of April of 2015, I told him that his $2,(and growing) bill needed to be paid in fullWhen pressing him for payment of the still growing bill in May of 2015, Mr*** told me he was seeking a loan to pay the outstanding and to pay on future services to be renderedHe knew my rate of compensation was on an hourly basis When after a day of trial preparation and two days of trial the bill then reached more than $6,000.00, I told Mr*** on June 4, that that if the entire bill was not paid in full I would withdraw; particularly with the case having been scheduled for more days of trial. Rather than say he owed me no more that $1,on a flat fee, he suggested that he would pay me $a monthI flat out rejected that offer because we still had more days of contested trial scheduled I filed a Motion to Withdraw based on the Rules of Professional ConductThe Court granted itMr.*** filed an Objection to my being allowed to withdrawIt was deniedIn his Objection to my withdrawal, Mr*** stated: “In fact Mr*** was mostly satisfied with his and and Atty Winkfield’s what seemed to be a meaningful attorney-client relationship until Winkfield’s withdraw.” Accordingly, it clear that Mr***’s Complaint is meritless and should not be printedHe knows my basis of compensation was hourly
