Mr ***:Please allow this letter to serve as a response on behalf of Lawyers Title Company("LTC") and Commonwelth Land Title Insurance Company ("CLTIC") to the complaint (the"Complaint") filed by you with the Revdex.com ("Revdex.com") regarding the transaction identified as Escrow Number
*** (the"Transaction")For the reasons set forth below, your claim is respectfully denied.The facts presently known are as follows: By *** *** *** ** *** *** *** ** *** *** *** *** *** *** *** *** *** *** *** *** *** *** ** *** *** *** *** *** *** *** ** *** *** *as the escrow holder in the underlying Transaction and *** underwrote the above -captioned Policy of title insurance.The Complaint states that LTC failed to ensure that all taxes were paid in connection with the underlying TransactionAs a result, the claimant paid $in connection with delinquent *** County secured supplemental taxes accrued on the Property in 2014, when *** *** was the owner of the Property (the"Supplemental Taxes") LTC's obligations as escrow holder are limited to complying strictly with the escrow instructionsThe escrow instructions that were signed by the Claimant state that title would be free from encumbrances Except "The lien of supplemental taxes, if any, assessed pursuant to Chapter (Commencingwith Section 75) of the California Revenue and Taxation Code ..." deals with taxes levied in connection with a change in ownership and new construction after the lien dateAs payment of the Supplemental Taxes was not contemplated bythe escrow instructions, LTC did not violate its duties as escrow holder in the Transaction.With regard to the Policy issued by CLTIC, no coverage is afforded as the Supplemental Taxes are excepted by Schedule B, Part of the PolicyThis provision states that the Policy does not insure against loss or damage which arises by reason of:"BThe lien of supplemental or escaped assessments of property taxes, if any, made pursuant to the provision of Chapter pr Part 2, Chapter 3.5(commencing with Section75) or Part 2, Chapter 3, Articles and 4, Respectively, of the Revenue and Taxation Code of the State of California as a result of the transfer of title to the vestee named in schedule A; or asa result of changes in ownership or new construction occurring prior to date of Policy."
