Hello, I spoke to Mr [redacted] today and advised him of the nature of seeded and seedless tangerines/mandarins The variety in which he purchased is considered seedless, though if cross-pollinated with another variety, particularly one that normally produces seeds, then his tree may in fact end up producing seeds There is always the chance that the tree was mislabled as well Though unlikely, it has happened in the past and will inadvertently happen again in the future We have offered the following: refund in full his purchase while still allowing him to keep what he has received from us; have us replace the tree with another variety of his choosing that we stock; or plant another clementine next to the one we already planted in hopes the majority of pollen used to pollinate both trees will be of the clementine variety thus producing fewer to no seeds He wanted to talk it over with the family and get back to me Thanks for your assistance We strive to keep our A+ rating and accreditation

For all trees, we require majority of root ball to be removedHair line roots do not directly impact the installation of the new treeAs mentioned, the customer had shown pictures to sales rep, and acknowledged that the tree was ENTIRELY removedWhen such a tree is ENTIRELY removed, no further excavation is required prior to planting. As mentioned to all customers all digging and excavation is done by hand, therefore to have such a root ball removed would require more and extraneous type of excavationThus deeming removal and planting not possible. Pictures were shown, however, as described to the customer after the incident, the trunk that remained seemed camouflagedPictures illustrated to Big Tex looked as if it were solid ground or dirt, in which may qualify for new planting by our companyThe sales rep was blind to what was in the ground, and the customer insisted that a new tree may be plantedThe sales rep that had been involved, has never before made an error like suchInformation given by customer was unfortunately not described correctly or to the entire truthIf known, the sales rep would have insisted that the customer may still purchase the tree and plant the new tree after the existing trunk and root ball were removedWe review all information and instructions possible with customersAll customers have the right to purchase a tree or plant, however, recommendations are all that can be communicated to the customerIn addition, the sales rep has been with the company over 2yrsPeriodically, through meetings and interactions, we go over similar situations to make sure mistakes are not madeFor most trees, we do not remove if established longer than yrs, as well as trees whose trunks are larger than a coke canHowever, if a larger tree were to be removed prior, than planting would be deemed possible. As mentioned, we attempted to make amends and give several optionsBig Tex is not pursuing to withhold the entire amount, however, simply charge for what work was done, and required15% reflects as such

Upon original visitation customer purchased 48" live oak to be planted. Customer had explained that the tree that was there before was a 40yr old tree and had been entirely removed, thus making planting possible. The sales person acknowledged that if there is a tree or existing root...

ball in the spot where planting would occur, that we could not remove such a large tree, and such work would need to be done prior to planting. Therefore no further work was needed, except to plant the new oak tree. On the original invoice, customer had signed the warranty agreeing to a 15% cancellation charge and the rest of the warranty, entitling that Big Tex will not perform any work not stated on the invoice. In addition, the customer had initialed agreeing that there were no removals to be done except for the standard digging of soil. Upon planting day 3-10-15, foreman and crew arrived at the home and started as any other job. As the crew attempted to dig, they soon realized that there was a Large 5'-6' trunk (flush at ground level) inhabiting the area. The driver then had to cancel the delivery of the ordered equipment to handle the customer’s tree, therefore, the purchased tree could not be installed because of existing trunk and root ball.  Foreman, explained to customer that tree can be moved to a different location in yard or, further work would be needed to have tree installed. Unfortunately, the customer did not want to relocate such tree, yet demanded that we return the tree and money under false pretenses. Reviewing the situation, the tree purchased was held at the yard for planting. Unfortunately, by misunderstanding or misinterpretation, equipment was ordered to plant tree at the job site, the tree was loaded onto the truck, delivered, and then returned to yard. The 15% cancellation fee directly reflects all the efforts involved in the attempt to plant such a large tree. As conveyed to the customer, options were given:1. Hold tree at yard until inhabiting trunk and root ball were removed, and planting were deemed possible. 2. Allow customer to trade purchase amount in full for store credit, in which the customer will be allowed to spend on a different project or whatever he or she may wish.…or ultimately…3. Return purchase however at a 15% cancellation fee.As we spoke multiple times, dearest apologies were made to understand the situation as it were. Attempts were made to satisfy customer and surpass the cancellation. Unfortunately, as we attempted cooperation, the final result was never accepted.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  
The respondent is not telling the truth.   The sales person was shown pictures of the site.  The sales person was told that a 40 year old tree had been in the spot we wanted it.   The sales person was told that the trunk had be ground.  Ground only NOT excavated as would have been required for the tree we were sold. The real problem that has not been addressed by Big Tex is the incompetence of the sales person.  As consumers we expected the sales person to understand the business of the very large trees they are selling. We have visited several knowledgeable tree farms since and shown them the exact same pictures and told them exactly what we told the Big Tex sales person.   EVERY ONE of them said they would NOT sell us a tree until the spot had been excavated.I want Big Tex to take responsibility for their sales person and give me a full refund.

Big Tex didn't satisfy the complaint - my credit card company helped me do it by getting my money back and helped me with my horrible experience.  Big Tex did NOTHING to help with the situation nor did they care about my business or me as a customer.  This...

company should never hold such a high rating with Revdex.com.  I consider it closed because I got my money back - all I wanted since they wouldn't deliver my treesR
