This letter is in response to your letter dated 71h Aprilregarding Mr *** ***'s complaint regarding his grandmother *** ***'s apartmentThis complaint arises from *** ***'s requeston 4/03/to have *** ***'s Social Security for the month of February turned over to
himpersonallyAt that time I attempted to explain to Mr *** that the Social Security Administration had requested a refund of the benefit for the month of February as neither the beneficiary nor the estate is entitled to receive the benefit during the month of deathDocumentation of the SSA letters to LBSH,receipt for payment and the pertinent regulations were sent to Mr *** on April Alldocumentation is on hand for review.Ms*** was a resident of the Enriched Housing Program (EHP), regulated by New York StateDepartment of Health, at the LBSH facilityMs*** was never discharged from the EHP until midFebruary.The intent of the care at the Skilled Nursing Facility, *** *** Home, was to rehabilitate Ms*** to the point where she could return to her apartmentThere is a lease for boththe apartment and for the EHPThe NYSDOH approved lease for EHP clearly states that the cost of the EHP and enrollment in the EHP program does not cease when the resident is out of the facility on atemporary basisAdditionally, a 30-day notice is required for the termination of both leasesMr ***would not be aware of the lease arrangements as he was not Ms***'s representative at the time.A 30-day notice was never received for the EHP or for the apartment itselfFurther, documentation exists that Ms***'s apartment was included as part of a NYSDOH EHP survey conducted on February Ms***'s son, *** ***, notified LBSH on February that the apartment would be vacated during the following weekendAs per the HUD lease and the EHP lease, as no 30-day notice was given the tenant (not the family, as documentation will bear out that the family was never party to any of these leases) was liable for the month of rent during which the apartment was still being heldAll information pertaining to the subsidized apartment, the participation in the EHP, and the coordination between LBSH and *** *** Home is documented.The $,90/ month fee for EHP was paid by *** ***, not by *** ***The fee includes the rent for the apartment, care, daily congregate meal, Electricity payment, transportation, Case Management,etcLBSH never charged the family of *** *** for this payment; documentation of this exists*** paid her own bills and Mr *** *** was never a party to any legal documents pertaining to herMr *** *** was also never party to any legal documentation pertaining to Ms***, LBSH wasnever aware of a Mr *** *** prior to the Revdex.com letter of April Ms***'s tenancy in a subsidized apartment was regulated by HUD, NYSHTFC, USDA RD, and NYSDOHLBSH strictly adheres to all regulations pertaining to the apartment and has a Superior Rating for doing so from all Federal Regulatory Agencies.Thank you for your time and attention.Sincerely, Nathaniel *** Executive Director
