Good morning.We understand Mr [redacted] 's disappointment in not being awarded the prize he felt he should have been awarded, however the Scratch, Match and Win states you are a winner if your prize number matches one of the numbersThe flyer does not state which prize you win, and one of the prizes is a Wal-Mart gift card up to $1,000; Mr [redacted] won a $Wal-Mart card.After Mr [redacted] spoke with our Sales Manager and the flyer was explained to him, he was very angry and belligerent and leftHe then called our General Manager and was offered gas money for his trip, to which he replied, "You had better not send me anything because I will go to your house and take your [redacted] TV!".We were absolutely ready to give Mr [redacted] gas money for his trouble; however, he did refuseWe would still offer to send him a check for gas if he would like.Respectfully, Santa Fe Mazda Volvo

I sincerely apologize for Mrs [redacted] loss and employment troubleI also apologize that I did not know of any of this prior to reading this complaint today.Our GSM Mike J [redacted] called Mrs [redacted] today and she will be bringing the new purchase back to us and picking up her Subaru tomorrow morningWe have instructed Wells Fargo to unwind the deal.Respectfully, Norma M***

I am rejecting this response because:Unacceptable This company is trying to make this about me, instead of accepting responsiblity for it's actions.They have told many lies in response to my Revdex.com complaint:NO employees or the company ever offered to pay for my gas until after I filed a complaint with Revdex.com,NO employees ever offered or explained to me I get a dollar walmart gift card until after I filed with Revdex.com.This company responds with "The flyer does not state which prize you win" and actually it clearly says I won a inch flat screen TV because my scratch off number matched the prize number. I never told a General Manager "You had better not send me anything because I will go to your house and take your *** TV!".This is a lie, and an effort by the company to muddy the waters and shift blame. The flyer clearly states "You are a winner if your numbers match any of the prizes."My scratch off numbers matched the winning numbers to win a 70" flat screen TVworth $2,No where on this flyer does it say that this only gives me the opportunity to win.When I came to the dealership in person, I was told, "You did not win, you only won the opportunity to win."This salesman I spoke with was no managerHe was only a salesman. He never bothered to check confirmation numbers before telling me this. No one ever bothered to check the confirmation numbers. An employee named Greg told a customer via phone on 2/22/that he won a inch TV in this contest.when in fact he was lyingHe was lying to get them to come to the dealershipI also was decieved just to get me to come to the dealership.These are misleading, deceptive practice in violation of the FTCA which defines deception and advertising.Under the FTCA,There is no need to establish intent to deceive in order to find a company liable for a deceptive act or practiceFurther, the deception does not even actually have to occur to be in violation of the FTCAAn unfair act or practice under the FTCA is one that cannot reasonably be avoided by the consumer; and causes, or is likely to cause, the consumer some sort of injuryThe act or practice by the business will also be either no, or very little, benefit to the consumer.NM law defines a deceptive practice "making or misleading statements of fact for the purpose of obtaining appointments for the demonstration, exhibition, or other sales presentation of goods or services. If and when this matter comes to trial, no jury will side with this dealership

I apologize Mr*** feels the WRAP and GAP were added on without his knowledgeWe do not add warranties or other insurance without our customers' knowledge and we do have a contract and Purchase Order clearly showing GAP and WRAP with Mr***' signature
However, that being said; we also
do not force a customer to keep cancelable coverage should they wish to cancelThese insurances have been submitted for flat cancelation; there was no dihonesty or untruthfulness involved, sometimes it just takes a while
Mr***' refund of $3,will be submitted to his lienholder, *** *** Bank within the next few daysWe are obligated to send any monies due a customer to the lienholder to be appled to their loan
