[redacted]'s claim that he was tricked into paying to see the 80's band performance is wholly inaccurate and missing lots of vital information that is detrimental to [redacted]'s claim. I was managing the night of the event and I spoke with [redacted] in person, as well as all staff that dealt with [redacted].
On the night in question, there were two events in two separate rooms with two different start times and two different admission prices. Each of those two events are produced by different producers and they each staff their own, separate cashiers. LPR does not collect any of the admission money and the management or security guards have no motivation to trick people into paying one admission over another. The Gallery Bar (the small room) event is called "More Than Enough" (a hip hop, house and soul dance party with no band) opens at 10pm and charges a $10 cover. There is never a line for this event. Anyone can walk up to the door and say "More than Enough" and have their ID checked at the ropes and gain entry into the lobby to get to the cashier for that event. This information on this event is published on our website (www.lprnyc.com) and can be verified.
The other event is called "Back to the Eighties" and takes place in the "Main Room" and features an 80's cover band. The door time for this event is 11pm and we set up barricades and ropes to process all customers in an orderly fashion. The admission price for this event is $20 at the door. No customer can bypass the line for this event and must either check in on a prepaid list, or wait in line to be admitted through the lobby to the cashier for that event. The event information the Back to the Eighties party is listed on our website as well.
There are three large glass doors at the entrance to the venue. On Saturday nights, the left door is designated for the Gallery Bar events and the middle and right door are designated for the Main Room events. Furthermore, ropes are set up to separate the lobby to prevent accidental misdirection. We also post a security guard to stand in the center of the lobby to enforce access control and make sure people don't try to sneak from one line to the other.
When [redacted] approached the venue with 3 friends around between 10:20 and 10:40pm, the line that was formed for the 80's party had already gathered between 50 and 75 persons and it was considerably long. The 80's party wasn't open yet but customers generally arrive 30 minutes early for the show so they can gain entry first and get good spots close to the stage.
According to [redacted]'s claims, he said he was told about an "80's band that he had been in line for" by a security guard and he further claims that he was told by the cashier that he was paying to see the 80's band, and then the claim that he and his friends were tricked into paying for a "band that wasn't actually playing". All three claims are false. First, [redacted] and his group had not stood in line for the 80's band. If this was the case, they wouldn't have been able to enter the venue prior to the start time of 11pm for the 80's band and why would they be taken off of a line they were already on while everyone else had to stay on the line? That makes no sense.
Secondly, the cashier for the More Than Enough party assured me that she did NOT claim that paying admission would get them into the 80's party. As a matter of fact, my entire doorstaff, in addition to the staff for the 80's party that was at the door and the cashier for More Than Enough party claim that when [redacted]'s group arrived they originally intended to show up for the 80's party, but saw the line and decided amongst themselves to follow a couple of female customers for the More Than Enough party in to hang out until the 80's party was open at 11pm.
Furthermore, I've worked with that cashier for over 2 years and she is a reliable and honest person. Besides, only an itic cashier would try to pull a fast one on customers claiming to sell tickets to a big 80's band event when the actual cashier for that event is 15 to 20 feet away on the other side of the lobby, only have to those same people you just sold admission to be able to walk 20 feet down a flight of stairs and enter a small room that obviously is a hip-hop/house/soul DJ party. It would never fly and anyone paying admission accidentally or even someone who was misguided on purpose would notice and immediately return to the top of the steps and demand their money back. On top of that, if anyone were to come up and complain for being tricked, the cashier would be outed as stealing money from the opposing cashier's event and would lose their job.
In fact, [redacted] and his group purchased drinks and socialized for over 30 minutes before returning to the top of the steps to accuse the cashier of trying to trick them. After confronting the cashier, [redacted] and his group were told by the cashier that she wouldn't refund their money because they spent over 30 minutes inside hanging out and if they truly were mistaken and entered the wrong party, they would have returned immediately. At this point, the lobby security guard walked over because [redacted] (not anyone else in his group, just him) started becoming aggressive and demanding and was blocking the top of the stairwell where other customers were entering and exiting into the Gallery Bar. He then demanded that he be given $10 credit for him and each of his friends towards admission into the 80's party as a result of his claim that he and his group were tricked. The cashier and the security guard told him that the two parties have nothing to do with anot her and that if he waited on the side the person running the More Than Enough event would come upstairs and talk to him.
He agreed to wait for the event producer but when asked by the security guard to wait off to the side so as not to block the stairway, he used his pointer finger and shoved it in her face and menacingly said "I'm going to stand right @#%$#ing here and you're going to go back over there." At this point, [redacted] was considered uncooperative and therefore was ejected from the building with his friends for acting aggressive.
His reaction was that he wanted to call 911 and his friends' reactions were to just go somewhere else. He insisted that he wanted to call the police. His friends left him and he stood outside the venue by himself for 35 to 45 minutes in the cold with no jacket, intent on getting his money back. When the police arrived, the two officers heard his claim and flatly responded by asking him if he really just wasted their time over $10. He said "yeah, what are you going to do about it?" They made it clear he was wasting their time and that they had more important matters to deal with. They wanted to speak to the manager and I was present so I walked a few feet over to them. I explained that first and foremost, [redacted] was ejected for his aggressive behavior in the lobby by the security from the venue and if he hadn't gotten himself kicked out, the person who could have helped him (the event producer who controls the cashier and admission money for the ev ent he and his friends did attend) might have listened to his story, but since he was ejected anyway, he lost that opportunity. I also explained that the only person who could return his admission money was the business that took his admission money, which were the folks at More Than Enough, not LPR.
I also pointed out that I had multiple witnesses and that his friends had left him because they were smart enough to give up while they were ahead. The police officers agreed that he had no claim with LPR and that his claim would be with the folks at More Than Enough, but since he was ejected from the building for acting aggressive, he no longer had a claim. [redacted] asked the officers incredulously "So you're not going to make them give me my money back? and they told him no. [redacted] kept complaining that he was upset and that he wanted to complain to someone. He asked for a business card so he could write to someone at LPR to complain and I told him that it would just end up in my mailbox and he kept complaining. Finally, one officer said if you have a problem with the establishment you can write to the Revdex.com.
As you can see, [redacted] failed to mention his behavior that resulted in his ejection and his subsequent 911 call. He is also trying to make a claim for 3 additional admissions that he didn't personally pay for. It's clear to me that [redacted] is very angry that he was unable to get his and his friends' money back, he is also upset that he got ejected for being rude and aggressive with multiple persons (female cashier and female security guard) and he's upset that his friends left him as well as being upset that he waited so long for the NYPD and still didn't get his money back.
Note to the mediator, if you have any questions please contact me via email.
Thank you and best wishes,
[redacted]
