The amounts LEAF charged [redacted] ***'s company were the amounts set forth in the Lease Agreement and the Progress Payment Agreement There certainly was no "scam" as the complaint alleges That said, I had a nice conversation with [redacted] yesterday and I certainly understand the confusion she felt (and I understand that the responsibility for that confusion may lie with the oral correspondence of LEAF personnel).I believe LEAF and this customer have resolved the issue and this complaint should be withdrawn As a result, I do not feel the need to get into further detail at this point If [redacted] disagrees, I will be happy to elaborate and explain LEAF's position and actions further Brian K [redacted]

[redacted] has submitted this complaint against LEAF and it is wholly without merit I am going to explain the facts of this matter and describe why this matter should be wholly dismissed That said, I am willing to work with [redacted] to resolve this matter if she is interested in doing so At the conclusion of this response I will provide my name and contact information in hopes that we can work together instead of being adversaries But for now, I'll explain the facts of this matter LEAF is an equipment finance company and LEAF financed a piece of equipment for a lessee, [redacted] (I will refer to them as [redacted] throughout the remainder of this response) This is a commercial lease transaction between two business entities, LEAF and [redacted] At the outset of this lease, LEAF paid the full value of this piece of equipment to the equipment vendor so that [redacted] could have use of this equipment, and in exchange, [redacted] agreed to make monthly payments to LEAF To date, [redacted] has made of those payments but is now days past due on its monthly payments On the lease agreement, the Company provided the email address of [redacted] as part of its contact information MrDavin M***, an employee of LEAF, contacted [redacted] using the email address that was supplied to LEAF regarding the past due contract payments [redacted] has an obligation to make these payments, and there is nothing wrong with MrM [redacted] contacting [redacted] through the email address supplied by [redacted] to LEAF This alone should be sufficient grounds for dismissing this Revdex.com complaint But I will continue.During their conversation today, [redacted] indicated that [redacted] was sold This is a clear violation of Section of the lease agreement, which, in BOLD FONT, contains explicit language that says, "You have no right to sell or assign the Equipment or Lease." Now this raises a number of questions to which I would like an answer: Did [redacted] personally sell our equipment? Did she receive any benefits from selling our equipment? Our equipment certainly has value Did she realize that value and personally benefit in some way? Because if she sold our equipment, then I think she personally could owe us money for our equipment?If [redacted] did not personally sell our equipment, did someone else? Does she have any details for LEAF about this sale?Did someone else promise to pay LEAF? If so, who? What's that entities contact information? There are many more questions that could be reasonably discussed here if we could flush out more facts However what we know is that: [redacted] 's email address is the contact provided by [redacted] [redacted] is past due on its payments MrM [redacted] had every right to contact [redacted] in connection with these past due payments [redacted] likely has pertinent information about [redacted] breaching its contract with LEAF (regarding who bought the equipment, who sold the equipment, etcTherefore I would like to request two things: (i) I'd like to have a reasonable conversation with [redacted] to understand what took place with respect to LEAF's equipment and hopefully work through a reasonable resolution, and (ii) this Revdex.com complaint should be dismissed My name is Brian K [redacted] and my direct dial is [redacted]

We didn't look seriously at the contract!
It was a lease of a printer, the fourth year the Co in charge stopped the service when the scan was not working :"it's your problem : Internet! After dozen of phone calls the manager came and saw the printer in a closet and looked at the Brother we had to buy 3 months ago.
But according to to the manager of EAF We have to pay even it's not working!

Review: Financed a [redacted] track loader with Leaf. We paid for approx 4 years a total off 68,000.00. When we were in the process of changing funding companies, Leaf files a UCC on all our receivables and equipment. They ask for 5,000.00 to release the UCC, we sent the 5,000 and they did not release. They ask for another 5,000.00. I refused to send since they were not reliable. We ask for a pay-off and it was over 107,000.00. I asked about the additional charges, they said they had made collection calls to our office at 200.00 each. Since the pay-off balance was more than we originally financed, we could not reach an agreement. They sent me a letter stating that if I returned the machine, they would forgive the debt and account would be cleared. I returned the machine and they said that I did not voluntarily returned the machine. and that I did not send them pictures when they requested them. I have emails where I asked them where they wanted me to take the machine and they said to take it to our yard. Approx 6 weeks later they picked it up. They then placed a negative filing on my personal credit report. I've asked them to remove it and they have refused. They have given the account to 3 different collection agencies and once they see the documentation, they leave. This last collection agency is threatening on sending me a 1099. We have more than paid for the loader and we returned it to them. They now say we still owe over 107,000.00.Desired Settlement: They need to honor their letter and remove the negative filing on my personal credit report and leave us alone. They just wont quit!

I find this complaint to be very misleading, which is not surprising given this customer's conduct towards LEAF in the past. The customer begins his complaint to the Revdex.com by stating that he paid $68,000. What the customer omits is that the customer signed a lease for this equipment obligating him to pay 54 payments at $3,000 per payment. So the customer should have paid LEAF $162,000.

Review: Company has failed to provide an explanation of charges as requested. Company provided two separate account histories with conflicting information. Numerous requests were made to speak with a supervisor which were ignored. All communication documented via email.Desired Settlement: Full and complete reconciliation of account with all late fees and interest penalties removed.

Our Company certainly does not intentionally charge customers for amounts that are not owed. That said, I have tried, but cannot find any records relating to a Stephanie Lee Woodard and our company. I'd ask that [redacted] please provide some further information so that we can research this matter further. Is there a contract with our company she can provide? Or can she provide a copy of the charges she is complaining about? Anything to help me research this further would be appreciated, as I have yet to find her name in our system.

Review: I have a non-cancelable lease with Leaf Leasing. However, the document has been changed since I signed the agreement. Moreoevr, the party for Leaf Leasing did not date the contract. The statement of Non-Cancelable Lease was not on the document I signed. I asked the salesperson that sold me the lease was the lease cancelable and he stated yes. He had only been working with the company for a week. When I called back he was fired within that same week. Now, I being told on page 12 of the contract that there is a pay Leaf Leasing taxes for doing business in [redacted], NC in fine print.Desired Settlement: Cancel contract.

The contract has ALL CAPS, bold language that clearly states "THIS IS A NONCANCELABLE/IRREVOCABLE AGREEMENT. THIS AGREEMENT CANNOT BE CANCELED OR TERMINATED." This language appears directly above the Company's signature of the agreement. So I am not sure why this customer is claiming the agreement should be cancelable.

Review: I am considering buying out my copy machine lease with Leaf Funding. When I asked for the total buyout price, they quoted in price an "early termination fee" of $478, but falied to show where in the contract it states that an early termination fee will be charged, They have not responded to my request that a supervisor call me back to explain the potential charges.Desired Settlement: Give me a new buyout quote with no early termination fee.

Response:

A supervisor from LEAF contacted this company last week and I believe had a meaningful conversation to resolve all matters. From LEAF's perspective, this customer is seeking to terminate a lease which by its express terms may not be terminated early. To do so will cause LEAF to incur unexpected expenses such as storage. That said, in this instance LEAF is willing to forego charging an early termination fee but still will expect to receive all other amounts it is entitled to pursuant to the contract. As stated above, it's my understanding a supervisor from LEAF spoke with this customer and they are on the path to resolving this amicably. But please let me know if there is anything further for me to assist with.

Review: The company's broker/sales representative was unethical in sales practices. [redacted] ([redacted]) misrepresented the terms of a financial contract to secure an agreement with my company, for which LEAF did not honor and is unwilling to take responsibility for training their representatives to use such sales tactics.Desired Settlement: I would like to have the terms of the contract as they were explained to me by [redacted]. I was at the understanding this contract was a loan with a four percent interest rate. But it is actually more like an equipment leasing contract in which I'm being charged a monthly fee and I am playing $59,000 for a crane that cost $34,673.37.

I would like to pay off this debt in full, at the originally agreed upon price.

While LEAF disagrees in full with the customer's allegations, and the customer signed a clear equipment lease agreement, LEAF does not want its customers to be unsatisfied. For that reason, a senior customer service representative at LEAF has reached out to this customer and LEAF has offered a payoff quote to the customer which payoff quote is less than the amount LEAF is entitled to under the contract. My understanding is that LEAF and the customer have reached an amicable resolution to this matter.
