was out of the office and the Revdex.com correspondence was accidentally marked and sorted as personal mail and not opened until his return to the office.   Our formal response to Ms. [redacted]’ complaint is listed below:   Pursuant to Hawaii law, a lawyer cannot represent an injured person on a contingency fee unless there is a written agreement.   Without any exceptions, our firm always enters into a signed, written agreement with clients when we take their case.  We then provide a copy of that agreement to our client.     We did not create nor sign a retainer agreement here.  Although we did meet with Ms. [redacted] and provide a free consultation, we did not agree to take her case and we did not enter into a written agreement to handle her daughter’s claim.    We did tell Ms. [redacted] that we might reconsider our decision to not handle the case after one year when it became clearer as to the extent of the long term damage, if any (we had hoped there would be none).   We were quite surprised that Ms. [redacted] did not apparently understand that we were not taking her case and that she somehow thought we were handling the claim.  Since being made aware of her concerns, I apologized to Ms. [redacted] that I did not make it abundantly clear to her that our firm was not representing her or handling her daughter’s claim.   The suggestion that the passage of 18 months would impair her daughter’s claim is quite inaccurate, since the statute of limitations for minors does not commence until they reach eighteen.   In the meantime, I have referred Ms. [redacted] to a very competent and experienced attorney who will take her daughter’s case.  Hopefully, she has already met with him.   We wish Ms. [redacted] well, and we hope her daughter has a full recovery.     Please let me know if you require any additional information.   Mahalo,   Reece *.
