leaking basement due to grading issues that I had noticed early in the build”:  This is inaccurate.  No grading was done on the project early in the build and what he believes he saw early in the building process is unrelated to the state of the project after final grading. Final grade was completed and a licensed surveyor did a GAB (Grading as-built certificate) on 9/3/17. At that time, all the slopes and contours were in place and functioning properly according to the original survey approved by the City of Centerville.Once final grade is completed and an approved GAB has been done, Lee Homes’ contractual obligation has been met.  Subsequent weather incidents, such as heavy rains, is the responsibility of the homeowner and/or their contracted landscaping company who works the soil to maintain and restore a proper grade.  If Mr. [redacted] hired a landscaping contractor to complete the finish grade which would have included any general grading needed to restore the swales and contours resulting from heavy rains, he should be working with that landscape contractor directly.  If Mr. [redacted] did not hire a landscape contractor to complete the needed finish grade, he should consider doing so to help correct his issues and avoid future issues.   Regarding the patio: The cracks are not caused by a structure or craftsman issue and are therefore a non-warrantable item.  They are caused by the water from the side yard draining directly into the patio and when frozen, it causes heaves and cracks. Our cement sub replaced this patio once already, strictly as a customer accommodation and he did so not knowing why the patio was cracked. He was under no obligation to replace the patio at all. Properly landscaping the yard will help avoid these issues in the future.Regarding the claim of non-functioning drain tile:  Drain tile is not installed on interior or exterior walls of walk-out areas, therefore there is no drain tile there to fail. Mr. [redacted] needs to get the water away from the house and adjust his landscaping or take other measures to make sure water does not sit against the exterior walk-out wall and ensure water flows away from the home to avoid this issue.Although we find the landscaping issues Mr. [redacted] is having unfortunate, Lee Homes is not responsible for these issues. Hopefully Mr. [redacted] hired a reputable landscape company and they can assist him in making some needed adjustments to their work.
