Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Hello, yes, once we looked at the apartment, I was told to get a 100 dollar money order at a nearby postoffice. Nothing else was stated. We were walking back to the office. If you are going to want a 100 dollar money order and it will be nonrefundable, shouldn't I have been told that before I received the money order. There was no paper work in front of us. We had just looked at the apartment and was walking back. Not one time, did he mention anything about it being nonrefundable. How can you tell me I need to get a money order to move forward but not have the paper work in front of me at the time or not mention the nonrefundable fee? That is a horrible business practice and seems a like a scam.

After we got back and he gave me the paper work and left me in the room alone. He never even went over the paper work. He said just look over and sign to complete everything so that the application was complete. Then, after I fill out everything and he comes back. He asked about my credit. I said to him, "My credit is not that great. I have a voluntary repossession on my credit that I am trying to get straightened out. When I was in [redacted], during the recession, I was laid off from a job that got shut down. I was receiving unemployment. I was planning to move to [redacted] to go to school and I told them that I could no longer afford the car and I wanted to return it. They came by on a scheduled visit and got the car back. I had [redacted] insurance on the vehicle which should cover what I owed. This is why I am currently disputing this. This was not placed on my credit report until the end of 2014 and this happened in 2009. I asked him would that affect me getting the apartment? He just said. It should't be a problem, took all my paperwork and that was that.

The very next day, he calls me and says that I could not get the apartment because of my credit. I asked what happened. "He said, didn't you mention the repossession? That's why." He then said I could only get it if I can find a guarantor that would live with me and sign the lease. I asked to clarify, "They have to live with me?" He said, "yes," which sounded funny.

This bolded part in their response never happened. "The customer advised us that the credit bureau was misrepresenting their credit history. In response, we offered that the customer could contact the credit bureau(s) to have the information corrected and that if they chose to re-apply for the apartment that we would not charge an additional fee."  I was clearly told them that I had to get someone to live with me and call back if I do. I was at work, but I called back the next day after researching this. I asked for my application fee back because I needed it to continue my search. They told me then and only then that it was nonrefundable. I also informed the receptionist what happened and she said to wait next week to call back to speak to the owner. Then it all became a cat and mouse game.

It all sounds a bit strange considering others were looking at the this same model apartment (the real apartment wasn't even shown) that I was showed. They could be taking app fees, rejecting people, knowing the apartment is already taken. That is an unfair business practice and this is what it sounds like was done to me.

As far as the voluntary repossession (which was the exact term I used and they keep misunderstanding). A voluntary repossession is the same as a general repossession. Whether I return the car back ( hence the term "voluntary" repossession" or they have to take it, it is a repossession. They should know this and I thought they did. It would be reported on my credit as a "repossession" regardless. Although there are other issues with that situation that I am currently trying to clear up, I informed them of the exact thing that caused my application to get rejected pretty quickly before they took anything from me. They showed no integrity or honesty.

In
response to Customer Complaint ID#...

[redacted], we were advised that the car in
question was voluntarily returned, not that the car was repossessed. It was
further explained to us that the customer had [redacted] insurance on the vehicle and
that they believed that all was well with their credit history.
We had explained that unless this showed up on the background and credit
history search, and other parts of the application and background and credit
history search met our guidelines, that the application would likely be
accepted.
Upon performing the necessary background and credit history checks, this item
showed up as a collection on the customer’s credit report and therefore did not
meet our approval criteria.
The customer advised us that the credit bureau was misrepresenting their credit
history. In response, we offered that the customer could contact the credit
bureau(s) to have the information corrected and that if they chose to re-apply
for the apartment that we would not charge an additional fee.
In response to the claim that the customer was never informed that the
application fee was non-refundable, this information is clearly stated on the
application form. The subject line on the section of the application, that
outlines the application fee amount states, “Non Refundable Application Fee”
before the fee amounts are even listed. This page of the application contains
additional information as well and there is an acknowledgment at the bottom of
the page where all applicants must initial the page to indicate they have read
the page.

Review: I went here to look at an apartment. When I spoke to the sales person, he asked my salary and my credit. I explained to him my credit is a little low and that I had a voluntary repossession on my credit from about 6 years back. He said that shouldn't a problem. He showed me the apartment. It was a model. I told him that I liked it and he told me that I have to fill out the application and that I had to get a 100 dollar money order from a nearby post office to cover the application fee. I got the application however he never said anything about it being nonrefundable. The next day he calls to tell me they can't rent me the apartment because of my credit. I asked what did he mean. He said, "Didn't you say the car situation? That's why." I was in a public place so I couldn't speak further. I called to ask for my deposit back and they tell me you don't get it back. I told them but I don't know if you showed this apartment to 10 other people and just had me pay the fee to take my money. He then tells the lady he told me it was because of the car I gave back. I told her but I told him that upfront so that makes this whole situation even more unfair because he should have told me then, that I would not qualify so that I would not pay this fee. She claimed the manager would call me Tuesday (4-*-2015). I never got a call. I called back about 5 times and they kept saying he would get back to me. He never did. I need my money back. I am looking to move. This is shady business practices and I don't this it is fair.Desired Settlement: I would like my application fee of $100 back because I was never told it was nonrefundable. I told them upfront about the voluntary repossession.
