May 11, 2018This complaint refers to two distinct issues, payment of rent, and communication with our office.With regard to rent: All tenant rents are due on the 1st of the month by 5:pm, it is late after that time however late fees are imposed after 5:pm on the 3rd of the month if rent remains unpaid at that timeAll payments are applied to the oldest charges 1st as per lease termsThis tenant states that he called our office to inform us that he would be paying rent late; we acknowledge these kinds of promises but that does not change the late fee policyThis tenant’s payment history records partial payments ranging from the 1st of the month to the 30th of the month and everywhere in betweenWe have waived late fees on two occasions for this tenant.Pertaining to communication: The tenant has been issued a Day Notice to Pay or Quit times in the months of tenancyIn addition there have been two Day Notice to Correct or Quit for other lease violations, and a Day Termination Notice which was later withdrawnEach of the legal notices was sent both by USPS Mail and email with the exception of the Day Notice which was delivered in personIn addition to these written communications we have communicated with the tenant through text message from our software and through phone callsAs a matter of policy notes of all telephone conversations are also recorded by employees on the tenant account in the softwareWe have records of a dozen phone conversations, text messages and all of the mailed communicationsThe tenant’s phone message in question was responded to via text message the same dayWe will provide copies of written records upon request.The tenant and roommate caused physical damage to the property when the gas was shut off for non-paymentThe pipes then froze causing the water meter to burst and break other pipesThe tenants were informed about the damages and that they would be liable for the cost of damagesInvoices for damages were sent by USPS mail.A review of the facts of this tenancy indicate that there have been numerous lease violations and grace has been given both monetarily and in allowing tenants to stay in the rental unitWe do not believe any adjustment of charges is appropriateWe strive to communicate effectively and professionally in all cases.Should you have any questions regarding this rebuttal of the complaint you may feel free to contact our office again.Kelley *L***
