Please solve this issue with Legacy Enhancement. My name is S ***. I live in ***. In 2014 while crossing the street going to my baby brother graduation. My twins ( 5 years old ) at the time and myself were ran over by a vehicle while walking; my oldest daughter witnessed the entire accident, she was 13 years old at the time. I hired a lawyer , Geoff C, in Texas to handle our case. Geoff told me with me being disabled that he had to set an annuity up for my kids and myself. The annuity started in July 2018. It was set up with Legacy Enhancement. The papers and emails from Geoff stated that my children and I would be receiving nine hundred twenty one dollars ( $921) for all three of us. I was introduced to my trustee , Andrea M over the phone. I was sent a rule book for dos and don’ts. I read the rules and know what the dos and don'ts are, I noticed that when my kids and I went out to eat that our credit cards didn't work. Instead of getting money , Andrea changed my plan to not getting cash to just getting money on a credit card. Everything can be paid with a credit card. Please ask for the papers from Geoff C stating how much our cards or our checks would be. Now last week I was told by Andrea M and Jacky M that my kids and I can’t eat out twice a month which is a new rule. Im disabled to a hospital bed with air mattress and a wheelchair. I can't cook so when we don't have food we do eat out because our credit cards don't work at grocery stores and have to be called to legacy to be unlocked to shop at Wal-Mart. I called Jacky M at Legacy - Friday ( 8-2-19 ) to unlock our cards because I was at Walmart trying to get my twins school clothes & supplies. I also tried calling Andrea with the Federal worker on the phone - they did not unlock the card for me to purchase what we needed.
Andrea and Jacky were saying eating out messes with my benefits , and it doesn't interfere with my disability $849 or my medicaid. I was mistreated by Andrea and Jacky and I need you to look into this case. I have talked to Andrea about this issue but Andrea is now head manager and not my trustee. I asked Andrea and Jacky to show me in black and white that it says we can’t eat out but twice a month. Andrea said that she doesn't have to show me anything. I have Arkansas Medicaid ID. which I called them as well. Im asking that you see the files that my lawyer sent to Legacy Enhancement and look at the rule book form Legacy. Because it does not state that we can only eat out twice a month and why we cant.
And also why we can't get the amount that was granted to us monthly

I'm asking that you fight for me since I don't live in Pennsylvania.
I'm needing the information from my lawyer stating the $921 for myself and two minors . A check not just a credit card

Where's the new rule stating that *** and her minors can eat out only twice a month
My government benefits are not affected by my trust and disability
With this new rule about them not unlocking our cards has stopped us from shopping at Walmart. I need household supplies, toys,lawn stuff, and clothes from walmart
I can't cook and legacy is stopping us from having food when the kids and I are hungry
Everytime they want something out to eat after church our cards are declined, not able to process

To Whom It May Concern:This letter is in response to a complaint you sent to Legacy Enhancement through the mail. The customer who filed the complaint is on income-based government benefits like SSI and Medicaid. In order to protect and preserve those benefits, she set up a Pooled Special Needs Trust with Legacy. She receives funds on a pre-paid card (Si920 on her card and $500 per child) that allows her to make purchases for supplemental needs. If you know anything about Special Needs Trusts, you know that they can not pay for basic living expenses like rent/mortgage, gas, electric water and sewage bills and they can not buy groceries or food.These rules are from the Federal Government/Social Security7 and not Legacy. Legacy is just required to follow and enforce the rules. We do allow a person to eat out 2 times per month. Anything over that would jeopardize the income-based government benefits they are receiving. She was eating out 4-5 times per week, so we had to block the ability for her to use the card at restaurants as she was replacing groceries by eating out all the time and jeopardizing her benefits. Her 2 children also have iiinds with us and she was using their card also to eat out. She was also asking for the card to be unblocked so she could shop at Walmart. When she would send in the Wal-Mart receipt, she would purchase groceries for the home and not clothing/school supplies for the children. She also stopped sending in receipts for Walmart. Without proper verification and review, we cannot keep the store open. In order to protect *** and her children’s SSI and Medicaid we can not change the rules.I have proper documentation concerning receipts, blocking of stores etc. I'd also be happy to share the disbursement manual showing all the rules concerning the operation of the trust, should you want them. These rules have been in existence since *** joined the Pooled Trust.
