We take all customer concerns very seriouslyWe have for the past few months tried to work with [redacted] and we remain willing to do so As part of our response to this complaint, it is important to correct several untrue and misleading statements by [redacted] First, [redacted] *** [redacted] incorrectly stated that " In early December [her] contractor brought on [redacted] who worked for Legacy.” The fact is that [redacted] 's unlicensed contractor, [redacted] of [redacted] , was apparently doing some remodeling work on [redacted] ’s home and recommended our cabinet and granite business to [redacted] because [redacted] personally knew [redacted] who worked for us [redacted] did not hire [redacted] and did not have any legal relationship with *** [redacted] contacted [redacted] and requested our services [redacted] met with our designer, [redacted] ***, and picked out cabinets and granite [redacted] signed a contract with [redacted] for cabinets and granite material, as well as cabinet and granite installationAll payments made by [redacted] with regard to this contract were made to *** [redacted] then went on vacation and when she returned she informed [redacted] she was "Home and ready to start" her cabinet installation [redacted] seemed jovial and joked with [redacted] how happy and excited she wasEven inviting [redacted] to come and help her paint (see attached emails documents)Since [redacted] referred [redacted] to us, we, as a courtesy, asked [redacted] (weeks earlier) to provide us with a bid for cabinet installation (which does not require a license to perform) [redacted] provided us with that bid and we accepted his bidAfter [redacted] returned from vacation, and the week [redacted] was to start the cabinet installation, [redacted] sent [redacted] a sub-contractor agreement outlining his fee and wherein he guarantees the quality of his work [redacted] abruptly chose to not sign the agreement but instead went around our contract with [redacted] and negotiated with [redacted] separately and installed [redacted] 's cabinets without ***'s knowledge or permission, and [redacted] breached her contract with [redacted] by having [redacted] install the cabinets and then paying him directlyThis created a number of problems for ***, including but not limited to us not being able to insure the installation of the cabinets (per the terms of our insurance policy) as well as not being able to insure the stability of the cabinets for the placement of the granite on them, among many other concerns and insurance issues created by [redacted] 's actionsDespite [redacted] ’s breach of her contract for cabinet installation, we offered to complete the granite installation with an understanding that we could not insure the installation of the cabinets since they were installed outside of her contract by a third party who did not have a sub-contract agreement with [redacted] to legally insure the quality of their workDespite our offer to install her granite under those terms, she has not allowed us to do so, then we offered to discount the remaining balance she contractually owes us and offered to provide the granite to her directly so she could do with it as she pleased upon full payment of the graniteAll of these offers were either ignored or rejectedUnfortunately, [redacted] has continually attempted to rewrite her contractual obligations on the fly by her actions, attempting to cherry pick only the portions of the contract she wants and demanding to have us comply or she will file complaints against usOur attorney has communicated all options of potential resolution to [redacted] and her attorney on several occasions, without successHer attorney seems to no longer be representing herWe are simply at a loss as to what would make [redacted] satisfied other than a return of all the money she paid for her cabinets and granite, which the cabinets have already been installed in her home by [redacted] and her granite has already been purchased by us sits in our shop awaiting final paymentWhile we always strive for customer satisfaction, we cannot be held to account for [redacted] ’s unreasonable demands Please let me know if you need any other information

I am rejecting this response because:I first hired *** *** last fall after interviewing about different companies and meticulously checking references and work for each oneOur first thought was to paint the old cabinets, giving them a face lift and putting tile on the countertopsAfter talking with *** ***, he pointed out that it would not cost that much more to put in new cabinets, which would increase the value of the homeIn addition, my daughter was attempting to paint the walls behind the kitchen sink only to find that the countertops there had dry rot making it mandatory to replace themAfter several meetings with him, he brought in *** *** who worked for ***He never did any work in my home until the remodel began on April 24,
The only thing untrue as *** suggests is possibly the datesI was not, nor would I ever be misleading on any of my statements
Upon doing research I see that *** *** sent me designs for approval on January 8thGoing backwards from that date it was likely January 5th *** *** came over to talk about designsI never contacted *** and requested their services. *** *** spoke with *** *** about our project** *** explained that if I paid upfront for all of the cabinets, half of the labor and half of the countertops that *** would guarantee their products(We ordered *** cabinets and *** countertops, not graniteI gave her a check #*** for $on January 12thThat check cleared my bank on January 18th*** ordered my cabinets on January 19th, waiting for my check to clearThe cabinets were to be delivered mid February*** *** called me about that time and told me the cabinets had been backordered and would not be in until mid March
March 23rd the cabinets arrived and I contacted *** *** and *** *** to let them know*** *** informed me that since the cabinets had been backordered he had to take other jobs and therefore couldn’t start until April 24thGranted, I did go out of town but not on vacation, after the cabinets had been delivered and put in the middle of my living room, we went to do some volunteer work leaving Monday, March and were home the following Friday, March 31stThat days of volunteer work in no way interfered with the remodelThe cabinets remained in the middle of my living room until they were installed
*** *** was my contractor and I had an agreement with himHe brought in *** and told them since I was his client, he saw no reason to sign another contractI am wondering why *** insisted on his signing a subcontractor agreement with them when he already had one with me? Did they either accidentally or purposely give me the wrong contract? Shouldn’t the contract between *** and myself have been a subcontractor agreement rather then them seemingly kicking *** *** to the curb? The negotiations between *** *** and myself occurred long before *** was ever brought into the situation
On several occasions I asked *** to provide me with a copy of the original contractI never received that contract until they got their attorney involvedIn retrospect, had I known all the ins and outs and legalese of the contract, I never would have signed it as it essentially put them in charge of my project, leaving my contractor outAfter hours and days of checking references, why would I want a contractor whose work I had no knowledge of? They did make an offer to let my contractor stay on and me pay him directly (their offer, not mine) but there was a discrepancy between the amounts of the first contract and their second offerI repeatedly asked them to explain the difference and told them I would be happy to sign the new contract if they could tell me what the difference wasIt wasn’t until their attorney became involved that I found out that it was simply a bookkeeping error
*** never offered to complete the granite (***) installation but rather had their attorney send me a contract stating I was to pay 100% of the balance of the *** up front, with their taking no responsibility for any damages to my cabinets, my new tile floors, my home or property, a gag order saying I could not say anything bad about her company and it all had to be notarizedWhy on earth would anyone ever sign a contract like thatI took the new contract to a notary, changed places; I would pay half up front and the remainder upon completion of the work to my contractors specifications and *** would take responsibility for any damages to my home and/or propertyI then had it notarized*** refused the contract with my changes without any negotiations
From this point it went from bad to worseI called the *** *** ***’s office and asked for a referral to an attorney that helps senior citizensThe situation was explained to them and they asked that I in turn give them a written report, which I didThey then referred me to a company who could give me the name of an attorney who handles cases for seniors. This company referred me to a *** *** *** and after speaking with him over the phone he agreed to write a letter to the *** attorneyAgain we went back and forth a few times without any headway*** continually refused to negotiate
Furthermore, in one of the letters from the *** attorney to *** ***, *** *** stated that *** refused to refund any of my monies since I had scheduled install of the countertopLet’s be perfectly clear here, neither my daughter, my contractor nor myself ever scheduled any such install and I gave them notice that I no longer needed their services on April 19th, before they hired an attorney
On May 19th I responded to *** *** about his letter dated the same day and in that letter questioned his ability and desire to represent me when he worked in *** ** and I am in *** ***After not hearing from *** *** by May 31st, I again contacted ***s attorney asking their intentionsWhen I got no response I was forced to contact another company for my countertops, which I did Thursday afternoonThey were to come either Friday afternoon if time permitted or Monday, June 5th at 10AMThey came Monday as scheduled, measured and installed the 8th of JuneMy daughter, her twins and myself had been living in an unbearable situation for almost months, dining room full of boxes rendering it unusable, boxes stacked in living room until my contractor could start work (again, due to the lateness of the cabinets he was forced to take other work) and finally no kitchen whatsoeverWhat would you do? Why did it take *** from January 18th until now and still not accomplish what this other company did in a mere days?
