I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below [redacted] There were two primary concerns with the rental of this apartment The deceptiveness of the information provided and the health risks the apartment posed to my party Clearly, the apartment was not what it was advertised to be Even the owner’s (Legacy Realty & Property Management) response acknowledges as much as their response centered around the fact that they had option of changing the furniture/accommodations Apparently they’re of the view that they could exchange what was being advertised with sub-par replacements that probably cost them considerably less for them to rent than the furnishings they were advertising Again, the apartment didn’t even contain all of furnishing/accommodations that was conveyed on the websites or displayed with the various photos; such as a ceiling fan, air conditioning, headboards for the various beds, and in particular the “Table with Seating for four” that was specifically documented within the rental agreement It’s also quite telling that the owner didn’t address any of the health risks within the apartment The bathroom had mold growing all along the tub and the apartment lacked any effective means of dissipating the stifling heat The elderly grandparents of the graduate that were to stay with us would not have been able to tolerate the stagnant, stifling heatIn fact, I don’t think anyone could have tolerated the stifling heat that would have built up in that apartment (which is located on the top floor of the building) over the course of that hot weekend We had no expectations of encountering these issues with this apartment In researching this property on "vacationshomerentals.com ,the apartment was listed with having air conditioning and one of the pictures also displayed a ceiling fan It wasn’t until we arrived at Legacy’s office that we were told that the air conditions were not put in yet Again, the apartment didn’t include the air conditioning and/or ceiling fan that was being advertised, nor did it have any other effective means of managing/ regulating the heat for the safety of my party The existence of the rampant mold further exacerbated our health concerns As for the balance of their response, it’s as deceptive as their advertisingSome of the more egregious statements that warrants comment: In response to their assertion that they encouraged us to review their website thoroughly, to watch the YouTube Video of the Apartment Building and their other suggestions as to how we could have conceivably done better due diligence, please note the following: We did thoroughly check the internet and came across this property being listed on "vacationshomerentals.com It also advertised predominantly the same details, but also listed the apartment having air conditioning and a photo that displayed a ceiling fan None of the correspondence we received from Legacy, ever made reference to a YouTube Video In any event, in reviewing the video now, it’s apparently a video of another apartment and not of the one that we had rented, which would have only been even more deceptive They suggested we should have sent someone over to check out the apartment I understand that apartments, such as this, are occasionally rented by visiting fans from out of state Universities for football games How would those potential renters be in a position to have someone “check out” the apartment in advance of their rental, and avoid becoming victims like us In response to the Payment issues: The Agreement called for 50% of the $rental fee and the $Security deposit (for a combined total of $1200) , be paid in advance, upon execution of the agreement Both of these checks (including the $ security deposit) were cashed by Legacy back on February 5, We then proceeded to given them the second half of the $rental fee (ie., $600) when we arrived at their office on the day of the rental to obtain the keys for the apartment When we arrived at the apartment and it became evident that we couldn’t stay there due to the aforementioned health issue, we informed them that we wouldn’t be staying and requested a full refund, which they rejected As they already had $1200, effectively the total amount of the rental in their possession, and given we couldn’t have incurred any damages as we didn’t take the apartment, and thus should have been refunded the $ security deposit , we proceeded to place a stop payment on the pending payment In their closing comments, they state “ ..Legacy do not believe MsAbate did her due diligence in finding a rental unit.” Isn’t that an implicit acknowledgement that the apartment wasn’t up to the standard that they were advertizing? Their effectively stating that we should be penalized for not having taken every precaution to uncover the fraudulent misrepresentations, and not them, for having perpetrated the deceptive misrepresentations While we’ll continue to pursue whatever recourse we can to obtain our $1,refund, we’re hoping the Revdex.com will take every action it can to protect other unsuspecting renters from being caught in this situation in the future

There were two primary concerns with the rental
of this apartment.  The deceptiveness of
the information provided and the health risks the apartment posed to my party..
Clearly, the apartment was not what it was
advertised to be.  Even the owner’s (Legacy
Realty & Property Management) response 
acknowledges as much as their response centered around the fact that

This is the worst rental agency I have ever dealt with. They take full advantage of college students and are extremely difficult to deal with. Check out their Google reviews, too! The reviews are not favorable.
Have an attorney review any lease you are considering with Legacy Realty, aka Ballyho Realty, and I am certain you will be advised to go someplace else. I would never do business with these business owners, Brad & Jennifer K[redacted]. In my experience they are crooks and predators and should be prohibited from working with college students.

Review: I am writing to express the disappointment I had when I had rented a apartment thru this company. Based on the pictures that were posted on their vacation rental website, we were very excited to find this rental. We proceeded with the rental agreement and sent payment to secure our date if May 9 & 10. 2014. When I arrived at the apartment I was so taken back and very disappointed. The apartment was nothing like the pictures. The furniture was all different, the floors were extremely worn out and buckling. The kitchen was very old with cabinet doors that stuck together and paint pealing off them, the floors were sticky and was missing tiles of linoleum. The bathroom had mold growing all along the bath tub and Rust all over the radiator covers.There was no air condition or fans and the windows had no screens. The outside temperature was 80+. We couldn't open the windows because there were pigeons on the window sill. And much much more...With all this we left the apartment 1/2 hour after we got there and went to hotel. (I have pictures). This was my daughter's graduation weekend. As I was deceived by the information posted on their website, I would appreciate your assistance in recovering my deposits.Please contact me to further discuss.Desired Settlement: Payment in full - $1,200.00
