To: Revdex.com ***
The items spoken of
by Mr*** like the roof leak have been addressed and will continue to be trouble shot until rectifiedThe issue is the roof framing around the large masonry chimney but we will certainly get it figured out
The garage floor was inspected on by the concrete contractor Whited Concrete and was found to be properly finished and in their opinion no issue exists
Most items other than these two particular items have never been discussed and would obviously not been dealt with
Thank you

Initial Consumer Rebuttal /* (3000, 7, 2015/09/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Roof is still in progress
Whited Concrete could not explain why the garage floor looked differently than when finished when water is on the floorTheir response was 'don't get it wet' Pictures attachedI have another contractor scheduled to look at the garage floorI will update when I get their opinion
Caulking around screen post was mentioned to Legacy in spring and has been ignoredSee email dated June requesting all of the above issues to be addressed
Final inspection still not called for by LegacySummit County said they will not perform without the builders call
Loose trim was also mentioned in the spring, but it was in a text message, and got so bad that homeowner had to fix himself before it warpedMany items throughout the project where ignored by Legacy leaving the homeowner to finally fix them himself because of the lack of responseA job foreman named Joe was hired which only added to the lack of follow up
Siding was put up full of mud and therefore hard to see the problems
Missing floor nails on outside deck not discovered until carpet was being put down this summerQuicker to fix as the carpet was going down then to wait months for Legacy to reply
Truthfully the homeowner just finally gave up on getting smaller items fixed because the requests were ignored so oftenLegacy delays this spring and summer on serious issues caused the homeowner to want everything corrected
Legacy will not address any issues other than the roof as stated in their responseLegacy says the warranty period is past, but the warranty of one year has not expired since the work was not finished until winter and has had no final inspection
Also attached is a handwritten sheet of items that needed to be completed (this was given to Joe in November or December of 2014)

Mrs [redacted] and Legacy had an agreement to address her concerns in March of 2016. We have every intention of addressing the items that are covered on the contract.
The yard grading and personal utilities are clearly spelled out on the contract...

as not being the responsibility of Legacy.
We will contact Mrs. [redacted] about the items she is asking to be addressed by end of business today.
Thank you,
Bill Y[redacted]
Initial Consumer Rebuttal /* (3000, 7, 2016/03/07) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The word "agreement" implies communication. I received an email in December demanding payment or Legacy would get a lien on my home. At that time, I resent my list of concerns. Legacy's response was a certified letter again demanding payment. I responded with a certified letter again detailing what needs to be completed and setting a deadline for completion as March 1, 2016. I received no response from Legacy. I filed the complaint on 3-1-16 as promised
The contract does not address grading. Grading is not the cause of the wet walls at the front corner of the addition. The cause is insufficient spouting for the run-off from the roof of the old section of the house. The wet wall on the back may be from grading.
The contract does state that Legacy is not responsible for private utilities. However, Legacy did take responsibility when they disconnected those utilities.
Final Business Response /* (4000, 13, 2016/03/21) */
I met with the homeowner last week and we agreed on a number of items to be repaired in order to resolve her complaint. We will have these items taken care of this week.
