I purchased a car from Legend auto sales in April 2015. 8 months later still no tags. I turned car back in. Legend refused to give $1500 down payment I purchased a 2004 Nissan Maxim in April 2015. I was told it would take 3 months to get the tags. I was also told that the vehicle had been wrecked in the front. Three months came still no tags. Calvin told me that the person he had gave the money to get the tags had stole his money and it would be a little longer. Next month came no tags still. Calvin still trying to explain that he was trying to get a clear title for the car, to please be patient. By now I concerned about the fact that I am insuring a car and paying $300 a month for a car that is still not registered to me. I called Nashville two times and both times they said there was no paperwork on the car showing that he even applied for a title. I also called farmers insurance where they said that the car was still in their name because it was a salvage title. I called him and explained my concern and to make me understand what salvage title meant. Calvin tried to explain again that they bought the car from Copart. I then tried to ask for my $1500 down payment back. He said be patient he was going to get them. I then asked for my money again. Two months later I am still driving on a drive out tag. I am very upset and I called him and told him that he had til November 30, 2015. to get the tags or I wanted a refund or to be put in a car that had a clear title. He did'nt agree to the refund but agree to getting another car. On November 20, 2015 I received a text from Calvin that said he should have the tags by Nov 30. Then on Nov 21, 2015 he text me and asked me to have the vehicle to his car lot so he can get the car inspected. This is the inspection that was supposed to take place prior to the sale of the car because it had been wrecked and had a salvage title. I refused to come and again I asked for my down payment back and I would give him his car back. I had already stopped making payments on the car in October. So this time he agreed to the refund bout got upset because I refused to take a company check. He never responded after that. I called a week later again asking for my money back and he said that his attorney said that 8 months was within the normal amount of time to get tags on a vehicle and that the car was up for repo. So I decided to return the vehicle and take further action later. He also had a conversation with my husband Armon saying that my car was not the only car that needed to be inspected he had 20 other cars that were no clear titled. Keeping in mind he actually filed for the title in November. Meaning he never filed prior to this.Desired SettlementI want a refund of $3300.00. Because he was not honest and told me what was really going on with the car I want all my money back. I now do not have a vehicle and has caused a major hardship in my life. I did what I was supposed to he need to do the right thing. The only reason Calvin was telling me anything was because I told him I called Nashville and farmers insurance. I was doing my own investigation. He never told me anything outside of he was trying to get a clear title.Business Response Sorry about the late response to to your letter but thank you for taking time out to read it in advance. Ms [redacted] purchase a vehicle with us thru our "Lease Purchase Program" having to put down One Thousand Five Hundred Dollars ($1,500.00). At the start of our program we ask our clients to pay three months of monthly notes in lieu of clients filing bankruptcy,repo ,etc. Once Ms [redacted] made her third payment and it was time to get her tags we did have an issue with the company doing our title work but we extended Ms [redacted] a courtesy of not having to make a payment till she got her tags and she was still able to drive the car. Her last payment was on 9/11/2015. Once we got the title situation taken care of we ask Ms [redacted] to bring the car in for inspection. She refused to do so and started demanding her down payment back in full after the courtesy we extended allowing her to drive for free. After discussing the events with our companies lawyer (Joe Barton) he stated we went over and beyond to extend Ms [redacted]'s needs and that we did not have to pay the down payment back. Ms [redacted] then voluntarily returned the vehicle to us.We have the car ready to register and would be happy for Ms [redacted] to still get the vehicle but she would have to bring the full balance in because of the circumstances now.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I do not accept the response from the business. Mr. Calvin has lied once again about the nature of this situation. Legend Auto Sales has had several issues with getting the tags for this vehicle. He has had to sue the person he gave the money to to get the tags. He went to court on October 28, 2015. He also states in a text that he had filled out for the tags himself on the 28th of October. Mr. Calvin never stated to me through out the entire 8 months that I didn't have to pay my car note until I get my tags. That is a lie. If this was true why did he continue to accept my payments for the car note up until September? I stopped paying the car in October because I am now realizing that he really has no intention of getting these tags. He just taking my money. I also stopped paying because of the liability I was carrying by insuring this car that was not registered to me. So if I was in a wreck the money would have went to Legend Auto Sales not me. I explained all of this. I have been more than patience on an issue that by the law he really had two months to get tags on this vehicle. We are now in the 8th month. By the end of October I then asked him to either return my down payment or issue me another vehicle that had a clear title. I went into his office on October 30, 2015 with my friend [redacted] We drew up a letter stating that he would have tags by November 30, 2016 or he would transfer all the money I have given him which was $3300.00 into a new vehicle of equal or better value with clear title. I asked for the down payment originally. He agreed on the phone the day before but when I came in he had said his business partner did not agree to that. So that was how the letter came into effect. Mr. Calvin is also lying when he says that once he got the title situation taken care of he asked me to bring in the car for inspection. He needed the car to get inspected in order to get the title. November 20, 2015 I received a text stating that the tags would be in in probably 10 days. I didn't respond. Then text me again saying he needed the car by 10am to get inspected and that they were almost done with the process. Also stating the car has been wrecked [redacted] there no way around that. The car should have been inspected prior to him selling the car to me or anyone else. He agreed after going back in forth to give me my money back. The only reason it didn't happen was because I didn't agree to a company check. I wanted a cashier check or money order. So this why we are at this place where I have representation and I am pursuing this in court. I want a refund and out of the contact based on untruth and not being able to obtain a legal title within the statues of Tennessee. I have text messages, paperwork, pictures and receipts to back up what I am saying. Final Business Response
