Thank you for sending us this complaint. Keeping members happy is certainly a top priority for us and in this case we have communicated with the member from day one as to the terms of their contract.

In November 2014 it was questioned as...

to why there was a reoccurring charge for Caesar. The family knew there were reoccurring charges for [redacted], [redacted] and [redacted] but wondered why there were charges for [redacted] We immediately wrote to [redacted] on the day we received the written request so that we answered our member promptly.

We wrote back with the attached e-mail correspondence. Since then there have been several verbal discussions at the gym with [redacted] and it was reiterated to her that [redacted] signed an annual contract and is required to complete the term of his financial obligation that he signed for. The information provided to them in these conversations is that there is a contract in place and in lieu of signing an annual contract the fees were greatly reduced. As an example for a month to month contract the monthly fees are $183.75, a three month cancellation term contract have monthly fees of $156.45. [redacted] was offered $50.00 per month plus GST. As noted substantially reduced costs.

It is noted in the complaint that the member was pressured to sign a contract. This is absolutely not true and makes no sense as to why someone would sign a contract without reading the terms or agreeing to them. As you can see the contract is very simple and in plain English for legal ease and the terms for cancellation are very clear and noted in several places. [redacted] should be familiar with this contract as three members of his family have been on the same contract for some time.

It is our position that a valid, binding, legal contract is in place as signed and initialed in multiple places.
