I am rejecting this response because MrD*** clearly is missing the issue at hand. It was his responsibility and legal obligation to uphold the contract
to which his representative signed and agreed. Finding an alternative contractor should never had been necessary had he just upheld the contract
As to the statement that we did not allow him time to find an alternative contractor to provide the services at the same costs, is flawed as well. The contractor that he suggested to do the job is, in fact, the same one that has since completed our project. Our new contractor made it very clear from the beginning that they could not honor the project amount on the original contract. Stated that they were aware that Lehigh "cut the margins" too thin and were not "making a profit".
As to the weather argument, today in reading his response is the first time that weather has ever been introduced as an excuse. The more accurate account is that he ignored any contact with us as a way of avoiding the issue that he really had.....no longer wanting the project because he could not make any money!! There were countless attempts to reach both MrD*** and MrF* which went unanswered, in our attempt to find out why we were being ignoredHe did in fact return the deposit but not before many phone calls requesting the release of the funds. It was necessary on our part to contact the manufacturer for assistance with their distributor. It is my understanding from the manufacturer that they had several phone conversations with MrD*** concerning his lack of contact and refusal to complete our project. As a matter of fact, it was their representative that first advised us of the "margin" issues for MrD***. Our new contractor also had to place phone calls to MrD*** requesting the release of the funds back to usMrD***'s response letter just continues to solidify his inability to take responsibility for his own actions which lead to a breach of contract. No where is his letter does he take any blame for the situation that he created, instead he places blame on us for not continuing to wait on him. His lack of moral and ethical practices just continue to shine through in his wordsI would request that we not lose sight as to the original complaint, which was a breach of contract. Regardless of how he would like to cover up the issue, there was a signed contract to which he walked away from based on nothing more than his bottom line.

In response to this letter, we had spoken to [redacted] on Tuesday, January 6, 2015 in reference to scheduling our installers for taking care of the issue with the roof leak. We let [redacted] know that the guys would be there Friday, January 9, 2015 to fix the issue. We apologize for any...

misunderstanding they might have had with us, however, we did not build the room and we were not obligated to fix it either. We are a dealership of [redacted], but the original company to build their room was not Lehigh Patio Rooms, Inc. Throughout the holiday seasons, our company had been closed and the emergency line was checked every other day. Additionally, there were no installers available to help fix [redacted]'s roof. This is why we called her back as soon as we could on the first week back into the office. Again, we apologize for any misunderstandings and the roof leak, as of the lateral part of Friday morning, has been fixed.

Review: We purchased Every tractable awning in July 2012 Upon opening it June 2013 we noted a sag on the one end. The height of the awning was specified in the original contract. A phone call was made to the dealer and after numerous phones calls, a call to the factory. I was promised on various dates that they would be here the next day that did not occur. Finally, on July 19, they did come to look at the awning. At that time they said that two bolts were missing. The men accused us of removing the bolts. New shoulders were promised to us for one week later The following week after that I began to call every day to find out when they were going to fix this. meanwhile we were unable to use the awning at their direction. When they finally did bring the new parts, after canceling and rescheduling numerous times, they could not fix it. The awning was taken to be repaired at the factory with a promise of return on August 13. It is not here.Desired Settlement: We want this awning either repaired immediately to be working according to the contract or removed entirely repair done to the wall of the house a refund of the original cost plus the cost of having to get a new one from a new company and our inconvenience. I could not use the awning in the record heat of this summer. In addition, I cannot sit on my deck because I must limit sun exposure due to medications I am taking.
