LEI windows maybe good, but their sales tactics are questionable. The salesman tried explaining that we would get nearly 84% return on window replacements. However if anyone is knowledgeable of remodeling, windows give little value to value of the home. Before they make false claims to push their window they should do more research on the local real estate market and how homes are appraised and valued.

We greatly appreciate your feedback, good or bad. After all, that's the best way for us to learn where and how we can improve. First, we apologize that you feel this way about our sales approach. The Return on Investment number on windows you are referring to does not come from us and was taken directly from the 2020 cost vs value study (see www.costvsvalue.com). This study is being updated every year and regularly referred to by home improvement companies. I respect that you may not agree with them on their findings, but I want to assure you that we did not make this number up for our advantage. After all, no matter what the real ROI might be, it would theoretically apply to any window you decide to purchase. For this reason, our focus has always been on the quality of our products which is backed up by our industry leading warranty and the outstanding longterm energy savings.

LEI is forcing me to pay for windows that were denied required approval from my HOA. I am being forced to pay for services not rendered.
I signed a contract to purchase windows with LEI under the agreement that it must be approved by the HOA, showing in terms and conditions part 1 of the contract. The sales person said of course. After my request for approval was denied, I sent it to LEI saying to hold off on the order until I get approval. I emailed the board and tried to appeal their denial , then met with them in person and they stand firm on their denial. I tried to cxl the order with LEI and the said they already manufactured them, so I have to pay and take them. I said they shouldn't have manufactured them without approval as stated in contract. He said I still have to pay, and he will proceed with legal action to collect payment from me. I filed a complaint with the bank ***, and they reviewed my contract and HOA denial letter, and said I still have to pay the bill. The contract is misleading. The bank sent the funds to LEI, and I have to pay the bank back for funds and product I did not receive. I can't have them installed because the HOA denied approval, and LEI won't let me cxl the order.

Desired Outcome

I would like LEI to cancel my order due denial of approval from my HOA. I would like LEI to pay whatever funds they received from *** back to the creditor, and stop billing me and have the loan cancelled. I tried to cancel the loan and the bank wouldn't cancel it. It's all not fair.

I am well aware of this situation as I was in regular contact with our client during this process.
Our client signed the agreement on 7/22/2019. I have attached a copy for your information (Exhibit A). At no point in time were we informed to wait on any further instructions from the client before we start production of the ordered items.
In her complaint our client referenced section 1 of the Terms and Conditions of our agreement. This section clearly states that "With respect to the Products, the Owner shall ... (c) obtain all necessary approvals, permits, and authorizations from HOA or local authorities."
On 7/29/19 our client signed the first set of loan documents for the purchase of the windows (Exhibit B) which is another indicator that there was no hold on her order.
On 9/13/2019, our client requested we take a picture of her custom-made windows to show to her HOA, and which I emailed to her (see Exhibit C1). In other words, our client was very well aware of the fact that the windows had already been made according to her specifications (see Exhibit C2).
On 10/24/19, three months after the order was placed, and over a month after the products had been manufactured, our client sent me a text to cancel the order. I communicated with our client several times to explain the situation and her options in detail. While the contract does not provide for a cancelation clause due to the nature of our custom-made products, I made a good faith effort to compromise on 10/28/2019 (see Exhibit D), but there was no response from her. Since our client's windows were custom-made in terms of model, color and seize they cannot be returned or used anywhere else.
As our client pointed out herself in her message to you, the financial institution through which she financed her purchase sided with our point of view after carefully analyzing the Exhibits listed above.
There is no doubt that our client's HOA created a very frustrating situation for all parties involved, especially for our client. And there does not appear to be a perfect solution short of installing the windows as originally planned. However, we have made every effort to keep an open and direct line of communication with our client and tried to compromise to the maximum extent possible. We disapprove of slander on social media as a means to achieve your goals (see Exhibit E). If you have any other suggestions of how to resolve this issue, we would love to hear them.

When I signed the contract it was spoken out loud between me and the sales person that it needs to be approved by the HoA first. He said of course, and we both thought it would be a non issue since they were the same as other windows in my community. I texted the salesman As soon as I received the denial letter and asked to hold up. He said it was too late they already manufactured them. I tried to appeal with my HoA 3 times and finally met them in person, and they still stand in their denial letter. They said all windows should be contingent on approval from HoA first as stated in section one of the contract, so based on that and the salesman knowing I needed approval first, I don't think it's unfair to request cancellation. Why would I pay for windows I'm not allowed to install? What am I going to do with them? I am distraught with this. I need another option, I can't afford to lose all this money and have no windows to show for it. He said I have to come pick them up far away in Statesville at a warehouse. If I have to pay for them at least he can deliver them to me.. Maybe I can donate them to charity. I am also open to trying again with the HoA to install just some of the windows that are exactly like my current ones. They can refuse exact same style. There ar 4 windows out of the 15 that are exactly the same as my original window style that should be able to be installed if I can get the HoA to reasonably work with me. At this time time My HoA is not accepting new requests for windows for approximately 3 months. I would like a chance to put his on hold until I can appeal the HOA again and perhaps get some if not all approved for installation, and adjust the cost as fit for windows that can't be installed vs ones that can. And if the HoA says no to all again, at the least, if the contract binds me for paying for windows I can't install, I would like them delivered to me so I can at least try to give them to charity, with detailed receipts of the cost of each window less installation costs if they can't be installed. I still feel very distraught and stressed about this whole experience, and misled by the salesperson and contract. I feel as though they shouldn't have manufactured them before having my HoA approval letter, that is normal procedure. Why on earth would anyone sign a contract if they new they would have to pay for windows even if approval was not granted.. this whole thing is so unfair and expensive, and just makes me ill. Please just make this all go away the best and fairest way possible for all of us.

I am still very upset about this whole consumer experience. I'm out 8 thousand dollars plus over 200 dollars in interest charges that I wasn't aware of. I have no windows, my best option was to give them to charity since I was legally forced to pay for windows that I was unable to obtain approval to install. The amended contract lowered my cost by removing installation costs which were never listed in detail. I just had a flat price, a contract I couldn't cancel with reasonable reasons and a lowered flat price to deliver to address of my choice, being a charity because I can't do anything with un approved windows. I feel ripped off, mis led, and lied to. People I've explained this situation to can't believe the contract wasn't contingent on approval from the HOA as it reads to the general public. Consumers need to bring an attorney with them before signing any contract with this company, to understand their real rights, not what the salesman lies about to encourage the signature. The contract I signed and the salesman made me believe that the purchase was contingent on approval of the HOA. I strongly believe that LEI should have let me cancel the contract after my HoA denied approval. The day I signed the contract, I told the salesman that It has to be approved by the HOA first, and he agreed, and said "of course". I would never have signed that contract if he confessed that if the HOA denies approval, I still have to pay, and the fact was not disclosed that I was to pay accrued interest from the loan starting 6 months before my first payment was due.. I had to pay over 200 dollars more in accrued interest to pay off a loan for a product I don't have.. I feel so ripped off and disrespected as a consumer. LEI put their greed before the customers satisfaction. I would never recommend this company to anyone. I'm out 8 thousand dollars plus, have no windows, and have dealt with multiple hours of aggravation trying to fight for my rights to cxl this project..I feel robbed and thoroughly disgusted with this company.

I do understand our client's frustration resulting from the HOA's denial of her request to install the new windows. I also believe that my previous statement supported by documentation lays out in detail the timeline of events in a very objective and factual manner. Without repeating the details, you will understand that I object to accusations of misleading or lying to our client in light of the documentation on hand. A few days ago, we (the client and LEI) agreed on a compromise, and documented it in writing, that didn't give either party 100% of what they felt entitled to. With all due respect to the understandable frustration and anger our client has experienced as a result of her HOA's decision, we feel this compromise is an equitable outcome of this difficult situation.
I cannot comment on the loan terms. While we facilitate the financing process between our clients and the lender we do not present the loan agreement to our clients, are not a party to the loan agreements, nor do we derive any financial benefits from the loan signing or loan terms.

Lei should not have manufactured the windows prior to approval from my HoA, and should have let me out of the contract when I wasn't able to get approval.
