I purchased an Above Ground Pool from Leisure Life Pools, Spas & Billiards that was installed on May 5, 2020. The purchase receipt states on the bottom, 'All returns must be accompanied by a receipt within 30 days. Restocking fee may apply.? I need to return the pool due to the fact that my backyard has a slope and my fence is not tall enough per my HOA. After careful research the Above Ground Pool can only be put 2 feet in the ground which is still not low enough. On May 22,2020 my Husband, Mr. *** contacted them store to explain the issue and advise they he wanted to return the pool. He spoke with Mr. Aric S, who is the part owner of the company's debt he advised my Husband that he can't take it back because it has been installed, but there is no policy that states this. On May 23, 2020 I visited the store and spoke with Mr. Aric S and showed him the receipt and advised him that I would be willing to pay the restocking fee, he can keep the install fee, and I would pay to have the pool uninstalled, but he stated, 'It's no way I can resell this pool and it also has depreciated.? I asked Mr. S, 'Please tell me how much it would be'? Mr. S responded, ? I wouldn't even know how to add that up. If you want to seek legal action that's fine. Have a good day.? When I got into my vehicle I called the location located in Lexington, SC and asked the representative, 'Do you have a 30 day return policy on your pools'? He stated, 'Hold on and let me check. It will be up to my Manager Jason and his number is (803) ***.? I contacted the number and found that the number was the same contact number for the install company Install Masters, but the phone went to voicemail.

Refund I would like for Leisure Life Pools, Spas &Billiards to return my money for the cost of the pool in the amount of $3,199.99. The total I spent was $4,941.99 and I am willing to allow the company to keep the installation fee and the 15% Restocking Fee of $741.30. If I have to pay to have the pool uninstalled that will be fine as well, but the install price was $1,000.00 so, I am sure it would be under that amount. I will need the remaining amount $3,200.69 returned to me.
On May 22nd I Aric S spoke with Mr. in reference to him wanting to return his pool. He stated to me that he sought his Homeowners Associations approval for his pool before he bought it. He stated that he waited over a month for them to respond and decided to go ahead with the pool despite not having approval. I explained that we don't do returns on installed pools as they are deemed as used. The liner would need to be replaced as it is not reusable and the pools value is depreciated after install as well. I recommended to sell the pool on Marketplace. I offered to support Mr. by telling the customer they could contact me to verify purchase info. I felt by selling in the private market they stood to capture the maximum value possible versus losing money all together. On May the 23rd I explained the same thing to Mrs.. She maintains that our invoice says 15% restocking on cancellations. For clarity we do offer 15% restocking on pools, spas, and billiards not installed but ordered. Other items may be returned unopened for a 15% restocking fee.
